If you ever buy on eBay; you’re basically safe. If the watch is not as described, you can escalate the case to eBay and they’ll force a refund if the seller doesn’t make it right and eBay determines based on your photos and their message telling you the watch was fine. In fact... eBay is known for buyers saying item is not as described just to get a refund for buyers remorse and this usually works. No need for lawyers!

I sold a watch on Chronocouple of weeks ago, absolutely genuine, with box, papers, in impeccable condition, a great deal. The reason why I sold it was simply a collection upgrade, but I didn't want to sell it cheap, because I was wearing it when my son was born, and it had a great deal of sentimental valuefor me. I did mention this to the guy who was negotiating. He finally bought the watch, but he was very suspicious all the way. He even excused himself because of it after the delivery, he was very relieved when he opened my package. I guess there are exceptions, but I will definetely have to change my communication stylefrom now on! :)

The worst hit I got collecting watches was sending a watch to the UK. I sent it from the Spanish official courier, with a tracking number. The tracking system stopped at the UK Customs. The Spanish courier made an official claim for the package but nobody answered on the other side. It was declared officially "lost" and the basic insurance was 50€. But things do not disappear. It got stolen. If you are the maggot that stole my Tissot Visodate at the UK customs bare in mind that you are cursed. I think about you almost once a week. I'm growing stronger since then and someday I will find you and exact my revenge upon your spiritless being.

To clarify one point: while it is generally true that ignorance of the law is no excuse, the law typically protects a good faith purchaser for value. That is somebody who buys an item in good faith, not knowing it is fake, stolen etc ... for fair market value. If you buy something well below fair market value you are not protected. That means 2 things: 1) generally that purchaser won’t face criminal prosecution for trying to resell the item and 2) in the event that the item is stolen- the purchaser holds good title to the item against everybody except the original owner. Nobody else can make you surrender the item simply because it was stolen. Not the police, a dealer, watchmaker or anyone else- unless there is a valid claim by the original owner. In your example of an eBay listing: it depends if the person genuinely doesn’t know of an issue or if he’s lying to you and using certain phrases to cover himself...but in any event it’s unlikely that they would face criminal charges.
@CasebackWatches5 жыл бұрын
You're right. If you can explain that you're action was under the assumption of a legal transaction, then nobody can prosecute you. Problems will arise only if you act careless in a situation in which a criminal backstory is likely.

I’ve sold a few watches on eBay (along with other expensive items like knifes, musical equipment, etc) and thankfully I haven’t been scammed yet but certainly not for a lack of trying. Also, it seems like you cannot list an item on eBay these days without getting at least a few messages saying: “Hello, what is lowest price you will accept for watch?” I just received three of these messages today in regard to my Hamilton that is currently up for auction. What could I possibly have to gain by undercutting my own auction and telling you the absolute lowest price I would accept? Why do people expect someone who is selling something to do all of the negotiation for them and simply say “this is the lowest amount of money I would accept.” You’re supposed to be the one making the offers. I list a price, you make an offer and then I will either accept or decline that offer. Asking the seller to immediately skip all of that and go straight to their absolute bottom line is classless and lazy. I put the watch up for auction because I’m confident that it will sell for a good price but I’m also hoping that multiple people will really want it and perhaps the bid will go a little bit higher than I would have gotten with just a straight up sale. It just doesn’t make sense to me. I would never send a seller a message asking “what’s the lowest amount of money you would accept for this item?” If I list a watch in great condition for $1,100 and the current market value of that watch is $850 - $1,150 depending on condition, I might eventually be willing to accept $900 but why would I just come out and say that? Obviously I’m hoping to get $1,100. If the watch hasn’t sold for a few days or weeks and you came to me with an $900 offer, I would certainly consider it but I’d never just come out and tell you the lowest amount I would accept. It takes away all of my ability to negotiate.

Ebay has really gone down the drain. I was selling a lot there four years ago, but now i have stopped selling on eBay since they forced my to accept PayPal payments because I was repeatedly scammed by buyers. One of the tricks is to buy the item and then return it, but they only send an empty box back and it's almost impossible to prove you've been scammed ( which is why I recommend to always filmed it when unpacked something ). And this is just the tip of the iceberg but don't want to explain the other tricks here on KZbin....

There was a vintage Patek on eBay last week and it only had a bid to £1,400 I thought this was strange and then I read the description, which said that it was being sold by a late man's nephew, who said he knew nothing about watches. The watch looked new, which was also strange. And of course NO RETURNS was declared in the info. So I emailed the seller and asked if the watch had been examined by a watchmaker to confirm authenticity, and of course said he had not. It went to some pore sod for just under £1,500

After the auction end the seller contacted me to ask if I was still interested as the winner would not pay 🙄. Yes I was, I replied saying only for the start price as the other persons bids where effectively all void. Guess what? I had no reply. I've bought about 25 vintage watches on eBay in the past year, and returned five of them. I've had watches that lose 5-7 minutes a day even though they claim that they were just serviced and "keep good time." In these cases most sellers are reasonable and offer a partial refund in lieu of return (though I always go for a return). According to eBay's policy, the seller is always responsible for paying the return postage. Ebay (and Paypal) make it very easy to open a case and get your money back if the item is not as described. The crazy thing is that all the watches that I returned ended up straight for sale again, with the exact same description as before ("keeps good time"), waiting for the next sucker who doesn't have the energy to make a return. One seller even blocked me from making future purchases after I returned two watches that were not as described. No huge loss for me, but funny to find out when I was considering another purchase from them.

The rare vintage watch is used frequently in ads and while may be stated it infers it is desirable and rare, collectible and sought after when it is rare, can be a piece of mediocre horology when it came out, is still that and likely worse today, the. Asked did not sell and or make many, therefore it is rare and also not worth the money at all as there are superior vintage watches worth paying a premium on. There are rare vintage watches that also will cost a fortune to repair, if you can find a watchmaker to take it one as parts are not available for it, so almost all watchmakers will decline taking it on, often stating stating it can’t be repaired .

A common lie with vintage watches on ebay: ''Although an officially certified chronometer watch gains 2 minutes per day because it is a vintage piece...'' That's rubbish - a COSC certified chronometer from the 60s or 70s if properly maintained and in good condition has no reason to not perform with the same level of accuracy as it was new. Such a big deviation from COSC standarts means the watch has been neglected for decades and its movement is crap.

Second that. There is no technical reason for non cosc performance.
