anticipatory breach of contract is a brach of contract occuring before the fixed time to performance has arrived. the promisor refuses to perform before fixed time of performance has arrived. anticipatary breach of contract in two following ways 1)expressly by word of mouth 2)impliedly by condact of one parties

effect of anticipatory breach 1)either treat the contract as rescinded and sue the other party for damages from breach of contract immediately before the due date of perfoemance or 2) he may elect to not rescine and treat the contract as still operative and wait for the time of performance. in this case the promisor may perform his promise under the contract or can also take advantages of supervaning impossibilityin which effect the discharge of the contract

effect of actuall contact 1) at the time the performance of contract is due i.e mr A promised to deliver good to mr B on sept 1 and in same date he refuses to deliver the goods 2)during the performane of the contract i.e where during the time of performance one party refuses to perform his promise expressly or impliedly

in the breach of contract , the party who is suffering from the breach of contract is entitled to recieve from the other party who broke the contract compensation for loss and damages caused to him by brach of contract compensation is claimed for any loss which is natrually arises in a usually couse of event special damages can claim only on a previosly notice no compensation is payable for any remote or indirect loss
