Andrew, you're conflating two issues. After declaring residence at the town hall, you don't "go through the process with the court system." Registering one's right to citizenship happens directly at the town hall where the residence was declared. However, for people who do not already have the right to Italian citizenship because their female ancestor was able to transmit the line of citizenship (1948 rule), they can go through the court system with a lawyer, hence not requiring residence. Therefore, most people would go through a town hall (or a Consulate abroad acting in its place) whereas the courts are the exception to the rule.

My wife (born in Southern Brazil) got her "citadinanza" recognized in just a few months in 2018, even under a broken chain situation (her great grandfather was Italian which came to Brazil by the end of the 19th Century...neither her grandpa nor her father ever had the citizenship). She only used an immigration lawyer to help her gather the docs, apostiles etc, then hired the services of an agency in Imperia, Liguria and had to travel to Italy and stay there in order to take all the steps presentially with the local "comune". Came back with everything ("codice fiscale", ID, "pasaporto", validated D/L etc)...the processes via consulates are the ones which take years, so we were told.

I can confirm much of this. My "comune" was also much faster to produce documents than the Italian consultate in New York. While I don't suspect much has changed in over 30 years--your mileage can vary depending on the specific "comune" in question. Cheers.

Look up "Italian citizenship assistance," they are a private firm that is helped me put the paperwork together and translated the needed documents. But don't be in a hurry: I started the process in 2019 and I'm still waiting for my passporto. I may move to Sicily before that happens at this rate.

@@SikDigitz Thing is, unless you are fluent in Italian, you kinda need a middleman for this. Italian bureaucracy is legendary and it's hard for even Italians themselves to get things like this done.

Hi! Both sides of my great grandmothers naturalized automatically through marriage before 1922. So in a 1948 petition in court, is it more convincing (ie: twice as strong) to a judge to see that the citizenship by descent exits - because both great grandmothers passed citizenship down to respective sides of applicant's grandparents, which then passed their citizenship down to applicant's parent - to applicant? So, in theory, are two heads better than one?

I tried doing this from my great grandfather, but I got super confused about when he became naturalized and if that was after he had my grandfather. Also, finishing these documents would almost be imposible.

Just to clarify, it's not the 'intention to naturalize' date that counts, but rather the ACTUAL date your ggf naturalized compared to the birth date of your gf. You can ask for the naturalization document via USCIS if you have some information on your ggf, like his birth date.

How useful is Italian citizenship though if the Italian government will still tax you as a resident if you reside in a country they deem a “tax haven”, including the UAE, Malaysia, and the Caribbean islands?

If a citizen and reside abroad, no tax from Italy as I understand it. You have to be careful to not to claim "residency" in Italy to avoid the tax.

Even Ireland is slow as they closed their offices during the pandemic which caused a backlog. It took me almost a year to get my passport.

Very good point! I'm jumping through the hoops to get jure sanguinis citizenship now and it is indeed a pain. I may just pack up and live in my grandparent's home of Catania in Sicily once travel restrictions are lifted and my little ebook business has a good enough revenue stream going on to live there. But the good news is that Sicily has one of the lowest costs of living in Europe, and it is absolutely *beautiful* in most places.

So my child’s grandparents were born there, dad was born here but lived there for years, and child was born here. Is it possible for them to get an Italian citizenship by descent?

You need to order your sons fathers long certified birth certificate that will show which citizenships they had at the time of dads birth in your country. So if it says Italian citizenship then most likely. Then you would need to order the American citizenship certificate that will prove exactly when he became American.
