I love how Tony tries to think of a reasonable solution about what he should do with Vito, only to have Phil’s crew beat him to death instead. The real reason Agent Harris didn't keep pursuing Tony in court is because of 9/11 and getting moved to counter-terrorism, then they're basically friendly for the rest of the show because Tony isn't the objective anymore so it does work both ways, sometimes the inevitable worked against Tony sometimes in his favor.

An untold story that went on behind this, Tony had already told Vito he could come back, but he would be placed in Atlantic City, and when Vito asked to come back, he offered $200k to Tony, straight to him nobody else would know. So it is almost certain Tony got that $200k. And it is right around here in the series when Renata dies, and Tony gives Hesh the $200k he owed him.

What really makes me laugh, if you didn't catch the irony, is the scene just before this and the transition to this scene. Carm is in Paris, and has been amazed at the lifestyle, sculputures, etc. Just prior to this scene she is admiring a sculpture on a bridge. Then cut to a gritty New Jersey industrial district, with interstate noise, cars rushing by, horns being blown, and mobster Sil yelling up at a guy cleaning a cartoon strip club sign "Make sure you clean that shit off her tit". Quite a contrast, very sharp script writing...

Sil didn’t seem to mind, but Tony didn’t want to deal with any extra crap, and his rep. Sil did point to Tony with Vito being discreet about his life, but he just happened to get caught by some low level guys.

tobsmonster2 he literally spends the entire exchange trying to justify killing Vito, and looking for Silvio to reassure him that it’s not his fault. He is showing actual guilt and remorse, which doesn’t happen often.

Tony is not exactly a gay rights activist. What he is pissed off about is losing a loyal subordinate who will do what he is told without question or complaint (unlike Paulie, etc). Vito is also a reliable earner and can't easily be replaced. He knows Phil and the other guys determination to take out Vito is going to easily cost him 200k a year, plus that amount up front and that's what has riled him up.

Scott he honestly doesn’t when pressed about he’s stance he starts to fold. He just never faced or delt with a homosexual so it was easy for him to recite the mafia’s stance. He’s upset because Vito was actually kinda his friend. He was loyal, smart, didn’t talk back, did what he was told, funny and cool to be around.
