No one has ever gotten banned for playing these emulators yet. The only thing you should be careful with on retail is taking and uploading screenshots - that's something Microsoft looks into, and there have been people getting warnings for doing it. Other than that, you should be in the clear.

Developer mode, no you shouldn't get banned. Doing it on retail mode seems a little more sketchy
