The "2 girls 1 cup" comparison was spot on. I remember back in school kids would show this video on a laptop to people and film their reaction and laugh about it. Theres literally thousands of videos on KZbin just showing people that video. Also the Pain Olympics videos, and other nasty shit. Another thing which I have seen is like Japanese gameshows where celebrities or whatever is shown reacting to viral videos. The entire concept is old as balls.

A trademark typically only applies to the specific purpose it was granted for and related markets/services. For example, Apple Inc (the Beetles) and Apple Computer were both allowed to have apple trademarks. It suddenly became a problem when Apple opened the iTunes Music Store and stepped on Apple Inc's toes. If you recall, Apple Inc refused to allow their music on iTunes for about a decade. They finally buried the hatchet, but it's still a good example. If Apple Computer had been in music in the first place their trademark never would have been granted.
