A deep dive into the Sixth Amendment, which guarantees citizens the right to a speedy and public trial. In this video, Kim Kutz Elliott discusses the Sixth Amendment with scholars Stephanos Bibas and Jeffrey Fisher.
To read more about the Sixth Amendment, visit the National Constitution Center’s Interactive Constitution. On this site, leading scholars interact and explore the Constitution and its history. For each provision of the Constitution, experts from different political perspectives coauthor interpretive explanations when they agree and write separately when their opinions diverge.

Correction: at 14:53, Fisher says that trial by jury is also in Article IV of the body of the U.S. Constitution. Actually, it's in Article III, Clause 3 of the U.S. Constitution. By the way, trial by jury is also in the Seventh Amendment.

I call on the sixth. I don’t want to have to spend so much time on jury duty.

This is BS!!! The time is 30 days for misdemeanor 120 days for felonies if the defendant is in custody and the defendant doesn't waive time. If the defendant is out on bail or their own recognizance the court had 6 to 8 months to bring them to trial. Spending over a year when there is no on going investigation is punishing the defendant without a conviction.

Often, time limits like these vary (many times widely) from State to State.

@@ProfessorGamez they are federally governed. So states have to conform to federal regulations aka our constitution. STATES CAN NOT MAKE LAWS THAT VIOLATES OUR CONSTITUTIONAL RIGHTS. Why are people soo F'n dense????

@@MrSlicky77 With great respect, States have a lot of flexibility in crafting their laws and procedures ... As long as said laws and procedures do not conflict with the Federal Constitution. This is what's known as "States Rghts". While it is true that sometimes the feds will come down on the Sates and have them run certain things the "Federal Way" (for example, this is why the drinking age in most States is 21 and not 18. A few decades ago, the feds told the states to raise their legal drinking age to 21 or they would cease receiving federal funds). Obviously, most states complied. Also, the concept of Federalism says that while we do live under one central federal government, we also live under the individual government(s) of our respective States, in a type of power-sharing arrangement between the two.

@@ProfessorGamez again, our constitution is the frame work that they must work within. And respectfully you are still trying to justify the states violating citizens civil rights that are guaranteed by you guessed it our CONSTITUTION. So what justification can a state work outside the law that they all are governed by??? I'm in wonder of how many associates degrees you have🤔

@@MrSlicky77 Sir, I am not saying that States can violate fundamental rights without consequence..I am however, saying that States have a certain amount of flexibility within our Constitutional framework when dealing with said rights & related issues. We may or may not agree with this setup, but this is how the system functions. Moreover, I have taught various Criminal Justice (and related courses) for more than two decades for multiple colleges & universities throughout the U.S. in addition to working on my terminal degree in American Criminal Justice...what is your background and credential(s)?
