Kali Doom The government, like any large entity that draws from the public, is a spectrum of the population. The very best, worst, and all the averages in between. The ruling could be similar to an annual budget review where they have to show activity. The flawed statistics could be the work of a someone who has no formal knowledge of study methods. All of it could be arbitrary politics. We have no real way of knowing why except that this is a staple of bureaucracy.

Great work, keep up the good fight. At this point with the amount of history that's occurred the situation is obvious--this isn't about product safety. The majority of action by the CPSC here is dishonest, mis-representative politics driven by fear. When an aspect of government fears for its well-being (in this case legal action from sparse cases), it stops serving people and starts defending itself. In comparison even to the reach of current law this new law is an obvious contradictory outlier, but it doesn't tend to matter in situations like this. Duty to people doesn't tend to matter either. To a government body fearing risk to itself, the only thing that matters is its own well-being. All of the concerns they only voice about your freedom to sell responsibly and our freedom to buy responsibly does nothing in the end except highlight how they value the well-being of their organization above their duty to us and to our freedom. We've given CPSC the power to represent, and they will represent what they want unless we bring our collective voice to oppose and right it.

I suffer from depression and anxiety and have discovered that the tactile and creative nature of the product helps to center my thoughts, easing my anxiety. In the ENTIRE time I've had the magnets I have not lost a single one. Nor have I swallowed one. Nor do I intend to. By CPSC logic, anything labelled as a potential hazard IF MISUSED should be banned. My best wishes go out to Zen Magnets and I hope that logic and common sense wins. How else can I buy a Mandala set otherwise?! :)

Involve any of the U.S. House delegates from Colorado who claim to be pro-small business (they typically have an "R" after their name). Tell them the CPSC is willfully destroying a minority-owned small business in Colorado for no discernible reason other than to exercise their unchecked power. If that doesn't work, look into suing the CPSC. It's expensive and complicated, but it can be (and should be) done. If you're successful and awarded a monetary judgement in excess of $50 million, offer to deduct $1 million for every Zen magnet eaten by the CPSC Commissioner.

Their motive is to save their jobs and justify their existence. They can't ban products owned by multinational corporations who have endless resources to fight back and have the media in their pocket. When it comes to safety this is the parent's fault. They should be held accountable. That's why we have warning labels. If a child swallows Draino are you going to ban it?

Why not ban everything kids get injured with. No more scooters, bikes, balls, pogo stick, skates and so on. I remember back in the 90's when roller blades became popular and it was all over the news about how kids were getting hurt using them but no one tried to ban them. Then I remember how when the razor scooters first came on the market and all the kids being injured using them. No ban happened. This is just insane. I feel sorry for the people who were injured but the ban is totally unnecessary and wouldn't even be necessary now. The whole magnets thing has kind of ran its course hasn't it? I mean I don't see anyone talking about magnet spheres anymore. I just bought some Nanodot Megas and I will try to get some Zen Magnets before the ban. I wanted Nanodots but I can't buy them.

Yes, I think that's the point. In that three-year period, only 72 cases were actual magnetic ball injuries (the ones listed). Not 1700, as reported by the CPSC.

Randy Marsh I don't think so. They looked at a sample of hospitals and extrapolated the findings to the rest of the country, which is an acceptable form of statistics. The case they made in the video was that they included bad Positive results for things like "marbles" or "ball" and such. There may have been a few of those that were false positives, but it looked like most were actual magnet injuries?

Randy Marsh Actually, the projection to 1700 from 72, isn't necessarily faulty. But the 72 they picks is faulty. Most are magnetic balls, but magnetic balls have been around for long time. It's hard to say how many of the 72 *Are* actually from high powered magnets, but performing the same analysis on the 3 years prior shows that the analysis method is garbage.

Randy Marsh Further, in looking through them it appears as if the likelihood of actually serious injury is extremely low. In that list there was one possible serious injury, but the vast majority of them were things like "mother thinks kid swallowed one or more magnets" and no actual injury. One case was a 2 month old that swallowed several of them and had no injuries, the magnets passed safely within a day or two.

So I’m thinking you just go to a CSRM (Concealed Strong Round Magnet) class and get certified to have them on your person. You could have open SRM carry laws but that will make anti-SRM people nervous. Of course, it’s not responsible SRM owners that we have issues with…it’s the criminals that don’t care about the ban or the SRM laws. In addition, the ATF will now be ATF-SRM and I’m sure the South American Magnet Cartels are going to smuggle them across the borders. It all comes down to illegal magn-igration…and Health Care…because it costs more under the Health Care Act to remove magnets than it used to. Then again, Colorado and Washington may legalize the use of medicinal SRM(s) but only if you have less than 10z on your person at any time. The government will end up spending millions on the enforcement of the SRM ban and eventually it will divide Americans yet again on the power of big government. Previous politicians will give testimonies on how they once “Used Magnets” but didn’t stick them to anything or swallow them. See, the use of SRM(s) is really a gateway to more powerful cool scientific (made in nature) things that we can’t risk the young people of America being exposed to….because of China…they are the #1 producer of SRMs in the world and we can’t have them beat the US in something else. Now that I typed all that out as a Satire…I think I feel sad that it’s kind of how the world seems to work.

As the documentation shows that most cases involved magnetic balls, and if Zen Magnets argues that these were not necessarily "high powered" magnets, then how could Zen Magnets argue the ban against their product or any other magnetic balls of this size? Why does the three years prior matter, if in fact the cases almost always involve magnetic balls? Don't get me wrong, I bought lots of Bucky Balls before they were no longer available, and I think we should be able to purchase magnets. But, the argument here seems flawed. Zen? The better argument, in my opinion, would be that the product is not inherently dangerous (no more than most anything else), with lots of data to prove it. Deaths/injuries occur with many objects, and that is not typically grounds for eliminating the objects. If magnets served no other purpose than to cause innocent deaths, then sure...ban em. But that's a ridiculous stretch from the truth.

The "documentation" shows an equal or higher number of hospital visits for the three years prior to the existence of buckyballs or zenmagnets in 2009. You'd have learned that by watching the video. The criteria for blaming a visit on ingested small round magnets would include reports with the words "strong & marble", "rare & round" or even "high & ball". Many of these reports are likely sports injuries such as a high ankle sprain while playing basket ball or tripping on spilled marbles.
