She isn't in the wrong. If she was texting her mother, assuming it was for pick up plans or something important, she has the right to do so. She has the right to defend her honor with this information. If she was texting for a viable reason, which she was, she has the full right to not give the teacher OR the principal her phone. The principal assumes that she is going to text her friends, but she said "you can check," which proves that she is texting the right people. This principal really doesn't think logically enough.

King. I agree that the rule is moronic. I'm an old guy who used to teach. I hated dress codes enforced on kids also. This is an example of a school that punishes EVERYONE because SOME kids abuse texting during class. What the school SHOULD do, is take away cell phones from kids who abuse the use of phones. Obviously, if you are in Calculus, you are probably okay with whatever phone you use. As a teacher I got in trouble for allowing my AP Chemistry students to listen to DVDs (I know that is old) during assignment work in class. I fought the administration and lost. So I just told my students to wear a hoodie to hide the earphones, and would just claim "I didn't know". I quit teaching because of the dumb rules I had to enforce.

There are 3 reasons (that I know of ) why some schools don't allow cell phones during breaks: students txt people who are still in class, the school is trying to protect students from theft, and the school is trying to keep students from taking pictures of each other without permission or using their phones to bully each other.

One of my friends had her phone out after 2:45PM, at 2:45PM after the bell rings, teachers won't care if you have your shirt untucked or your cell phone out, and this substitute teacher said that she cannot have her phone out at school hours, she intervened and said that it's after school hours, no-one would care, she later got called up to the office along with a teacher, and everything is cleared out and everything was a misunderstanding

Cellular phones are to be left at home. You're supposed to listen to your teacher and follow directions and instructions. There was a 16 year-old freshman back in 2015 at JFK High School in New Jersey that attacked his teacher because the teacher took away his cell phone. The teacher was 62 years-old at the time. The student was suspended, arrested, and charged with assault. Schools are for getting an education only. Schools are not a place for you to be on your phone.

Reasonable people can surely argue whether cell phones should be allowed during lunch period. Judging by the comments on the video, apparently some schools do allow cell phones during lunch. Students and/or their parents could certainly petition the schools to get that rule changed and to come up with a better policy. But the fact of the matter is that this particular school has a no cell phones at lunch policy and the penalty is confiscation of phone. And the principal absolutely MUST back up his teachers in enforcing that policy. Openly defying the teacher trying to enforce the rules, as this girl did, is a serious matter, and the principal acted accordingly. If the girl had a problem with how the teacher was handling it, the proper response was to give up the cell phone to the teacher and then ask the teacher for permission to go speak with the principal about it.

Should’ve been fired and arrested for destruction of property and child abuse for causing injury, because who knows how many more things that teacher is going to throw out the window and possibly destroy at the other schools that the district reassigns him/her to. I saw it falling from the 2nd floor. It was just a momentary interruption, versus an ordeal and possible reassignment or someone losing a job. It hit my classmate on the top of the head in the schoolyard.
