It's always like that for whatever unfathomable reason(s). Till this day I still remember vividly in middle school during English class a bully picked on me and even slapped me on the backside of my head. The male teacher in his late 50s saw the whole thing but decided to sit there and do nothing about it. I even made eye contact with the teacher giving him a blank face as though silently saying are you going to do something about this? He just looked back at me, eyes wide open but did not say a thing and kept quiet as though nothing had happened. I was about to snap and stood up to punch the bully in the face, but cooler heads prevailed. I was wise enough at that age to know the difference and that was if I retaliated I would be the one sent to the principal's office and be punished for my action. I was surprisingly wise at the time for being so young.

Many places will punish you if you're not in immediate danger when you harm or kill someone. So yes this even includes when someone is trespassing, vandalizing or stealing from you. Its only considered self defense if the person is attempting to harm you, so being charged, chased, shot/thrown at etc

I'm from Spain (native). Unfortunately, the Spanish law defends better the criminal and not the innocent. If someone breaks into your house in Spain, you can call the police and wait for them, but you CANNOT even touch the intruder. If you do, you can get sued by them and you WILL be found guilty. This is a reality in Spain. We have grown tired of this. You wouldn't imagine how many people would modify the self-defence rule/law to allow you to defend your property, but because the law can only be changed by politicians and they all are corrupt and horrible people, so I don't think it will ever happen.

It is 100% okay to attack someone who is invading your home, esspecially if they're holding a weapon (even an unarmed chainsaw can be used as a deadly weapon) - but self defence in basically every place on Earth says you can defend yourself until your life is no longer in danger, and a person lying on the floor after being shot with a shotgun is no longer a danger so the second shot wasn't self defence - it was murder.

Self defence by killing is also extremely strict. You’re allowed to defend yourself but not with guns. Important fact: Even if the judge had given him 20 years, the old man can only be in jail for 5. That is because the Spain's law forbids every person over 85 years old to be in jail. Edit: This law seems to not be on paper, but old age is a huge factor when making an appealing of release.

No, in Spain if the robber has not attacked you, you’re not entitled to defend yourself, he must first attack you, but there’s a trick, if let’s say they attack you (and you must be able to prove they attacked you) with a knife and the only two things you have to defend yourself is a gun and a spoon, you must use the spoon because if not, it’s considered not proportional and you’ll probably go to jail. As someone from Spain, this is true. If there's an intruder in your house, you can't defend yourself unless they strike first. And when you DO defend, it has to be with "reasonable force". Aka if someone stabs you with a knife, you can't shoot them, since guns are more lethal than knifes.

He certainly has a right to defend, but his method was flawed and hard to justify. Many crooks would drop and run at the mention of a gun being pointed at them. Dude apparently didn't say a word before firing. Then, with the intruder ON THE GROUND, he shoots him again? Nah, fam, that's not cool. That's when you call the police. It is NOT when you make sure the threat will never be one again. From the information given, murder sounds harsh but is technically accurate. He shot a man twice without warning, killing him. Might've been an intruder and thief, but he may not have even realized the homeowner was in the room... (Until getting shot, ofc) hard to justify self-defense when the person you're defending yourself from doesn't realize you're present. Too many issues with the information given. If I had to play jury based on this info, I'd be inclined to convict.

Yep, especially because he said he never feared for his life and killed the guy solely for stealing from him. If you're not doing it in self-defense, that's just murder. Not premeditated or first-degree murder, sure, but still a second-degree murder. And yeah, that double-tap to make sure he was dead and not just wounded definitely doesn't help his case. He made sure that guy was dead before he called emergency services and told them he killed a guy and all the evidence corroborated the story he presented. Also, the presence of a firearm is generally considered an aggravating component to any charge. Given a second-degree murder without that aggravating component might solicit 1-4 years imprisonment in Spain, so I can see overall how this happened. Also, as a side note, he would be subject to a 1-6 year ban from using a firearm after murdering someone with one. That said, I still feel weird about the overall 6 year imprisonment within that framework, especially for an individual approaching end of life themselves who might just die in prison. That makes this a life sentence when that doesn't seem to have been the intent.

There's no way you're thinking clearly in that scenario to accurately assess the danger level. The burglar forfeit his right to life upon entry. Convict the man if he left, spent 5 minutes calling the cops, and then came back and shot him. Don't convict someone for panicking in a self defense situation. There's no way you act completely calm in that situation.

Personal opinion is that people make mistakes, and while I would never want to harm another person if you break into my house I am going to fear for my life and be afraid you might do something else to me because I'm a woman before you end my life. I do think that the courts do not take into proper account the fear a person might feel by having a person enter their homes. It is definitely something that even thinking about gives me chills, and someone might act in a way to defend themselves that rational minds would not find correct. So my proposal would be, if you break into someone's house, and you end up killing them, not from a booby trap or something else, then you should not be charged and it should be assumed to be self-defense or a panicked decision that should result in no jailtime, unless proven otherwise. In most cases currently, the self-defense is taken into consideration but not the later part, maybe this guy didn't fear for his life, maybe he didn't make a panicked decision, maybe that's why he was sentenced, maybe it was just an outlash of anger. I think the first shot was fear for his life, the second when he was on the ground seems like it was anger. Though it's also possible he panicked because he just shot someone and was worried they might retaliate, idk.

The same thing almost happened to my grandfather, also in Spain. Came home to find his house had been broken into, so he grabbed a gun (not a real one, one with compressed air used to hunt birds that is still dangerous). Either you're a liar or your relative is a liar. The case you're talking about is literally from 1982, and it was a SCHOOL that got sued not a homeowner. It also never made it in front of a judge or a jury, because the schools insurance company decided it was cheaper to offer the man a settlement instead.

Jury judges evidence and most likely they found that his actions did not classify as self defense. If this video isnt leaving out crucial information it sounds like he didnt attempt other actions first and immediately escalated the situation to lethal force. Self defense in most nations means youve tried everything else first and fighting back is the only option left.

1st shot wouldn't be considered self-defense either in a lot of place(not sure about Mexico) because the intruder was completely unawre of the man. 2nd shot definitely sealed his fate though.
