President Obasanjo has all the power to change the constitution then he didn't do it, he was chasing third time. Why are will still listen to people like that. Obasanjo laid the foundation for this new dimension of jumbo salary for our legislators, sold their legislator quarters and all other Government property to his crone under the guise of privatization. I thought people should just look at the old cargo and stop disturbing them.

There is a 2014 confab organized by Jonathan ...whose recommendation can be used to draft a new constitution...let's not organize another one ...after this 4 years cycle dissolve the national assembly...run a unicamera legislature on part-time basis and foŕm a new constitution. A single term of 6yrs is too long ...I propose 5yrs

How will this be done in practice? Every action must have legal authority to be valid. On what legal authority will these measures you propose be undertaken? Surely not the same Constitution you're branding illegitimate? You wouldn't be relying on an illegitimate law to implement valid legal and legitimate measures, would you? There's a reason we're called learned o!

Chief Emeka has over 35 PHDs. Such Men came before their time. Nigeria should listen before it's too late
@gt-world-s7i
@gt-world-s7i Ай бұрын
PHDs have nothing to do with imagination and common sense that determine an unbiased and realistic patriot. Is every Nigerian generation going to write its own version of the constitution? Nigeria's problem is not the constitution. Our problems are tribalism, indiscipline, dishonesty, greed, corruption, ignorance, etc. displayed by some Nigerians who want to be called elites! These problems will never go away even if tribes secede from the country or are regrouped within the country. Let South Sudan be a lesson to Nigeria. Some members of the main tribes in Nigeria have been tearing this country apart as they claim monopoly of knowledge and wisdom, completely ignoring the silent majority of the hundreds of minority tribes combined. Western education was not designed to liberate Africans but to make Africans aspire to be like Westerners. How can any right thinking Nigerian believe that our constitution is irredeemably useless? Constitutional amendments take care of significantly outdated or vague provisions of any constitution. For example, one would think that the legislative arm of government would immediately after last year's election review the status of the Federal Capital Territory in relation to a presidential election, but that is not a National Assembly priority today.

Simple question, learned silk: on what legal or constitutional basis is this to be done? The Constitution in s.9 provides for the alteration of the current Constitution, but it does not provide the power to make a new Constitution? What would be the legal authority upon which a new grundnorm is to be formed without setting aside the existing one?

Forget legalism. Away with the current Militarised Unitarised Criminalised 1999 Constitution When your house is on fire, you don't begin to put your house subsisting rules before saving the situation. In fact, if you must know, Nigeria needs an Interim Government to fix it before going back to normal governance and it is NOW. The biggest problem in Nigeria public discussion today is that men of the generation of the man being interviewed here claim a certain understanding of nation building that a well-trained undergraduate student would know to be incorrect. This Senior Advocate of Nigeria is not just saying nonsense (believe me, I tried to find for kinder words), he is the best illustration of what is known as the Dunning-Kruger effect. The Nigerian legal profession is full of people like him who may be good lawyers as good lawyers are defined in Nigeria, but certainly not legal scholars. Here are a few inconsistencies with their arguments for a new constitution: 1. The current Nigeria constitution is illegitimate and because of the illegitimate nature of our constitution we need a referendum, and the referendum is supposed to cure the social tension in the country. It is clear those who make this argument have not read about the history of Germany or that of referendum. The German Basic Law, which is still that country constitution till today, was written in London by Allied at the London conference with minimal input from the Germans themselves. In fact, when the Allied told the German leaders to organise a referendum in West German for the constitution, German leaders refused. They refused to satisfy some people definition of legitimacy by risking the unity of a country their forefathers fought to unit. When the Berlin wall fell in 1989, West Germany signed a unification treaty with East German and the Basic Law became the law of the whole Germany, STILL without the REFERENDUM. It also may help our Senior Advocate of Nigeria to know that if referendum is a cure for social tensions among a group of diverse people trying to forge a future together, the United State of America would not have had a civil war. The American funding fathers did exactly what these men are recommending to us. Yet that Country, almost a hundred years after the referendum, under that same constitution, went to a civil war. Why? But the key reasons why I believe these men should speak less and read more is the confusion they create in the mind of young folks who look up to them. Here I think I have to educate. One of the questions I have been asking myself for while is this: If the Igbo, the Haussa, the Yoruba and other not less important ethnic groups that make up Nigeria today knew they were going to be colonised, what would their leaders do? Unit or, like this SAN, insist on preserving at all costs their differences as though identity is frozen in the past? When our forefathers were colonised, the United Kingdom population was about 19 million people. The UK army was not even up to a million, yet they left their land came and colonised us here. The reason they succeeded is that, like adolescent brothers, we fight among ourselves until a foreigner comes and takes away what we are fighting. This century will be dominated by empire-size countries like China and India both with more than a billion people and a strong central government. What would an Arewa, a Biafra or an Odudua Republic mean in that world when a growing Chinese or Indian power is in search for the energy to power its growth? Even as a united nation, we may not find it easy if we do not sit up fast and find a way to silence ideas like the one this interview. Sorry for the poor edit. And what is this bogus ideas of a different people that this man is referring to abeg? If he can spend more time to read instead of claiming the knowledge he does not have, he certainly would have known that the largest majority of European who migrate to the land we know call the United States of America were not English speakers. How did English become the official and dominate language?

Without removing the FG, NASS and State Governments immunities, Independent Military and Judiciary, with the judiciary being in charge of the Police, NSCDC, EFCC, NIA, SSS, Immigration, FRSC and other relevant security agencies, everything we're talking about referendum, restructuring and New constitution is balderdash and D.O.A. Give us stable electricity, security, education, healthcare and employment.

Good talk, but let me make it clear that the 3 biggest tribes which are: Hausa/Fulani, Igbo and Yoruba, will NEVER allow naija to progress and move forward. Mind you, I'm from one of the mentioned tribes, but I need to be frank and say the truth as it is. The reason for this is because of what happened immediately British left in 1965. Yes, I said 1965 (not 1960) because that was the year British handed naija army back to Nigerians. If you understood what happened in naija from 1960 till 1979 then you will know why the 3 tribes (Hausa/Fulani, Igbo and Yoruba) will NEVER allow naija to move one step forward.

Hi. It is high time we show our shortcomings in the areas of interviewing and reporting individuals or group when expressing their views and remedies for a damaged train of governance. They are only recipients of public views and not accessor of public grievances.

But if a politician has to spend millions or billions to win an election what do Nigerians expect ? There has to be more rules for cleaner democracy. If a presidential candidate has to pay hundreds of millions of naira for just a presidential form .That has to be addressed too. Serving your country is a very difficult job why should anyone spend millions or even billions to serve his country? Does that make sense? That should be looked into too. Judiciary system in any nation is the backbone of democracy. For democracy to work everyone must obey the rules of law. Once some people are above the law then there is no democracy .All our politicians knows how democracy works in western countries they are human beings like them if they make democracy work we can too. They like the western countries that’s why some of them buy properties there , go there for treatments etc. Some politicians allegedly stole money from their people and summoned to appear before federal courts they will disobeyed the court is that democracy?

If l May ask a question ❓ Why will Nigeria elect their leaders for 4 or 6 years term to steal without checks and balances or prison term and repercussion facing the politicians. Nigerians should completely restrict these so call leaders direct and indirect access to public money and make the consequences of dipping your hands in public money earned a politicians easy long term prison. In the Nigerian constitution, Nigeria should reserve the right to recover looted money from Nigeria citizens or politicians by signing threats with other countries for 100 years wherever the looted money is found.
