Good evening sir, Today’s motivational quote is “Ambition is enthusiasm with a purpose.” Editorial is related to the assassination of Ex Prime Minister Rajiv Gandhi. In my opinion:- Ex Prime Minister Rajiv Gandhi who was assassinated in the year 1989 and now the Supreme Court has granted remission in favour of A.G. Perarivalan who is one of the seven accused those who did the heinous crime. In this case, Mr. Peraivalan was accused of arranging battery which was used by his colleagues while doing such crimes. When the heinous crime took place he was only 19 years and currently he has completed over two decades in jail. Given his crime and demand of people, finally he has been granted remission by the Supreme Court. At first, the mercy petition was filed by the lawyer of accused side and then the case was forwarded to the Governor of state with the consent of council of ministers as we all know that the Constitution gives special power to the governor for granting remission but in this case, the governor has done nothing due to which it has taken much time. However, lastly he has forwarded the remission petition to the President of India for further disposal but nothing outcome was come. Lastly, the Supreme Court made intervention and utilized the extraordinary power which has been conferred under Article 142 of the constitution and granted remission in favour of Mr. Peraivalan. In this case three main pillars of the country i.e. the Central Government, the State Government and the Governor, all were involved but no one was keen on concluding the issue. There are two questions which need to be answered by the Union Government, State Government or the Governor. First is that whether remission of any accuses can be granted on the advice of people? Second is that when council of ministers of any states give consent on granting remission to the accused and forward the case to the governor (competent authority) then the governor has right to delay or forward the case to the President of India? One thing is obvious that the Constitution of India gives right to all the people then all must work following its norms, be it related to the ordinary people or any prominent people.
