The problem with the death penalty is not the legal justification, the state's authority to kill, or some sort of injustice. the problem with the death penalty is that it's administered by the state and the state is garbage.

Thomas Sowell makes a pretty good argument in his book Knowledge and Decisions. The threat of the death penalty can be an effective deterrent, but it has to be done properly and efficiently. Our justice system needs massive reform to achieve that.

I am fundamentally opposed to the death penalty for one simple reason: our courts aren't perfect. There are already way too many people who get wrongfully incarcerated, and I do not like the idea of those people potentially getting the death penalty. If you are alive, at least you have a chance to get out later if whatever verdict you have is overturned. If you're dead, that chance is gone. The government also faces no accountability for wrongfully incarcerating and/or executing citizens, and as such I will never agree with a death penalty.

Law student from Europe here, the idea that there is a way for the government to legally kill people is just insane. We are post socialist country, lot of people were executed in the 50s for political reasons. Their guilt was also proven 'beyond any reasonable doubt'. Once there is a way, it's not about if there will he a slip, but when. It's better to 1000 people serving life sentence than to execute one innocent person. Death penalty is connected ho high emotions. And the law should not be based on emotions.

But there couldn't be a less emotional verdict than death. A life for a life is the perfect example of "justice." @@troyboy811 Here in Europe our criminal law is built on some principles. One of them is principle of humanity. The law has evolved, we no longer seek 'eye for an eye'. That is a natural emotional reaction - to seek vengence. Criminal law should not be about vengence. You can't undo death penalty. Also by death penalty you are not only punishing the perpetrator, but also his family. That should not be the case. Families should not suffer. Two wrongs do not make something right. By committing a crime perpetrator denied his humanity, but that does not mean society should do the same.

Yeah I'm with you in concept but in practice even that's messy. Someone killed your girlfriend after you left her house that night? Well your DNA was found inside her and under her fingernails. That's concrete physical evidence. Or a family of 4 was brutally attacked but one of the victims survived and picked you out of a lineup. They are 100% sure it was you and gave very convincing testimony in court, pointing right at you and saying "I watched him kill my brother". But they were mistaken and your Defense attorney's attempt to illustrate that just came off as you sending your lawyer to victimize your victim yet again. So as much as I'd love to have a world where the truly guilty are taken out behind the courthouse after the verdict and save the expense and burden of paying for their appeals and food/shelter/medicine, a lot of times it seems we are stuck with having to warehouse scumbags forever and only occasionally get small "victories" when we manage to free an innocent person after forcing them to live in the scumbag warehouse for a decade or more.

I'm in favor of doing away with the death penalty if we bring back corporal punishment with the understanding that is neither cruel nor unusual. You wouldn't have to create ludicrous prison sentences or accept prison as crimina community college if a bunch of sentences included repeated horse-whipping. As a taking, the state can be forced to compensate you for any sentence - time, fines, or corporal punishment - in proportion to make you whole. But there's no adequate compensation for a wrongful execution.

Firing squad is the way to go, multiple large caliber wounds creates an immediate drop in blood pressure to the point where you're unconcious within a couple seconds, better than drowning for 20 minutes in air. If we as a society decide that the death penalty is something we should do then I think it's required to find the people to do a firing squad, dressing it up as medicine is a pretense that hides what's actually happening and beyond that it creates a disturbing and horrific death, botched (which means death is more than 10 minutes, and 9 minutes of suffocating in air does not sound pleasant to me) a third of the time. As Nick mentioned, the chemicals they use are injected quickly in such a large volume and are caustic so they literally do burn through your flesh while you're paralyzed in agony and then get pumped around your body and they still aren't dilute enough to not cause damage so it is burning from the inside, if the vein collapses under the heavy pressure and caustic agent then the chemical is pumped deep into tissue and you have no pain relief as it burns through soft tissue and you're stuck with a melting bicep while they try to find another vein (I know they don't inject into the bicep but that's where the drug goes immediately and then the burst happens either at injection site or shortly downstream towards the heart through the vein which is the area the bicep is in if injected in the typical place opposite elbow. That causes immediate muscle death and if you look up Rhabdo from people at the gym they go from working out to collapsing in incredible amounts of pain as their kidneys are ripped up by dead muscle tissue, happens so fast so there's no way you're dead before that happens either on a botched or even 'succesful' injection. Edit: It's possible that the electric chair might have actually been better than lethal injection when it killed in one shot, I mean yes you burn and are on fire but all your nerves are firing so there's no discernable sensations just one massive whole body trigger and then you're dead. When they were introducing lethal injection, before world war 2 they were looking at and I think experimenting with gas chambers but that got the kaibosh quite quick, to be honest though, 100% nitrogen is probably a pretty good way to go, it's the way people do suicide and you can find videos in compression chambers of people going hypoxic and trying to do toddler shape puzzles and they can't and then they get giddy where they can't even put their own mask on, a couple minutes of that and they're dead but there's no way anybody would ever even float the idea of gassing due to obvious reasons

Would you be OK with that? I'm not. Our DOJ is out of control. Many state AG's are, too. How long before they'd start executing prisoners for more menial crimes? Especially, if they were white males? Yeah, Philip Nitschke's Exit International has that "Sarco pod" (short for Sarcophagus) that looks like one of the cryosleep pods from 'Alien.' It uses nitrogen gas, and supposedly causes a painless (and apparently even 'euphoric') death within 30 seconds. They plan on using it at those assisted-suicide clinics in Switzerland, which currently predominantly use pentobarbital (either injected or swallowed) to cause a painless death. I even wrote a paper in law school this semester on why we should replace lethal injection with the nitrogen gas method.

My problems with the death penalty; 1) Outsourcing the punishment to the state. If the defendant is found guilty and sentenced to death then it is the duty of the jury to pull the trigger. And I mean 12 jurors, 12 guns, 12 bullets. Spare not their feelings. They told a man to die and now they fallow through with it. 2) Legal protections for the state against false convictions. If the state convicts someone, hands out a death sentence and later after the sentence is fulfilled is it found out to be a wrongful conviction; there should be penalties in the *billions* for it, paid out to the victim of the state's family. Executing an innocent civilian *should bankrupt* a state. Because a country that can kill the citizenry with impunity and never face punishment is a country that can commit democide.

1. There should be a threshold of evidence for giving someone the death penalty like cameras, multiple witnesses, fingerprints, and DNA. 2. They should have to make the death penalty the only punishment on the table so that if the jury decides the defendant is innocent they walk free. 3. There should be someone completely disconnected from the justice system who has the ability to access all evidence (which may have been restricted during the official trial by the court) and is required to do a validation of the reasonableness of the conviction.

Get your editor to filter out the background noise. It's very consistent so filtering it out would be pretty painless.

I'm for it, but it must be held to the absolute highest standard of evidence and assurity of guilt. A case like this one doesn't even come close to those standards.
