Recently Levi Triffit and myself were investigated for a series of infringements regarding our content creation in reserves managed by Parks and Wildlife Tasmania. Here's a breakdown of everything that happened, what we did wrong and the outcome of the investigation.

You're right. But they don't want the outside world seeing the Tassie interior as they're logging/mining most of it (if not right now, it's under lease). If people don't see the beauty they won't care when 100+ year old tress are felled in coups.

@@georgewright9223your right and it's not just Tassie. Mining companies have leases and there eye on most of Australia. What do you think the controversy is about up north with sacred sites an the Mining industry . It's not about tourism or anything else , it just seems to me another control tactic. In my career as an environmentalist I have realised that people in society will only care for the environment if they 'value' it personally, and to value it they need to 'connect' with it. Your videos help thousands of people build their connection with and value of the environment, please don't underestimate the value of what you're doing. Keep up the great work! @Rob.Parsons

My sentiments exactly. Our commercial interests take us into state land and over many years i have come to the opinion that we need to encourage all interests that take people into state lands. It should be done in a way that encourages responsibility. This way the population has a chance of holding values for places which largely are not a product of our manipulations. I was beginning to think the Tassie Parks were enlightened in this sense. However this is very disappointing. Meanwhile I see old growth forests are being clearfelled which should be a criminal offsense by now.

19:54 Hi Rob I have watched and enjoyed so many of your videos which are so informative and inspiring! My advice is to engage a lawyer what Tasmanian Parks and Wildlife are attempting to do is a restriction of trade without any valid reasons. what are these people trying to do, put people off visiting the wonderful state of Tasmania. Misuse of power which I don't believe they have, how about they assist people like yourselves (you and Levi) who provide an invaluable service to people, and showcase the wonder and splendour of Tasmania.

Bugger Rob - I wrote Parks Tasmania an email. I include it below. Maybe if everyone who is pissed off with this did the same it may do something To Parks Tasmania I am a resident of NSW but have been to Tasmania many times to walk and adventure in your wonderful national parks. I have always been happy to spend money whilst being a tourist. One part of keeping the Tassie dream alive is to watch people who live in Tassie interact with the environment in a respectful and ambitious manner. As such I found Rob Parsons on KZbin and have followed his adventures vicariously, whetting the apetitite for more Tassie adventures of our own. I was mortified to see that Parks Tasmania has subject content creators in Tassie parks to draconian restrictions and heavy handed legal threats. I want to return to Tassie and spend money BECAUSE of the wonderful content created by people like Rob. Instead of understanding that Rob shows us how to be self reliant, to learn bush skills, and how to respect the environment, Parks Tasmania seem to be using out of date rules to restrict the very people that showcase proper interaction with our environment. I hope that this is a case of a manager going far beyond their remit and that Parks Tasmania will work with those who show us how to live with and love the bush. Sincerely Phil Thompson

This really sucks, though where you've made a mistake and broken a rule, then fair cop. Typical our laws will support logging of native forests and yet a youtube channel is treated like an existential threat. But what really annoys me here, is that this is such a huge missed opportunity for PWS to work with you (and other tasmanian content creators) as partners, to promote safe and responsible usage of these places. They could be like "Look, here are the rules, here's where you've gone wrong, let's work out a way we can work together to make sure your promotion of our wilderness spaces is educative about proper usage". Lawyer up and I reckon most of this will disappear, and be careful about what you say in videos like this - it can be used against you as admission to various things.

To keep this in perspective, the offences being articulated are not felony offences - there will be no trial in front of 12 of your peers as jurors. These are what’s known as misdemeanour offences that get heard in a magistrates court of petty sessions. You don’t go to jail for these things. The Nat Parks people’s are essentially “Mall Cops”. The magistrates court of petty sessions is where you go for speeding and parking offences. I would say that if you do contest the charges and get a lawyer etc, it would be unlikely to “go the distance”, the negative publicity potential for Tassie Nat Parks people over yours & Levis channels are not inconsequential. The reason yourself & Levi are being targeted is because of your subscriber base. I’d suggest that the intention would be to get the message out to the thousands now of other KZbinrs in Oz with monetised channels & a flash 4wd & Caravan & Drone - travelling around Oz and filming new Nat Parks scenery every day without buying the permits / licenses and paying the fees to start obeying the laws. If I were still working in my former role for DPAW and investigating this issue, I could generate $millions in revenues within a few short months just viewing KZbin videos and downloading all the offences I see. You have to remember that with the cessation of logging pretty much Australia wide that these departments are losing their hardwood logging royalties. So in order to make up that list budget & thus keep their salaried jobs, they have to find new sources of revenues. Even discrete off grid completely self containing camping now you have to book and pay in advance online, something that largely used to be free. It’s all about new revenue sources from tourism etc to replace the lost logging royalties. So the filming fees, camping fees, Nat Park Entry fees etc is what’s being targeted to make up that list revenues. And if you want to make a living from KZbin filming Nat Parks then your going to have to pay the fees and apply for the permits / licenses. There’s very few free lunches in this world, we all have to pay our way. That includes yourself & Levi & a great many other monetised KZbin channels. Something you & Levi haven’t considered yet is that it’s likely you might also face fines from the Tassie Inland Fisheries people. Rolling big rocks out of the stream bed & scratching out all the gravels from those cracks in the bedrock - those gravels are the spawning beds / redds for trout and other native fishes as well as all the 9 families of aquatic macro invertebrates (aquatic insects & freshwater crayfish) that breed / spawn in those gravel beds, and these are the food items for the trout & native fish that come under the inland fisheries legislation. If everyone did what you & Levi are doing, it would only be a question of time before every gravel bed in every river became silted up and the aquatic ecosystems in these rivers all died. We all want to be able to do “whatever we want” in order to make a living and mostly if it’s private property that you are doing it on then to an extent you can do whatever you want, however when you start doing it on public land, we’ll that’s a different story.

These Parks staff maybe a little jealous but would The restrictions they have highlighted are not only unintelligent but place very strict control over all Public Land. That allows them a wide scope of legislation to use if they wanted. It seems every staff member can interpret those conditions individually Set up a petition to have the legislation updated to include today’s technology. 5:21 Remember you are promoting Tasmania at no cost to the government and their agencies or the citizens. The Premier and Tourism Minister would love to hear about this.. Especially if you get signatures on a petition.. Good luck

Sorry to hear about all the drama you and Levi are copping mate. It must suck. I find Tassie to be so restrictive with what you can and cannot do. As you mentioned, it sounds like Tassie Parks and Wildlife needs to catch up with the modern times. In NSW, KZbinrs like myself can apply for an annual small scale filming permit which allows us to film in all new parks. If I wish to fly a drone, that's when I need to apply for a proper commercial filming permit which usually costs around $250 (except drones aren't allowed in wilderness areas). And luckily, quite a few of our parks allow campfires and according to the NSW Firewood Policy, the collection of firewood for use in backcountry areas is allowed. Hopefully Tassie Parks/politicians can see the value that content like yours brings to the state and you can get the legislation changed to something similar to nsw. Best of luck mate.

No doubt the parks will be reading these comments, Rob and seeing as this could potentially make things awkward for a lot of content creators in Tasmania I think you should contact Google about it I asked Chat GBT:Has Google ever defended a youtuber in court? As of my last knowledge update in September 2021, I'm not aware of any specific instances where Google (KZbin's parent company) has directly defended a KZbinr in court. However, there have been cases where Google, as the owner of KZbin, has been involved in legal matters related to content on the platform, including copyright infringement, defamation, privacy violations, and other issues. In some cases, Google might provide legal support to content creators if their cases involve issues that have broader implications for the platform or its community. This could include cases that test the boundaries of free speech, fair use, or the Digital Millennium Copyright Act (DMCA). KZbin also has a system in place called the KZbin Partner Program that provides certain benefits to content creators who meet specific criteria, including monetization options and legal support in copyright-related disputes through the Content ID system. However, the extent of legal assistance provided by Google to individual content creators can vary based on the specific circumstances and the platform's policies at the time. ----------------------------------- Rob, I think this is something you should look into further because Google could keep the parks tangled Up In expensive court proceedings for years to come unless they drop it! Good Luck Cleggy

Hi Rob Love your work, but for your own interest a similar legal case in National Parks in the US was been filmed by you tube influences as well. Recently they too applied for commercial licence and it failed in court because it was aimed at large film crews. Not at individuals and small scales operations. It was found that the conservation act aimed at conservation not at making money from individuals. Therefore the damage done by individuals was non existent. The same as a person who might have taken film footage for there home. Therefore the court ruled in favour of the you tubers. I saw this on you tube u might be able to Google it. It might give u a basis for future discussions

1st Thing CONGRATULATIONS on the birth of your First Born, Rob & Erin! That's lovely to hear. What a shame such a wonderful time was marred by petty bureaucrats pushing their weight around. This is so heavy-handed, but then that seems to be the way of Things these days. After all, P&W are administrating Tasmanian Land for the benefit of us all, it's not there so they can rule an Empire. - I wonder if you talked to an attorney, because much of this sounds like semantics and if I was less generous, that they were seeking to make easy examples of you & Levi. When you see some of the crass stupidity that goes on, and the daily violation of Crown Land - parking a B-double on Crown Land day & night, a blot on the landscape & ugly for neighbours to look at, where's his Reckoning? The littering, 4Xs tearing up the trails - and don't forget the Trolls - a mean-spirited person might imagine trolls bombarding P & W with 'concerns.'... This sort of thing makes me very upset, because to my way of thinking, you & Levi do a huge amount for this state, promoting its wonders, beauty & wilderness - I wonder how many people you have enticed down here or out into the Tasmanian wilderness that wouldn't otherwise have gone? I suspect you pissed 'em off by not jumping-to at the get go, but I think their treatment & response is out of order and not commensurate with your so-called infractions. If they were really so concerned, I think it would have been wise to have bought you guys in & had a sit down - point out where you've over stepped the mark - BUT, drawn on your experiences & ideas for how They should move forward in this New Social Media Age laying some foundations for new rules & regs to accommodate adventurers & small film-makers like you, Erin & Levi - as you say, what of all the casual photographers out there on the beaches, and the small independents. I don't see the harm to flying a small drone in the places you have - the images have been amazing - maybe you need a license but to out right ban them seems ludicrous - in some instances, they have saved you from having to call out S & R. I think they have to be careful they are not just being arbitrary because they can. So, if you get your business license would that mean you could perhaps be a tour guide, trailblazer - publish your work in the wider world? Yes, def see Rockcliffe - would Lambie help, she's a firebrand! With half the State virtually off limits I couldn't blame folk if they took their Adventures elsewhere - shame I don't have a spare thousand acres you guys could explore. All the best & don't let the buggers get you down - I mean, what about all the twigs that get broken underfoot - their complaints are so out of proportion - what would they rather that you froze to death - I can't see how in the depths of winter you couldn't have a fire in an indoor fireplace - sorry, but this really winds me up! Keep safe & Stay Free.

Parks and Wildlife Tasmania should be giving you a cheque for educating people about conservation and our nation's history. I've always found your videos to be excellent content. Your integrity is fantastic. I have learnt so much more about Tasmania from you than I ever learnt from Parks and Wildlife. You have inspired people to move to Tasmania because of the incredible wonders you show in your videos. The research you do into our pioneers and the battles they faced is impeccable. Out of all the content creators out there, your videos are entertaining, educational and well filmed. Do not stop making content because some outdated idiots don't believe in change. I'm sure the money you make from your KZbin videos is nowhere near the value of intellectual property and creative skills that you have invested in the state of Tasmania. Wow, I thought Tassie was better than that. Hold your head tall, and thank you for what you have done.
