Effect of novation The contract discharge by novation . The parties to the contract substituted a new contract with a old one is known as novation In the case being old contract in existence some new contract substituted with the same party or between different party The considera is discharge of old contract

If known to the parties-it would be observed that an agreement constituted, quite unknown to the parties ,where impossibility of the performance and hence void If unknown to the parties-where both the prmisor and promisee are ignorant of the impossibility of performance of contract is voud If known to the promisor only-at the time of entering into the contract, the promisor alone known about the impossibility of performance. The promisee can claim compensation for any loss suffered

Appropriarion of payment - where performance consist payment of money where several debt are paid, the payment shall be appropriated by provision of section 59 60 61 of indian contract act 1872 1)at the time of payment , the debtor has right to appropriating the payment 2) in default of debtor, the creditor has option of election 3)in default either the law will allow appropriating debt in order of time

When the promise is reciprocal and dependent, when a promisor who has to perform his promise before performance of others promise fails to perform it ,then he cannot claim performance of other promise , and he is also liable for compensation for non performance
