What we need is the ability to intimidate casinos more aggressively, with much bigger fines, and gaming agents all over the floor at all times, who have zero financial incentive to help the casinos, and authority over all casino personnel, including the CEOs and heads of security. I would love to go the Joe Pesci route and get away with it, but violence against naive casino personnel would never solve the underlying problem.

There's a lot of attorneys that don't defend clients with respect to the law and what's right 100% . I garentee there are courts and judges that don't rule that way. This attorney seems too be on the side of the law and his client as the law applies. I can tell you from experience, no matter how strong you think your case is for you do not go to trial without an attorney.

Perfect basic strategy can still win you money, if you have a generous enough comp program, or fool the casino into thinking you are betting more than you actually are. You could also use indices without raising your bets to lower the house edge even more so, albeit not necessarily enough to get the edge. Another clever thing that sometimes works, is to hide a smaller denomination chip, under a small stack of 3-4 higher denomination chips, so they accidentally overpay you. You do that by angling the chips, similar to Richard Marcus' surveillance scam, only difference it is legal.

Finally, if you don't want a cop to tell the casino who you are, respectfully remind the cop that if he runs your name and DOB [through NCIC], that it is "CJI" data under "CJIS". They are not allowed to give CJI data to private parties. If they do that, complain to the FBI. Local police agencies risk losing access to NCIC and other databases if they don't properly protect that information.

The cop has no lawful right to your ID unless you’ve committed a crime. If you’re asked to leave a casino, you must leave or you’ll be trespassed and then the cops can get your id to issue a trespass warning. You have to be given the opportunity to leave first though. Far too many people don’t know their rights. If cops show up and demand your id and you haven’t been asked to leave yet, that is a violation of your 4th amendment right (to be secure in your persons, papers, houses and effects).

Casinos count on players being naive to gaming laws and assuming that since they are the house, they know the rules so if they say you’re breaking them they are correct. The one that really blew my mind was going to a casino in St.Louis and saw they added a second blue number to the roulette wheel. Most casinos now have a "0" and a "00" space on the wheel which doubles the amount of times the house wins. Same casino I was playing at a "Jacks or Better" poker table and they allowed extra players to sit because of the crowd , so nearly the entire deck was dealt each hand. (Yes , they had a table that copied the video game) After a while I realized that each of the five decks they were rotating through only had 51 cards. In one hand they dealt out 48 cards , and I could clearly see there were only three cards left. Each deck was missing a face card, which is a big deal in "Jacks or Better"

I have seen the damage Casinos cause. I am one of the few lucky ones. I went to Vegas for a wedding with $800 fun money and came home with a 5k slot machine 🎰 win on one pull. Plus I still had 6 out of the $800 left. I never went back because I know that it is highly addictive and the Casinos always get their money back and will eventually wipe a man out.

not about cards but. They had a progressive slot machine here, the Bettry Boop one.. My wife and I locked it up for the million dollars. the machine was going crazy,all these people where around.After 10 mins or so As the casino people got there, the machine went all black. It then turned into an hr fight of me,my wife and about 15 random people arguing with the casino. Because they said they dont have to pay if the machine malfunctions.. Either up stairs can turn off the machine or they have a hand held device.. What a scam the Casino is

From what I know, when you deposit cash (or exchange for chips) at a UK casino *it belongs to the casino,* and the casino can *legally* take your cash because you didn't "play according to the casino's rules".

The problem is that so many people either don't know their rights in these situations; or they don't pursue payment. I've seen it happen multiple times where I have told a player to call the state's gaming commission; and they just choose to let it go. That's why they keep doing it. It's just like when a business acts illegally and are fined $10,000. However their illegal acts made them $1,000,000. Do you think they're going to stop?

What really surprised me was when he said "it's their data", "you've given up that information, it's theirs to sell". Lol, as a European who's used to our GDPR data protection rights, this feels so backwards to me. Whatever information that's out there that's about me - I own it. Whoever keeps a record, does so purely on my behalf and as soon as I demand anyone to delete it, they're required to do so - just because it's mine and I have rights to privacy and data about me not being exposed and sold against my will - like my address, license plate or a picture of my face. I hope the States catch up some day

Here's another key thing to know. If the casino mailed you notification that you are excluded from a specific casino, even if you never got caught there directly with a history during or after the fact, you have no case. That one guy guy featured in that towel, and cargo shorts all over Chicago in Holy Rollers documentary, betting min to max, did not have a case against Caesars for trying to sneak in illegally and running away from a security guard who tackled him in Vegas. Scary thing is, more casino companies like Penn National Gaming, are looking to up their game and link their players cards, like Caesars, so they can ban you from all their properties for getting caught once. Indian casinos and Jack Entertainment has had a lot of success with that. The government doesn't care: they are being bribed by casino companies, and are much more concerned about making sure you pay your taxes, before they even consider making a ruling in your favor, aka the clean hands doctrine. Unfortunately, gambling taxes are a huge nightmare. Unless you are generating CTR's, there is wiggle room to not reporting gambling taxes, but you are playing with fire by not reporting it, thanks to Suspicious Activity Reports. I can only imagine the long, boring, complicated tax process KC had to endure, in order to report his winnings on his taxes. KC had to pay taxes in multiple different states, and did not always have the option to report gambling losses. I wouldn't be surprised if KC got audited for his casino ventures all over the country. Compare that to KC's glory days, when he spread his action all over Vegas with credit lines, and never had to pay state taxes on his winnings: only Federal taxes, where he was allowed to report expenses and losses on Schedule C, got lots of comps, and did not have to travel as much, especially after moving to Vegas for awhile.

I worked in Oklahoma native casinos for over 10 years. I will tell you I have seen them violate gamblers and employees rights several times. They do that because they know you can't sue. Someone needs to take them all the way to the Supreme Court and get it changed so that they are held just as accountable as any other casino. They have "sovereign immunity." That doesn't mean they don't have to follow federal law. It means they get to act kinda like they are their own state. But they still have to work with the state they are in to negotiate a compact to allow them to operate gaming facilities. So by the compact that still holds them with some accountability to the state as well as the federal government.

Just after he took up poker, Stu Ungar was a known card counter because he had a genius level IQ and the rare gift of “total recall” memory. He was once bet by casino owner and friend Bob Stupak that if an entire deck was dealt one by one face up, he couldn’t name the last card. Ungar correctly called the last card (10♦️). He was killing casinos in AC in 1982 when they had him detained on a bogus charge of capping a bet. They said if he paid a fine of $500 and signed an acknowledgement that he cheated at the game, it would all go away. Ungar said go f yourself and fought it. He won in court but the battle cost $50K in legal and travel expenses. Later he said that he realized the point of them accusing him wasn’t because he was guilty but to harass him and let him know if you count here were going to spend what it takes to make you miserable. This is how they operate. This is who they are. Not much has changed since then.

I'm one of the early birds to casinos-I stick to slots mostly but play some 3 card poker on occasion. I've seen casinos put their cards on the table and spread them out. They then pull about 15 high cards out of an 8 deck shoe. I've seen it more than 10x in the last year.

Its obviously important on the subject of gambling; vs the bs we're feed trying to brainwash ppl into calling gambling Entertainment. The media and casions started calling it entertainment in the early 90's. To me it is not entertainment. It is gambling. You also cover the idea that people are protected by law. The only problem for ppl is finding a lawyer to take their case of which I've had a couple in Las Vegas, potentially huge cases thrown but lawyers who took may money and dumped my case and ppl gotta know this bc lawyers in vegas can't be trusted. This discussion adds a glimmer of hope to ppl wanting to get a lawyer for their case. But its a worse bet than playing blackjack. 😊

I think the reason in many cases the gaming control board will side with the Casino (which is wrong) is because of the ease of their ongoing relationship. They have to deal with the Casino's on a daily basis for their entire careers. They only need to deal with you, the patron, the individual, that one time with this one incident. So they are choosing to have a softer relationship with the Casino, for in part that reason. And I think in bigger part, the idea that "well the Casino does good things for the local community, they employ hundreds if not thousands of people, their taxes pay for public services" and I think that second reasoning is more likely to happen in smaller communities like reservation Casinos (Where there is little to no other industries to speak of)

One of the first times going to a casino I was with friends and decided to play Blackjack and the table was full and I was betting 5 sometimes 10 dollar bets and I won 4 or 5 games in a row. First time luck I called it, a few minutes later the Pit boss came up and told me that I had to leave. I was confused, I won a few games, yeah no biggie but I didn't know any about counting cards, I'm straight up stupid when it comes to numbers and yeah he thought I was counting cards. Kicked out less than 30 minutes and only walked away with 20 dollars (if I remember correctly) went to another casino across the street and ended up losing 300 bucks because I didn't know Jack about playing cards.

So basically he's only taking cases he knows he is going to win.... I spoke with this man on the phone. I explained him my story. He said he wouldn't take it because there was maybe a 30-40% of winning and the process would take about 2 years. This interview echoes what he told me. There is no little to no protections for AP's. Those settlements/trial wins are just a drop in the bucket to the many cases that don't win or don't ever get presented.

In the State of New York, a law was past to make casino more fair so that's why there's no dealers or table casino games at Jake's 58. All of the table games are electric table games so that casinos cannot cheat on their customers. It's easier to win in a New York state casino than any casino in the United States.

Forget card counting... I have a true story for you. For 2 years I went to the Hard Rock Casino in Davie Florida. In two years I never hit a jackpot. When my 50th birthday they were having a drawing 420 $400 in freeplay. Every 15 or 30 minutes they drew 10 names for 4 hours. I was fortunate enough to be called during one of the drawings and I spent the next nine and a half hours playing every penny of that 2400. At 9:30 a.m. the next morning I walked out of the casino with $5,400. I had one over 6,000 and when I got home I thought to myself... they are flipping switches and picking winners. Since that Revelation I have never been back to another casino. This took place in 2015.

From what I know, the casino has a right to ask. If you refuse, you might get cashed out, but you will probably be barred (per casino policy, but not a legal requirement. For amountsof $2,500+, they are required ask (to prevent "structuring), but you still have a right to refuse. You will probably have a "Suspicious Activity Report" (SAR) prepared against you, any you may be barred (per casino policy). For amounts over $10,000 *the casino must ask for ID and cannot (by law) allow you to play anymore.* I hope this helps.

As far as civil asset forfeiture at a traffic stop, they have to have had cause to pull you over in the first place. When you deny consent for a search, they legally can't keep you there beyond the time it takes to warn you or ticket you for what they stopped you for to wait for a dog. If they hold you for longer than 15 to 20 minutes for a simple traffic ticket just to get a canine unit out there, that's grounds to invalidate any search as well.

Does that apply in Nevada only or every state? Because I envision this hypothetical which I'm sure happened plenty of times in real life: a motorist is pulled over for speeding, the cop gets a "gut feeling" that the motorist is hiding something and asks to search the vehicle. Motorist doesn't consent to the search and this pisses off the power-tripping cop who threatens to call a K-9 unit, and then _detains the motorist for 30 minutes_ until the K-9 unit arrives. You're saying if the dog finds anything, it's not admissible in court? And the 30 minute detention is false imprisonment?

@@thebellcurve3437 the case law is Rodriguez vs United States (if i remember correctly) & it is a federal law. In that case law, suspects were pulled over for a traffic citation. Ticket was issued. Cop made them wait much longer for a dog to arrive after the fact. Dog alerted and cops found methamphetamine. The drug charges were later dropped in court and this became the standing law.

@@mp4JunkieI'd avoid being combative and keep in mind that 15-20 minutes would be a generality, not a hard and fast rule. More importantly, those dogs are usually about a coin-flip. They more often get evidence from people turning it over when they make a baseless threat.

On the topic of civil forfeiture and roadside searches of your car during a traffic stop: INAL but from what I've heard, when you refuse consent to any search (which you should always do) and then the cops respond by saying if they have to get the dog out there it will take hours, you should NOT respond by saying anything like "fine, whatever, get the dog out here, I've got all day". The reason why you do not want to say that is it implies consent to an unreasonably long detainment. From what I've heard (again INAL) courts have ruled against detainment for any length of time in a simple traffic stop that is not reasonable to issue a traffic ticket (say 20 minutes) and some states even have laws about this. So when they try to use the threat of long detainment to coerce you, your polite response should be "I don't consent to any searches and I also don't consent to any unreasonably long detainment", and you must verbalize that clearly so it can be heard on any audio recording of the stop. Like the lawyer said, it does not guarantee anything, but if the cops end up having you sitting there on the roadside under detainment for 2 hours while you clearly said you do not consent to any unreasonably long detainment, it might possibly give your lawyer one more item of the traffic stop that can be challenged in court. Verbally denying consent to every step of the traffic stop does not take any extra effort on your part, and when you say something like "fine, whatever" to the cops when they jerk you around on any aspect of the stop, it can be construed as consent on your part, and I think any lawyer would agree that consent is something you never want to give them.

Crockfords took Phil Ivy's Money and kept it because of "advantaged play!" Phil didn't break any laws, and of course wasn't arrested. Yet the Casino fenagled their way out of paying him out!!! (cause they could!). The courts I think side with the Casino for obvious reasons??? I recommend never ever playing at a Crockfords casino, under any circumstances! I'd certainly never want to hit a jack pot there!!! Might get someone telling you the machine malfunctioned!

In 2018 i was playing at a casino (Riverwind Casino in Norman ,Oklahoma) and was on a good luck spree and in my 6th visit as i walked in the casino and at the first machine I came to im flanked by a casino worker on my right and on my left and they stopped me from putting my money in a machine and they proceeded to unplug the machine and it was not even broke .All the machines i played in my previous 5 visits in a three week period ,they unplugged them all which i was not playing and they were not even broke.I feel like my rights were violated .I could of easily lost my money but was on a good luck streak.

Have counted cards, and have been banned from a couple bars, but recently have been banned for life from two local casinos for taking advantage of their machines. No lawyer would take my case.

I've been considering taking my local casinos to court over their trespasses against me for advantage play. I think we seriously need federal gamblers protection laws that ensure advantage players cannot be barred for beating casinos who knowingly offer beatable games. I know some AP's advise against it out of fear of reprisal from the state and the casino monopoly. But look at Ken Uston. He fought them in Atlantic City and I'm pretty sure he won, albeit on a small scale.

I'd like to agree with you Chris, but what if that were the case? If casinos didn't have the right to barr by federal law, they would just countermeasure. Likely there wouldn't be a beatable game available to play. In other words, the reasonable pen 3:2 shoe or double deck game would go away.

Missouri has laws the specifically prevent casinos from banning card counters. What happens is they flat bet the table, 6 deck shoe with 25-50% penetration, no mid shoe entry etc. but they don’t ban you, just make it so the table hates you and you leave on your own.

58:00 There is a third avenue to challenge the dog on. The officer can not extend a stop beyond reasonable time. (Generally however long it takes to affect action on the original offense.) To get a dog or anything else to you location. A two hour delay has been ruled a unresionable detainment by the Us supreme court.

As a trained dealer there is a STRONG linguistic issue I take with CHIPS vs CHEQUES The term “Cheque” is used when that clay disc does have monetary value. For example, the Cheques you get at a casino can be turned into the cashier's cage for cash. An easy way you could remember it is “Chip” means its worthless while “Cheque” means it has monetary value. When I lived and worked in Vegas this distinction was incredibly important.

I’m 44 years old. I’ve been counting cards since I was 18 and I’ve never made it obvious. I’ve never been backed off. I’ve never been walked out and I seriously don’t know how other card counters make it so obvious.

@59:00 I could be mistaken, but I believe it is also case law that police cant extend the length of a traffic stop to get a dog out for longer than it takes to write the ticket for the offense you were originally pulled over or (assuming there was no evidence of any other crimes visible and able to form reasonable, articulatable suspicion

Banker here. If you get a check have them make it payable to your bank for example make it payable to PNC Bank. You are able to deposit the che k into a personal account within that banking institution. However if you lose it any person would be able to deposit the check given they have an account at that bank.

Also Terry v. Ohio was the Supreme Court case that led to the term Terry Stop. Basically if a police officer pulls over someone who is driving they always have a right to ID. Other than that, there are 3 stages to police/public interaction. First is the voluntary interaction. An officer is free to ask questions and a person is free to answer or not to answer; as well as to provide ID and is free to leave at any time. (Also there is a distinct difference between identifying one's self and showing ID). The second stage is detainment. This requires articulatable reasonable suspicion that a crime has, is or will be imminently committed. A person being detained is not free to leave and must identify. The last is arrest, which requires probable cause.

I was told that "they din't want my action at the coast properties" even they knew i was counting at a five dollar table and comped my friend and myself dinner in the steak house several times. It happened in my mind when they thought i was being greedy...I played at a $25 dollar table, ironically loosing. I saw what appeared as a black and white picture of me walked past the table and five minutes later i was told that, "they didn't want my action. You can play any other game, but not blackjack here."
