I agree with Kelis's sentiments and I enjoyed listening to her point of view. She's also correct that her hair looks cute. Incidentally, I walked down the aisle at my wedding to Dracula's Wedding, a duet by Andre 3000 and Kelis (great song - and it's not rap or hip-hop). Although I'm very happily divorced now, I stand by my spectacular choice of wedding music. And my hair looked cute too.

I just recently found out about your channel, it's been quite a pleasure to hear someone break down songs to determine what works and what doesn't. As a musician myself with no knowledge of music theory that just rolls with instinct I like when a more knowledgeable musician discusses music the way you do. You probably won't end up reading this, but man I'd love to hear you talk about a band like The Dismemberment Plan. Songs like The Ice of Boston or Gyroscope would be really interesting to hear a well-informed inspection on. The thing is that Beyonce is stealing all the time. Since years. And she always gets away with it. The awful thing is that she even steals from little unknown artists. I really have trouble trusting any artist these days because it seems this happens so damn often and even bands like Coldplay or Radiohead have done it, which is messing with my trust in music.

I would have thought that taking a direct sample is worse than copying a melody as you're actually physically taking the recording too, but then either way is pretty scummy without asking first.

I worked in a studio in Manchester. We got a call saying a very famous manager and personality was coming in to record. He came in and just recorded one tiny little percussion section. So small. We enquired as to why he would do this and it was so he had performance and writing credits on the track so got more money for it. That is how and why managers get writing credits. As a producer myself I have often used bits of my own tracks in my newer pieces. As the producers of milkshake they might not have thought about it as stealing as it was their own work anyway? Wierd one

The thing is it was a licensed sample it’s just that Kalis didn’t get notified because she doesn’t own the masters of the song so the producers and writers or the actual owner of the song can allow the sample to occur. However I do believe that Kalis should have been told or notified about it because IT IS HER SONG

Is it her song, though? I mean, back in the day a record company would buy a bunch of songs from a publisher (or they had their own in-house publishing company and writers). Then they would have multiple artists record a song and hope for one of them to be a hit. They might even license the song to other record companies who would have their artists throw out a few versions. You could have the same song in the charts multiple times simultaneously by different artists. I’m just being Devil’s advocate here, though. I get that it’s her song in a sense. She is the face/voice of the song. But the Neptunes’ publishing company owns the melody/lyrics and the record label (Arista) owns the 2003 recording. It’s not her song. She just sang/promoted it. Edit: just watched the rest of the video. She seems to insinuate that she should have been given a writing credit back in the day. Forget everything I said lol

In the Netherlands we had a guy (working for BMG I think,) called Henk Jan Smits, he would put himself on albums in the credits as playing the non existing ‘supershaker’ and got therefore a cut from Sena. Which in Holland is the company making sure the “artists” get money every time their song is played publicly. Guess it’s a common thing for some of those industry people

I think Kelis is in the right here. But one thing I've always wondered is how they divide up the writer credits. If they use a sample for 99% of the song, and another for a very small portion, are they both given equal credit?

I used to work in music licensing back in the late 90s when people were figuring out existing hits that used unlicensed samples. It was a @*&##! nightmare! Normal bands, say, Duran Duran, agreed to split five ways for five members. Some splits with hip hop/samples were decided by courts. We had songs with a ton of writers, some getting a split of say 1.33%! Now? They know they have to license samples, so the split is worked out up front. For all I know, they’ve set a particular percentage for particular usage now. All I know is that it used to be a true nightmare! 🤣

The portion of the song I believe is in question is towards the end of Beyonce's "Energy". The backing vocals do a very similar "la la la..." that Kelis does in the pre-chorus of "Milkshake". Given the dispute I am not sure if the actual voice on the "Energy" vocal is Beyonce or a sample of Kelis that is altered to fit the song. A Rolling Stone article said that Milkshake was interpolated for Energy and not sampled which to my understanding means that they recorded that part of the song with a direct intent of having it sound like Milkshake. Some artist do this and give the original artist partial songwriting credit. I understand that Kelis is the artist for that song but she isn't listed as a writer. The two songwriters for Milkshake, Pharrell and Hugo, are both songwriters on the Beyonce song too. In rock terms I think this would be equivalent to one guitar player using the same riff in multiple bands. Maybe a bit tacky but entirely within their rights.

The whole pop music now runs on 3 or 4 chords progression. We will assist to more and more fights between who copied who and this is stupid. Here in Italy only the melody is evaluated in plagiarism cases because modern music is not considered original anymore, more over it has to be proven that the offender must have had some sort of contact with the victim's song to consider it a plagiarism so that accidental coincidences can be ruled out. This case is a no contest IMHO. Yet fighting over these things is a huge loss of time and money.

Plagiarism is plagiarism, and if it's an actual sample as opposed to an idea/chord progression, then it's literally stealing (without any clearance from the label/approval from the artist). Copying a melody to some degree is considered stealing, but it's somewhat open to interpretation. I'm not interested in the supposed quality of music of the past four years - the samples in question are almost 20 years old. Kelis also has some absolutely great indie/electro pop stuff for the record, though 'Milkshake' is definitely not included in that. Simple chord progressions in pop music has been happening since pop music was a thing, they just have different chord progressions that generally start in a minor key instead of a major key. Actually in the 60's it was more likely to only be a 3-chord progression. Every second British and American pop artists copied the Beatles early stuff.

In this specific case it's a sample and the songs share an author if I understood correctly. I'm no judge or expert but I suspect this would lose any trial.

I guess at the end of the day, the more songs that get created, the less possible unique melodies, progressions, etc. that actually exist anymore. Even talented songwriters have this issue.

They didn’t need to add that sample at all. The music is already too “busy” and they could have found another way to arrange it that didn’t include that extra bit. Regardless of whether they were legally able to use it, Kelis should have been notified before they used it.

It's difficult to hear if it's a sample or interpolation. My understanding is that sampling is using bits from the original recording of a song, while interpolation is re-recording something, possibly with some changes e.g. Coolio's Gangsta's Paradise or Ariana Grande's 7 Rings. If Pharrell and Chad are the only credited writers of Milkshake they are most likely owners of the publishing rights and are only stealing from themselves when it comes to re-recording the melody. But since they've removed the vocal bit at the end from ENERGY it might suggests that part was a sample they didn't actually have the master rights to. One of the takeaways from this is: just write your own lyrics and melodies, instead of having a team of 15 (there are 15 credited writers on the 1m56s long ENERGY) writers who still can't make an original song

This music is to my taste. The main thing to understand legally is interpolation vs. sample. The master recording isn't used. The rights were cleared, Kelis sadly has no publishing ownership in Milkshake thus Beyonces team and label didnt contact her...rude but surely all they care about in this case is legality. I feel for Kelis she is claiming she wrote on her first two records but The Neptunes are the only ones credited thus no publishing. this seems to be her main frustration. The music business is cold.

okay but Kaleidoscope is one of my favorite albums, so good. if anyone else knows Kelis' song Caught Out There (which I love, & was produced by the Neptunes/Pharrell) it has SO many similarities to Usher's My Way (which I also love & was produced by Jermaine Dupri.) I noticed this by accident a few years ago when they played one after the other on shuffle and I thought My Way played twice in a row lol. but no one else on the internet has noticed this or at least hasn't posted anything about it. I love Kelis btw. I think the problem is Neptunes in this case.

I'm a violinist and I've just been booked to dep in for a lead guitarist of a blues band that do all originals. I only had the chance to rehearse with them once, but every single song had a pinched riff - after the 3rd or 4th song I had to point it out to them. They were genuinely surprised. We then went through 4 hours of rewriting and performed 3 gigs back to back. Once they've trained up their new lead guitarist I may never see them again. I honestly believe if parts of songs have been nicked purposely or accidentally (and its pointed out) but they release them commercially then the original composer has the right to legally kick off. If the industry has found a loophole or two legally, once the song is released then the public generally side eye the theiving swines that pinched it. Remember Queen and David Bowie with the iconic Bass line from Under Pressure suddenly turning up in Vanilla Ices Ice Ice Baby?

I only seem to comment when I have a Nine Inch Nails story but the writing credits can extend as far as a single line of lyrics. There was an interview where Trent Reznor said Limp Bizkit's music was shite, and Fred Durst responded by writing a chorus almost entirely composed of NIN lyrics and song titles. He was then sued for plagiarism and Reznor got added to the record as a writer.

There's an organisation started up recently called The Pact, that has a page on Instagram and deals directly with this issue of publishing being stolen. I've had the same problem with Ellie Goulding claiming a share of one of my songs that she was paid a session fee to sing on, before she was well known.

Ultimately, pop, which has always been ‘manufactured’ to some degree, is now just a DAW cut’n’paste pastiche. Worse, everything has to have as few notes and chords as possible and a regular tempo so it can be mixed and remixed without much fuss.

A real funny story to this is I am a singer/songwriter and have been since 1999/2000 but never released an album until 2020 under the artist name RadioSpirit. On my second album coming out in about a month or so there is a song that was originally titled "The Darkness" that I wrote before The Darkness were famous so I changed the song title to "Darkness" as to not conflict.

@@PJF1981 I remember once on Radio 2 in a segment called Tracks of My Years, where a singer comes on and is supposed to name several songs which have inspired them, and they had, I think it was Ronan Keating or some other interchangeable chap like that, just name several of his own songs. "Well, I know it's me own song, but I reilly loike that one oi did back in 2004. Could you play that one again, so?"

Okay maybe “review” was a poor word choice. I was thinking more on the lines of explaining the process of how you and /or your mates came up with a riff, lyrics, writing, composition etc to a specific song. Maybe showing how the different ingredients are put together in a recipe would explain why we love the dish so much.

I recall a helluva stink when TV writer Terry Nation used the same script for an episode of The Saint and for The Baron, with a few characters' names altered. No-one noticed in the UK as they were broadcast with an interval of time in between but in the US one station managed to show them both on the same evening, which led to some embarrassment. I wonder if he had to repay half his fee?

Yep. John Fogerty was sued for sounding like CCR’s John Fogerty. Imagine the same guy having similar songs! “Run Through The Jungle” vs “The Old Man Down The Road”.

I do believe she should have been consulted, I dunno how the sample works but with 2 "controversies" in 2 days I can't help but feel its also deliberate to drum up attention to get more sales and to increase the value of those earlier sold hard copy albums that will remain unchanged. Undoubtedly they will have held some back too so they can personally profit from those later sales. Easy to say 1000 advance copies were sold when in reality they released 300, held 700 and will actually sells those on places like Ebay later for higher profits through a series of new "fake" accounts.

It seems pretty clear - if the 'La-la, LA la' is Kelis' voice, it's an unauthorized sample - but if Pharrell et al wrote 'Milkshake' and own the publishing rights (which seems to be the case) - and they had another vocalist recreate the vocal, it would be theirs to use. In a way, it actually feels like a cool nod to Kelis & the success of Milkshake to include it - a different way to look at it.

Ok all I can think of,for some reason is John Fogerty (Creedence Clearwater Revival ) court case back in the 90s I think it was . He got sued by his old recorded company for well sounding like himself (early music he wrote) ok point is Pharrell Williams and Chad Hugo wrote milk shake and wrote this new song . Ok this is all fucked up . Going to sit back in the corner and listen to my t-Rex albums 😁

I think we all need more detail to make a decision . If the sample didn’t feature her voice or her playing any instrument , and the samplers wrote the original sample and probs own the publishing , then is there a case to answer? Genuinely not sure 🤔 You would have to see if a precedent had been set in a previous case methinks .

I dunno, not sure if i can come to a conclusion without all the info. If it's a direct copy/paste of part of a song she performed on (a true sample) I guess she has a point; as long as it's a part she performed on (ie. It involved her singing or playing an instrument, etc.). If it isn't, then Pharrel can do what he wants with the song he wrote, and telling her about the use of a sample would just be a courtesy. Unless she obtained some legal claim to any use of that recording, which I obviously am not privy to.

In my opinion it sounds pretty similar but not identical. Perhaps a lot of the producers' licks, tunes, 'riffs ' even, just sound like that. take Jeff Lynne for example - everything he does even when collaborating with others, just sounds like Him.
