If she dissolved or never had an LLC then they get to go after her as a person. That means all her personal assets are up for grabs to help pay if Chrome Hearts wins. That is why you always have an LLC to protect yourself, even if the business is just you. This could completely ruin her and her family financially.

How much do you want to bet their “copyrighted” designs are straight up ripped off from a circa 1970s or 80s Navajo or other Native American silver work design? I’m no expert in law, patents, or jewelry design, but I’m pretty sure if the design has any links to culturally held intellectual property, it can’t actually be copyrighted. So just throwing this out there…also if you look even further back this cross style probably goes back to early Spanish missionary crosses. So I’m surprised they were even able to get a patent on the cross design in the first place…

the Van Cleef clover design cannot be copyrighted as it's a generic geometric shape. The inspiration came from the palaces of Islamic era Spain (Alahambra). Islamic art, architecture etc. is very much based on geometric shapes. If for example Van Cleef added more details into their design then yes they have right to file a copyright claim that can be approved. For example Louis Vuitton pattern contains the clover motif/shape but on it's own is not trademarked. But if you take the whole pattern of Louis Vuitton with the different combination of shapes and the logo, then in that case you can trademark as LV did. CH design of crosses to me it's not groundbreaking very similar to many gotic or goth crosses out there. I've seen some which are very similar to theirs , but to be honest it's very probable that in some old book or very old building you might find a cross that matches CH. It would be very interesting if CH will still have right to the trademark claim if someone finds it an old depiction of the crosses?

Mmm to be honest that is one basic as hell cross that could be possibly from a historic example, so is it genuine from Chrome Hearts to begin with? Also those type of registrations require measurements because small changes in proportions change the design no? It seems they registered that cross as a logo for jewelry, that seems to be the thing here. I don't know who HRH is but that jewelry does not look handmade unless she simply bought the crosses and other materials somewhere wholesale and assembled them at home.

Her designs are not handmade at all, she absolutely buys from an aliexpress-like seller, so she is also lying about her products being made in America. There’s no way they could all be handmade like if you examine logic. She brings too many products to the market too fast to be making them all by hand. She is one person, she has stated many times she is the one handling all the jewelry so there’s no way she is hand making all of these pieces and every single week she has a bunch of new pieces up. The most she does is attach different clasps to them, like sometimes she’ll film herself doing that but that’s the extent of it and that still does not count as handmade. Also a simple reverse google image search would reveal lots of different vendors who are selling her products in bulk. I’m genuinely not surprised whatsoever that she is getting sued, she has been lying about the origin and construction of her products for years, if not the entire time she’s had this business. And in this case she’s backed into a corner and her reputation is comprised no matter what she tries to say to defend this specific situation. If she says it’s not her fault because she didn’t design the crosses then that means she lied about the jewelry being handmade.

Well the law is clear on trademark infringement. Chrome hearts owns the trademarks to thier designs so they're entitled to defend that if they think someone else is earning from their trademarks.
