What I find weird about the US is the fact that judges are politically active in all levels of the judiciary. Aren’t judges meant to be outside politics and only concerned with matters of law?

Supposed to be, yeah. Especially the Supreme Court, which is supposed to loftily float above the mundane stuff down on the ground, like partisan politics. But over the years, it's been slowly, voluntarily, stooping lower and lower to drag itself and its ideals through the mud. Utterly disgusting and morally wrong.

Interesting fact: In Canada, there are NO LAWS concerning abortion. None for, none against. It's regarded as a private issue. Also, sexual and reproductive health is an important part of our health care system. Re the Supreme Court: Canadian Justices of the Supreme Court must retire at 75, in some cases at 70. They must have served as a federal court judge or have been members of the bar for 10 years minimum. They are appointed on reco from the Prime Minister; there is no public grilling or politicization of the process. If you qualify, you can actually apply to be a Supreme Court Judge! Appointments are drawn from across the country to be representative. Try less circus, more integrity, US.

...unfortunately, removal of a Supreme Court Justice can only be accomplished through the process of impeachment, and we all saw how well that went on two occasions with the Orange Faced One. The House may be able to get enough votes to advance the articles to the Senate but there it would require that 17 (R)s cross the aisle and vote to convict each one and that just ain't going to happen.

And with the SC, I've discovered there really is no binding code of ethics. It seem preposterous for the highest justices in the land to appointed for life, and then also be the only justices in the country immune from outside ethical scrutiny (all other courts have adopted a version of the American Bar Association’s Model Code of Judicial Conduct). As weve seen, letting them police themselves has led to partisan speeches, lavish gifts, and recusal failure.

Supreme Court justices are not elected by politicians. They are appointed by the executive branch and consented to by congress. We agree that the law should never be politicized, nor should anyone be above it. The act of leaking the draft decision is the single largest attempt to politicize a decision in American history, and it should be admonished by everyone.

The main difference is society gives special privileges to people in positions of power and the leeway to say one thing and do something completely different. PS: the fact that such people in positions of power can be so openly hypercritical/fake and this be held up by the system itself will eventually break enough peoples trust in the system and the chaos this would bring would be enormous. PPS: expecting people to support such a broken system would only make this turn for the worse much quicker.

I'm just sick. I was a senior in high school when the Roe v. Wade decision was announced. I started to get worried about the attempts to overturn it when Reagan became President and I've been more aware that the GOP was focused on dragging us back to the days of back-alley abortions and the adult women around me whispering about "D & C's." Here I am at 66, sitting not so much in shock as sadness of the inevitably of this soon to be ruling. So many of the battles that were fought and seemingly won when I was a child through my young adulthood are being undermined. Voting rights, abortion rights. What's next? I'm afraid.

I will never forget my experience in medical school, pre-Roe, during an away elective in NC. A sweet, scared 14 year old brought to the ER with 104+fever, chills and hypotension.: sepsis due to a “coat hangar” abortion. She survived, but only after an emergency hysterectomy was done,. 14: pregnant at 13-by definition raped.

God forbid you have an ectopic pregnancy - since afaik you have to abort to save the mother in most such cases, this is basically a death sentence under an unconditional abortion ban. IF you have the stomach to watch, go find: 4 Months, 3 Weeks and 2 Days. It's a movie set in communist Romania (pre 1989) where abortions were also illegal and also done in backalleys by unsavory characters. I just couldn't watch it all the way... as a guy. And that's only one side of why abortions should be legal, with plenty of other reasons which I don't need to go over. Honestly, how the US hasn't yet imploded is beyond me. The gall of these Justices to say that they shouldn't be influenced by public opinion when their opinion directly affects AT LEAST 50% of the public, is ridiculous.

Obama, Pelosi, and Schumer could have prevented this back in 2009 by passing federal statutes codifying Roe v. Wade. The Democrats had majorities in both houses of Congress back then. But they were too lazy and complacent and didn't bother. So now, if a woman gets pregnant in an anti-abortion state she may have to go to a pro-abortion state to get her abortion. Governor Newsom of California has already promised that free abortions will be provided to women who go there for their abortions. Connecticut is also trying to attract women who want abortions.

Well that and, according to the Bible, god explicitly valued an unborn child as less than the value of a living person. One could argue that the line "be fruitful and multiply" was a command to have kids, but if we just happened to multiply so much that we consumed all of the food and made the world unable to support mammals, that would not have been the intention. God, if such a being exists, also gave us a brain so that even though the Bible may be translated to have a black and white meaning, we could also decide for ourselves and make what could potentially be a better choice.

A friend's mother was a visiting nurse during the '50s and '60s. The population she served was the poor; some of the houses still had dirt floors. (This was in NY state & also New England.) She always said that illegal abortions would *NOT *decrease the number of abortions; it would only increase the number of women dying. She saw first-hand many women die as a result of trying to perform their own abortions. One of her daughters still cries for those desperate women, who died because they were not rich enough to go to private clinics.

Public opinion is not the point. The judges are in service to the constitution, and Roe is unconstitutional. All this means is that the matter will be kicked back to the states, and their legislative bodies get to decide. So if you're in a blue state nothing will change.

Duality runs down to the average person, there are a good amount of people who will pretend to stand for something because they fear being rejected and want to have a horrible opinion but the ability to look good. So the voters will act surprised when they vote in hypocrites, the elected officials will act surprised when they select hypocrites for high positions and the people selected will act surprised that their decisions are divisive. But at the end of the day each person in that chain did and got exactly what they wanted.

Biden could issue an executive order. We could get rid of the filibuster OR find 10 Rs willing to stand up for the right to choose, and codify Roe before SCOTUS shreds it. There are options. Even if SCOTUS guts it, states which ban abortion will lose workers/taxpayers and candidates who ban abortion will hemorrhage votes. Some states will pass even more liberal pro-choice laws. Well technically they are meant to interpret the law, and law makers are meant to create the laws on behalf of their voters. This is actually a good system in theory because it creates a separation between the legislative branch and the judiciary. I hate the idea that people who are pro-choice are pro-abortion or that making it illegal gets rid of them entirely. My father’s about as conservative as they come, but even he believes abortion should be a private personal matter and that legalization is the safest possible option for the public. Shame on the SCOTUS for this decision, shame on the Republicans who have been consistently on the wrong side of women’s rights for the last century or longer, and shame on the Democrats for being complacent and not codifying Roe v Wade into law when they had the chance.

Your rights are enshrined in the constitution, i do not recall EVER seeing a copy of the constitution guaranteeing your right to liberty, happiness AND pregnancy terminations, it is simply NOT there, these are STATE LAW issues and should ALWAYS have been dealt with at that level. The Roe V Wade decision was always a case of criminal contempt for the constitution by the judges who made that decision. There are MANY examples of unconstitutional decisions made by the Supreme Court, they need to be revisited and the law returned to the constitutional format. Judges ARE NOT lawmakers, unfortunately some judges have misused their position to do exactly that, in order to bypass the system.

This stage of pregnancy is not used as a form of birth control. A decision like this made at any stage of pregnancy is not a decision made lightly and it is traumatic. It is not up to someone else to decide what a living, breathing, able bodied woman can and cannot do with her body. Her life matters and if she can't afford to give a potential life a life worth living it is up to her how she wants to handle that situation. Women take all the precausions to avoid pregnancy. Men do not.

I was a near miss during a time when Abortion wasn't legal and was done in backrooms. If my mother had gone through with it, I would never have been around to care but the idea of her bleeding out on a table somewhere at 19 if she had been unlucky makes me sick. Roe v Wade didn't give women the go-ahead to have abortions, it gave them the ability to have safe, legal ones. But then again, these people don't care about women. They don't care about babies either. If they did, they'd worry more about taking care of them after they're born. Hell, they'd worry about taking care of them before they're born. This is all just a red herring for the only thing they actually care about and that's power. When Trump was elected in 2016 I said the Death Eaters won and we're seeing the fall out of that. It's so tiring watching the US disintegrate slowly. Just burn it to the ground quickly so we can dust off the ashes and try and see what is left to salvage.

Yeah, I dunno if this has been discussed a lot yet, but those statements to Congress were made under oath as well. Now, they didn't exactly swear they wouldn't overturn Roe, so it likely doesn't rise to the legal definition of perjury, but... The SCOTUS, like any court, depends on the concept of judges as people acting in good faith, right? If any given judge casually lies, or deceives or misrepresents themselves or their intents, or their own impartiality, then that judge can't serve as a judge anymore; that faith has been broken. And now that's happened with three Supreme Court justices. They stared Congress in the face and lied. As of now, the decisions of the Supreme Court mean nothing until they're gone.

With all due respect to those who say privacy rights for a woman to choose what happens to their body are not 'enumerated' in our Constitution here are just a few more rights that were ALSO NOT specifically mentioned but were arrived at by Supreme Court decisions based on that Constitution: The right to state guaranteed defense in criminal cases if you cannot afford to hire your own lawyer. The right to be reminded about your Constitutional right not to self-incriminate. The right to be delivered equal AND NOT segregated public education if you are a minority.

Totally wouldn't happen. /s Think about WHY they are lifetime appointments. It makes it HARDER for them to do this which is why it took them so long to succeed. They could easily stagger the terms to help alleviate the issues, have blind nominations from a pool vetted by both parties to be qualified, or design anything that is better than the status quo.

I mean, Barrett and other conservatives did not side with Trump on several recent rulings, both those connected to Trump himself and others. They also upheld several (not all) vaccine mandates. Once again though, if we want to reduce the incidence of abortion (which we all do! abortion isn't fun.) we need to have better sex education, free contraceptives and we need to reduce poverty (Nazif-Munoz and Chabot, 2022)(bearak et al, 2020). Restricting abortion does not decrease abortions (Sedge et al, 2012)(Henshaw, Singh and Haas, 1999)(bearak et al, 2020).

I am having the same feeling. I want a baby and I can't imagine how hard and traumatizing it would be to be forced to grow a fetus over nine months and go into labor against your will. It's so disheartening.

Actually, it's quite possible that someone from Alito's camp leaked it, in order to make it harder for the conservative justices to go in the much more moderate direction that Roberts was advocating. There's no way to know for sure at this point.

As a Canadian, I am afraid of what's happening in the United States. I truly believe that the U.S. democratic institutions remain strong and I'm not going to claim that America isn't a democracy. However, the politicization of the Supreme Court of the United States raises high concerns. I would normally condemn anyone that doesn't respect a Supreme Court decision, including a TV show host. However, I can't condemn in this case because over the past two decades, the Supreme Court became a political battleground for the Republican and the Democratic Party. Successive presidents were pressured by their party to nominate a candidate based on their progressive or conservative viewpoints on very specific political issues. Here in Canada, the Supreme Court candidates must be judges from lower courts. They need to demonstrate their interest by submitting an application package. Then, the Independent Advisory Board for Supreme Court of Canada Judicial Appointments reviews the candidacies based on their merits and will submit a list of names at the Office of the Prime Minister. Finally, the Prime Minister will appoint someone on that small list. The public usually has no idea what the political views of those nominees are. Some may criticize a nomination but this is mostly because the candidate doesn't speak one of the two official languages (generally French) or because of a lack of regional representation at the Supreme Court (for example, appointing only candidates from Ontario or from BC would be questionable but not because of the political views of those judicial nominees). The members of the committee are nominated by the Minister of Justice, the Canadian Bar Association, the Federation of Law Societies of Canada, the Canadian Judicial Council and the Council of Canadian Law Deans. The Minister of Justice will apoint three members and each other will appoint one for a total of 7.

@@dracoargentum9783 1. if she’s having her uterus removed, a breast implant, etc., it’s “her” body. When there’s a baby that she’s having a knife stuck through it’s head, it’s not “her body.” 2. Tell me where the constitution says she has a “right” to have an abortion……it doesn’t. Now read the 10th amendment.
