The Newsmakers: Breivik mistreatment case

7 жыл бұрын

After being jailed for taking the lives of 77 people, Anders Behring Breivik claimed Norway was violating his human rights. A court agreed, saying the prison conditions of the country's worst killer were degrading. But do microwaved meals, cold coffee, and three private prison cells constitute inhumane treatment? Norway's prisons are generally considered to be among the world's most compassionate. But the judge said Breivik was subject to unjustified strip searches and isolation which goes against a democratic society's fundamental values. So, is Norway violating his rights or his treatment justified?

His dead victims don't get 3 rooms, free meals, a play station, university studies, etc. They are dead and buried; and he certainly saw to that. What HE did was inhumane. I find what he complains he has to endure now quite merciful in comparison.. Prison is meant to be a punishment; not a pleasant stay in a motel. The salute is a dead giveaway that society needs him to remain where he is.

Scandinavian countries in general consider "loss of liberty", ie. the act of incarceration away from the outside of the world as the punishment. There is no "extra punishment" to make the inmates suffer. Punishment as a form of revenge and vengeance is an American thing. The families of the victims were quite happy with the sentence Breivik received, and Norway has system that works. This is evidenced by one of the lowest crime rates in the world and very low recidivism.

I think the Norwegian court system is smart for letting Breivik salute while in court. This will be a basis for the legal system to continue to keep him incarcerated indefinitely.... The salute shows that he is not yet rehabilitated.

What is the problem with these naive americans? "Why did he get just 21 years?" The term 21 years is just symbolic. His sentence is life, - as long as he is considered dangerous. I am not a psychic, but even when he is 100 and wears dypers, he will still be in prison.

Prisoners live in extremely comfortable conditions. He should consider himself lucky he isn't serving time in an American prison! What about the human rights of his 77 victims? As we can see, being in the spotlight means everything to him and he will try every trick in the book to get himself in front of the cameras. At the very least, his court appearances should not be filmed. Deny him the publicity and attention he craves.

At one point takes the pen towards his lips trying to show how concentrated he is. This guy is as fake as news gathering has become. Please fire him , he is way to full of himself. Or just cancel all this interviews with these obvious questions any intelligent normal thinking person can answer instead of her. Its a waste of time, like my comment will be. It seems like it's hard for people to understand that he didn't get only 21 years in prison. He got 21 years + Forvaring/custody, which means he will be stored away in prison until he's deemed fit til reenter the society of Norway. The will probably never happen. Unfortunately, Norway doesn't have the death penalty anymore, so the prison have to go by their own regulations on how to treat their inmates. Solitary confinement is not legal in Norway for more than a short period of time unless the police get a new court order. When the normal court case is over there's usually no reason for solitary confinement unless it's a very special case, as it is with him. He does however have a good case against the prison, because they have never had an inmate like that before... Inmates like him were shot in the past and not incarcerated...

The 21 years is just a number on paper. He was sentenced to "forvaring", which means that the sentence can be extended every five years until it is either considered safe to release him back into society - or he dies in prison. The former will virtually never be true, because he's not going to respond to any form of rehabilitation and has yet to even express remorse. And given the heinous nature of his crimes, it won't be safe for him out there either. TL;DR: he's never going to walk.

Well prison is not meant to be nice, and few mass murderers enjoy the level of comfort and privileges this man enjoys in Norway. Fancy doing 21 years for 77 counts of murder on Texas death row, China or Thailand?. No case at all, just playing hard done by now.

You make it sound like a weird thing to complain about living in isolation for year after year. At this point, he's been in isolation for more than a decade. Complaining about that is NOT the same thing as complaining about the coffee. If you end up in prison, and they decide to keep you in isolation for more than a decade, you probably have a very good reason to find yourself a good lawyer.
@railwayfan1988
@railwayfan1988 2 жыл бұрын
@@christopher399 He killed 77 innocent people and, being prisoned in Norway/Scandinavia, I know he is treated well. There are countries were you're not treated that well with such a crime-record. And the reason he is kept in isolation is because of the risk of spreading his radical ideas to other prisoners. After ten years he recently was legally allowed to ask for parole. During the handling of his case in court he made the Hitler-salute. I think he doesn't deserve any perspective for parole.
@christopher399
@christopher399 2 жыл бұрын
@@railwayfan1988 Trust me, not every prison in Scandinavia is what you think it is. I can't speak for Denmark and Sweden, as I haven't looked much at the prisons there. However, in Norway... Not every prison is Halden. That's the one you'll get when you google prisons in Norway, and there is a reason for that. For example, the other day, I looked into a prison in Norway where the conditions were so bad that the staff were complaining. Prisoners were almost never allowed outside their cells because of a lack of space, and they had this small area outside with cages that they were allowed to stand inside for an hour every day. Of course, they are almost never used, because it's so depressing that they prefer just staying in their cell. There was another orison. I don't remember the name of this one, but the inmate in question was struggling with severe mental health issues, and instead of providing him with help, they locked him up in solitary confinement and just kept him there. Admittedly, this last one was at least a decade ago, so the prison may have been shut down, or the routines may have changed. (Also, no, the cell they kept him in was NOT like the ones in Halden. Nor was the one in the other prison, which is still operating today. The cells looked better than American ones, yes, but that's more because the walls weren't grey and they used a proper desk and a proper bed. That's not saying much.) I'm not complaining about the prison system in Norway. It's absolutely fantastic. We have the best results in the entire world for a reason. However, foreigners see photos of Halden, and think that's every prison here. No, it isn't... That's just the most fancy one. There is literally a prison here, operating as I'm writing this, that have so little space that they can't let prisoners out of their cells. There is another prison where they cramped numerous prisoners into small cells. Although we have Halden prison, we also have prisons that are... Less admirable. Yet, what they all have in common is the focus on rehabilitation and how the staff will treat prisoners like human beings. But they're not all living in fancy conditions. He's in isolation because everyone in Norway that are around 25 years old and up, hates him. People want him dead. A mishap happened, and a prisoner managed to get outside of cell door and told him he would've been dead if the door hadn't been locked. There was also a prisoner who volunteered to help provide an inmate in need of a friend, with someone to talk to and play games with. He then learned the guy was Breivik. After the meeting, people in the prison where trying to find out who had agreed to see him. It's very unlikely they wanted to find said person to ask how Breivik is in person. Anyway, even though it's understandable why he's in isolation (for his own safety), it doesn't mean that's what we want for our prisons. And no, giving the Nazi salute shouldn't remove all possibilities for parole. You have misunderstood the purpose of rehabilitation. If he was already on the right path, there would be no need for rehabilitation. Killers, rapists, child molesters, drug dealers, robbers... These are all people who are doing things they shouldn't, and that's EXACTLY why they need rehabilitation. A Nazi and a mass murderer is a great example of someone who needs to be rehabilitated.
