You don’t need to go through insurance companies you can sue the owner directly. My TR6 was hit by a hit and run driver who we tracked down. The insurance company just kept giving me the runaround and also said they wanted ti write it off, which the hit and run driver thought was hilarious. So I wrote to the driver direct and said I was going to sue him for my car to be repaired as I need not go through insurance. The insurance company changed its tune and paid for the full repairs.

Leave the UK. The UK insurance industry is so poorly regulated they get away with all this crap. Move to continental europe and this sort of crap doesn't fly. You'll find the whole idea of named drivers doesn't exist - the car is insured, not the person. So my car can be driven by anyone over 23, and that is the standard policy. Additionally, if the car was bought new and is written off within the first 3 years of ownership, you get a new car.

In 2017 I had motor scooter stolen and it was chased by police before crashing and two on board were arrested, Bike was damaged beyond repair and I was paid by my insurer. At the time of renewing my car policy, with a different company, I (stupidly) declared the bike claim and this well known company, which specialises in the over 50s, increased my car policy renewal by 30%. I complained to the FCA and insurance Ombudsman and they sided with the insurance company. I then had the incident on my record for the next 5 years. The insurance industry in the UK needs more control as they have some very unfair practices, especially where the customer is not at fault but there is nobody to claim against so the insurer treats it as a fault claim.

The car park was apparently only 4 years old. Why, in this day and age of health and safety, was there no sprinkler system installed in the car park? No doubt due to costs. The airport should bear some responsibility for the severity of the fire.
@frasercrone3838 Жыл бұрын
It comes down to what regulations apply and as it was separate from other buildings and usually did not have a lot of human traffic. It is concrete and steel construction which you would call fire resistant material and of course the building of any structure is done to the cheapest legal quote. The designs for these car parks would be fairly generic from an engineering point of view but I would hazard that the engineering calculations do not take into account BEV's and the inferno they produce when burning. Now would have a sprinkler system have put the fire out? A lot of things depend on at what stage the sprinklers would have come on and I suggest that they would not have put out a burning BEV battery but they may have kept the other cars around it from going up. Water is very effective at putting out hydrocarbon fires that have not become to large and any studies done on car park fires would have predominantly focused on ICE vehicles being the main target. The entire saga has highlighted how we continually introduce new technology and deal with the problems later and you can bet that no politician wanted to hear about Li-Ion fires and none of the BEV lobby were going to offer any information other than they do not spontaneously combust any more than ICE vehicles.

A sprinkler system wouldn't help much in a car park, the smoke detectors will not work because cars normally produce smoke and the heat sensors would kick it after it's too late because the heat in a car park spikes a lot. Would there be other methods, probably, should there have been a proper xire suporession system that would work in car park ? Certainly.

@@-na-nomad6247 Sprinkler systems do not rely on smoke and heat sensors, they have 'meltable plastic capsules' on each head. holding a water valve in the sprinkler headclosed and when the heat from a fire is enough to melt the capsule the water flows into sprinkler head and sprays water 'locally' - sprinklers are designed not to cause massive water damage to a whole building and contents by all activating at once - they operate locally, only where the actual fire is.

@ThatMicro43Guy Жыл бұрын
The LR driver is only partly to blame in my opinion. Yes, his vehicle started the fire but the building owners could also be classed as liable in that the building is not fit for purpose. It is a building designed specifically for storing cars for the purpose of long term parking. I’m taking it that they don’t specify whether diesel, petrol, hybrid or full electric. Fires are an accepted part of motor vehicles and so if the building is not capable of containing and/or extinguishing a fire to a limited area then I’d argue that the building is not fit for purpose. The fact that it got to the point of collapse due to the fire just underlines the not fit for purpose claim. So I’d say the liability falls to both parties, the LR driver and the building owners. I’m also presuming there was adequate risk assessments and fire plans for the car park in place which the law does require.

You obviously do not understand insurance. The claim will count against you unless there is another person that your insurer can recover their outlay from. This means the claim counts against your policy as a 'fault' claim. Your No Claims Discount is impacted because you have a claim on your policy. And you have agreed to pay an excess on every claim you make. That excess is not recoverable unless another party can be held accountable. In the case of this fire it seems unlikely they will ever determine the exact cause meaning insurers will not be able to claim their monies back.

Because of the circumstances, nobody should be accepting any "final settlement" offers from any insurance company, unless they are getting a full payout to cover all of their losses. It's way too soon. When negligence and liability is established at some future point in time, settlements are likely to be substantially higher and reflective of loss. If you have already accepted a lower settlement offer from your insurance, then you have nothing more to get. Better to push for an interim payment if you need some cash towards buying another vehicle and then wait until liability is established. You'll stand a much better chance of getting a higher payout.... and, don't forget to use your motor protection insurance if you have it, to recover your uninsured losses such as, the loss of use of your vehicle and your excess. Remember, if you can establish on the balance of probability that your loss is another's responsibility, then you are entitled to be put back into the position you were in before the loss was sustained or as near to that position, as is reasonably practicable to do so, by those responsible and their insurer's.

I know this supposed to be a sob story about a poor grandmother... but she was on a vacation to begin with. Thats more means than most people have. All that said insurance companies always do their best to refuse to pay, or pay less than your owed. I had an apartment fire years ago due to faulty wiring in the walls. We got pennies on the dollar for every thing ruined. Have a TV you paid $600 for? Better have a recipient that didn't burn up or they won't believe you. Even if you have proof they deem it "used" and offer you like 300 or so for it if it's even a year or two old. They also tend to just write you a check for a set number for any incidental things you can't provide proof for. I think we got like 2k for all clothes my entire family lost in the fire. Simply put insurance companies are a scam that when the chips are down do their best to refuse to pay. Your almost always better off putting a bit of money away in a savings account than paying insurance premiums. Which is why the government forced people to have car insurance... Other wise no one would bother with such a stupid system that basically never pays out the money you put in.

I researched up the reg plate with the V5. Its a red range rover TDV6 diesel 2014 L405 euro 5. They only made mild EV versions in 2014, and didnt make full Plug EV in diesels until 2021. The 2014 range rover diesel mild EV model was called model SDV6 2014. So was the V5 data wrong, looking further, there where and are Range Rovers with Ulez issues on V5 as the energy fuel is wrong for hybrids as it should say hybrid, but states petrol, diesel or even alternative (gas). Full plugins (P)EVs should state Electric on the V5. Mild (M)EVs should state Hybrid on the V5. Looking even deeper it seems Range Rovers many ones with BMW engines spontanously combust to full fire of the car, theres even a website dedicated to this, and its seems its a tiny nano fuel leak in the engine which has a recall for a part recall. There is als stories that the main dealers are registering with DVLA the first V5 with slight typo errors ie the fuel, the engine type, and model kit numbers.... so its would be quite vesable that this Ranger Rover was indeed a SDV6 M-EV diesel hybrid (to be listed as Hybrid on V5) and not what the V5 states a TDV6 Diesel. As its a euro 5, both would not pass for Ulez exemption as this minimum for diesel is euro 6 and petrol is euro 4, or the full EV called a plug in EV, ie a P-EV, and then it has to be listed a fuel type = electric on the V5 to get Ulez exemption. Ie presently in 2023 some people with Range Rovers are stating they getting Ulez fines FPNs finding out their V5 has wrong specs on it. TFL state people to moan at DVLA to get the V5 corrected but the Ulez FPN still stands to be paid.

More to the story about the grandma who brought the £20,000 car Geoff, That is what she paid for it new of the fore court. What you haven't mentioned, is that the car was 4 or 5 years old (can't remember the exact year) but, insurance companies, will only offer market value for the car in question, not what she paid for it 5 years ago, so the offer was probably more to do with it's current value. Obviously, car insurance companies, always offer the lowest book price on market value, but this is usually a first offer, which can be challenged. Then more often than not, they will increase the offer to mid book price. Also regards the other insurance claims, claiming they lost this, that and the other. We all know people hike it, when they are making there claims, After all, who would genuinely leave valuable's in a public car park when going on holiday ? anyway, love the content pal, and keep up the great content from a fellow Brummie 👍👍

The disclaimer is the first line of defence for the car park owner. There are different qualities of insurance. Maybe she got cheaper insurance that was cheaper because it covered less.

I'm afraid you can get the best insurance going, and they will still stuff you willingly and legally at any possible opportunity. I was insured with Hiscox (probably the best insurance company by rating and customer reviews) and another car slammed into the back of me while I was stationary at traffic lights. It causes serious structural damage and took nearly 4 months of repairs before they threw in the towel and wrote it off. In that time, I was eligible for a hire car (and I paid extra a year for a hire car upgrade pack with my insurance) and they made excuse after excuse of why I couldn't have one. They also said the other drivers insurance refused to open negotiations in terms of liability, so my insurance put it though as "At fault", because they settled the claim; they later told me that if I wanted that changed, I'd have to take legal action at my own cost against the other insurer.....something that my legal cover with Hiscox was supposed to cover and was written into their T&C's, but they refused. They then offered a pathetic settlement that didn't even cover market value at the time, and as the car was less than 12 months old at the time, Hiscox says they give you the full amount paid when new in settlement. They claim that doesn't apply if another insurance company doesn't pay their liability, funnily enough their own terms don't mention this. It's now in the hands of the insurance ombudsman and I swear I've aged 3 years in the last 7 months. Moral of the story? Always remember that Insurance companies don't care how it affects you, they care about their bottom line. Just the way it is.

All insurers are the same when it comes to regulation.

When it comes to insurance, I’ve never accepted the first offer that they’ve given me, I just go through the Auto Trader screenshot Cars with my mileage and my value that I think is acceptable and they’ve always accepted my evidence and paid me out what I wanted
