I've been thinking about Bradshaw's assertion that a monarch had been tried for treason before, and as near as I can figure, he may have been referring to the uncrowned Lady Jane Grey. She was proclaimed (briefly) Queen after the death of Edward VI but deposed in favor of her cousin Queen Mary. Later, she was tried, convicted, and executed. I suppose in Bradshaw's mind there was no difference between a deposed Jane Grey and a deposed Charles I.

@@forgottenfamily Mary Queen of Scots was never Queen of England, although she claimed to be a rightful heir. She was deposed from Scotland and chose to flee to England rather than France where she was not as welcomed as she hoped. On the other hand, Charles was king of both England AND Scotland, but they were two separate kingdoms who happened to have the same monarch. He was tried by the English Parliament which would not have accepted precedent from Scottish legal procedures.

Even there though lady Jane was tried under the authority of Queen Mary. It wasn't parliament acting on its own authority.

I believe it may be a reference to the Magna Carta, which formed some of the only legal basis for the parliamentarians to even put the king on trial, suggesting that a king had been held accountable before, and therefore could be again

Charles was never going to accept a diminished role as king and Parliament was not going through another Civil War. Their mistake was trying to make things nice and legal.

Their mistake was trying to usurp the king. Cromwell was never going to let the King live. He wanted to be king and only decided not to be because his own followers said they would not support that.

They should've just gone all the way, reject the current legal system and craft a new one. Doing something that's blatantly illegal while maintaining a pretense of legality, while pretending like you're still adhering to the existing legal system, undermined all existing laws and created a very lawless and chaotic situation where the only option was for them to become just as authoritarian as Charles was.

Finally Historia Civilis! Probably in my top 3 history channels I will also say that I come from the other side of things, my family were on the side of the King and even fought against Cromwell, so I enjoy seeing the King run circles around Cromwell, despite my personal views on monarchy

Same here (with the exception of still being a current monarchy fan)! I take part in historical reenactments too under the banner of the King's Army, so sometimes it even feels personal even though I'm so well and truly disconnected to it by time Guess that's the power of reenacting if you really get into role!

This entire thing is me arguing with my 4 year old daughter. I tell her this is how it is and she responds "Well this is what I think about it" She's 4, and there's no winning ha ha. Bradshaw is my 4 year old daughter. I mean this in comical aspect, I love my daughter to death she got her stubbornness from me :) Yet she can really take one to the aspect of conversations.

16:45 Well the court wasn’t going to let Charles remain as the absolute monarch he wanted to be, but by antagonizing everyone he was preventing any chance of a compromise that left him some or any of his power. There were still those who would prefer a moderate solution but Charles is making that position harder to justify and in so doing weakening the moderates that he needed to empower.

Not sure the military would be backing anything other than killing the king. this had the look of a sham trial backed by a military that quite literally silenced dissent and i'm pretty sure Cromwell would have forced an execution anyway given the risks involved of having a living Charles and the fact that something like a 2/3rds majority(of the people voting) wasn't in favor of the kings execution but were persuaded any way. Cromwell won the war already this was just for legitimacy Charles not giving it to him frankly was better than arguing the case. a lost case to people who have already decided to remove you from power.

@@koiosdamocles1090 I don't think so, Cromwell barely got the death sentence signed even with the King refusing to negotiate. Cromwell doesn't have that much influence at this stage as he would later, and Fairfax leader of the army preferred mercy. It's clear here that the trial is not legal but English law forced it not to be legal. So it's a sham but that doesn't mean the parliamentarians wanted to kill the King, if only for the upset it would cause the country. Even if they would have killed him anyway Charles can't know that and his strategy while embarrassing for the parliamentarians does not aid him.

@@mini2239 Possibly. not well read on this time period. honestly if Charles wanted to fight the charges he had the ability especially treason and murder. treason being taking up arms against ones sovereign and thus the assembled judges and guards where guilty of said crime and not Charles. murder being the unlawful killing of a reasonable man is pretty easy with none of his orders being unlawful. Still i think the parliamentarians as they were would kill Charles. they already purged the house of commons for considering the treaty of Newport which was theoretically what the moderates wanted king on thrones with less power. large parts of the military already made it clear bargaining with the king was not permitted. the only way this trial would go is abdication followed by assassination or just execution. If the house of commons wasn't purged literally a month before the trial he could have had a more moderate sentence. but as it was and given the acts following it abolition of house of lords and the monarchy. i think this was just a case of a successful military coup consolidating power and removing descent(with no monarch the monarchist have a lot less influence).

@@mini2239 I don’t think the vote for the King’s execution actually mattered that much, since it wasn’t a majority vote anyway. Cromwell was going to execute the king no matter what, and it didn’t matter what the King said or did.

@@koiosdamocles1090again, your taking the purge out of context. Parliament was doing some shitty and shady shit, yes, but they were not just doing it to gain power. England was in chaos, and a group of radicals was in power, but they still exist in a time where monarchy is supreme. Cromwell would have accepted a deposed and imprisoned charles. Would the king be the absolute authority of England? No, Cromwell would, yes, but….Charles was guilty. He had twice denied peace and caused the chaos of civil war, the chaos that allowed cromwell to gain such power in the first place was because Charles refused to negotiate. What were they supposed to do?

What's also great about Historia Civillis is that in the description of every video he gives you the sources of his research that he does on every subject, and gives the link to the amazon page so you can buy the books the he used to do his research. So not only does he give you amazing and detailed analysis on historical subjects, but he also provides you the tools to do some research yourself. Not many history channels do that, so hats on to this guy. Can't wait for you to cover his Julius caesear videos. Wish you the best for your channel, great to see you come this far!!

Aye, you're finally doing Historia Civilis! They have been one of my favorite history channels on youtube for ages. This Trail of King Charles video is actually how I found this channel, your reaction to I want to say "Oversimplified's King Henry the VIII" video popped up in the recommended. Been here ever since. I highly recommend the Julius Caesar videos on Historia Civilis, they are brilliantly done

You should definitely react to Historia Civilis' Caesar-series, including "Caesar's funeral" and "Cicero's finest hour", very informative. I also gotta say how I love watching these Historian reacts -videos, as they are very informative to me, and it kind of gives me someone to watch these with, especially when that someone knows things and can better explain things, I have learned a lot with your videos by now

I’m planning on showing your reactions to this series to my parents either before or after the 1970 film Cromwell, probably after, which I need to watch myself first, having only seen the scene where Alec Guinness enters the House of Commons. Honestly, the approach Charles I took to all of this was rather impressive, and as you said in your reaction, by his argumentation I found myself to agree with what Charles I was saying and his stance over those putting him on trial, regardless of what injustices he had committed prior to this as king

This rarely ever gets taught in British schools when talking about the civil war which in itself never usually gets taught. A lot of this is new to me and I’ve lived in the uk my whole life

I think it's useful to remember that England at this point was on a complete knife edge. The Royalists may have been defeated, but they hadn't actually gone away. So, you still had a huge division in society based on whether people supported the King or Parliament. The Civil War had ripped apart families and communities. All this meant that anything you said could be misconstrued. It's also useful to remember that not only was the king the source of legal power, but even more than that, at the time it was believed by many (including Charles himself) that he had been appointed king of England by God's will and approval. He was also the head of the Church of England and there's an ancient ceremony at the coronation where the monarch is anointed with holy oil by the Archbishop of Canterbury. This part of the ceremony is hidden from public view and is considered the most sacred section of it. The king was therefore seen by many as essentially ruling because he had been approved by God. Apart from all the legal reasons why the trial might have been considered invalid, there was also this religious argument that as God's chosen king, who had the right to try or oppose him? In addition to the fear of possibly being assassinated, Bradshaw would have had all these fears and ideas going through his mind as he tried to make progress with something that had never been done in England before. So, it's little wonder really that he made mistakes.

I live in the town Whalley and Goffe hid in before taking shelter in Judges Cave in New Haven. There is a plaque outside of a house marking the basement they hid in. Guilford, CT.

Awesome! My 14x great grandfather, Sir Robert Heath, was attorney General under King Charles 1st, and he too got accused of treason, but he fled to France! Very cool!

Charles I faced a hostile Parliament from the start; however, his actions really didn't help him in any way. I think part of what we're seeing here is a case of people pushing for an outcome (in this case, regicide) in order to save their own necks. If the King lives, then their lives would essentially be forfeit. Mike Duncan has a very good podcast series on this.

So far it is a tutorial how not to set up a courtcase by the side of the house of commons. Day 1) Knowing what will be the first argument of the king and not being prepared for it. Day 2) Shouting "you are not allowed to question this" every time you lie is not the best strategy either.

@@VloggingThroughHistory It's a bit weird, but it technically does (?) It's a much broader overview of the Civil War and whether or not monarchs are even able to be tried for crimes. It sets the stage for this one, but it's not a prerequisite in any way.

I just watched this video about a week ago and it skyrocketed my interest in English history. As someone living in the US, I haven’t the slightest clue about most of European history and this video made the english civil war seem so interesting. Glad to see you reacting to this since I know that this time period is up your alley so I want to see what insight you might provide. By the way in case you didn’t know, in historic latin, Vs are pronounced the same as a W in modern English. In later latin the V gains the V sound we now know. that’s an amazing connection to know about and be connected to an event that has had so much influence on the ideas around monarchy, even after the restoration, a crucial moment for the idea that monarchy was not absolute. I tend to view the American revolution as being part of this tradition, just with a different, yet logicial, outcome to what happened in the balance of power between monarch and parliament in the UK.

It's quite amazing that you can research and find your ancestors from so far back in history. It's really fascinating. In my family we don't know anything past my great-grandparents on either side of the family. The way things worked back in Romania, where my family came from, it's basically impossible to find out.

I recommend the Revolutions podcast for a good telling of the English Revolution/Civil War. If you want extreme granular detail, I recommend Pax Britainca.

In retrospect, I can't help but wonder if The High Court of Justice would have had a stronger hand at the start if they argued that their Legal Authority came from God. I mean given the time period it's possible that arguing that their authority to judge a ruler came from God could strengthen their support, provided they could dig up a Bible passage that emphasizes their point and find a priest willing to make the statement in front of this Court. Of course, the argument would have to contend with the idea that a King also takes their authority from God so that would in some way have to be reconciled.

Well part of the reasoning behind the Divine Right of Kings is that they are chosen by God. God chooses who is born and when and where they are born and God chooses who dies and when and where they die. Since the Kingship is hereditary, who actually is King at any point in time depends on who is born and who is dead. Since God is the one who is deciding in both cases, Kings derive their right to rule by the choice of God. Parliament is chosen by the people through election. It would be far more difficult to argue that God directed the voting masses in their choice. Although I wouldn't put it past some clever parliamentarian to give it a try.

I cant imagine being on the tribunal and watching Bradshaw just driving everything into the ground. At a certain point you have to start thinking about making him suddenly take a leave of absence and have a new judge step in.

I always think the British Civil Wars provide a great deal of the underpinning of the Revolutionary War, although I spend a lot of time in the US I’ve never studied there (although we did have American students on my Revolutionary War module at University) but it seems like the Revolutionary War is taught as if I’d largely happened in a vacuum, with no precedents or cultural, philosophical, political and historical etc connections to Britain beyond ‘bad, tyrannical King and redcoats.’ I could well be wrong, and I hope I am, but it often seems like this. Was really impressed with the Museum of the Revolutionary War in Philadelphia for adding some of that context back into the conversation.

Regarding Edmund Whalley, the fact that he had to keep moving around and living in hiding for the rest of his 15 years of life (even far off in the colonies where support for the good old cause was strong) is testament to how merciless and wrathful Charles II was when it came to taking revenge on the regicides of his father.

So through reading up on the Wikipedia page for your very far back relative Edward Whalley, I learned of the origins some of New Haven’s street names. Obviously Whalley Ave has to be named after him and John Dixwell who he met in New Haven has Dixwell Ave. They associated with John Davenport who has Davenport Ave. Also major general William goffe must be who Goffe street is named for. Crazy, you learn something new every day. That’s why I love this channel. When you one day come to visit Judge’s cave at West Rock in New Haven would love to meet and treat you to New Haven’s amazing pizza.

Funnily enough it isn't the Royal Army. It's the only branch of the British military that isnt Royal and It's because of this civil war. You see the British Army comes from the English Army which was formed by the English Commonwealth under Cromwells rule. That's why its the Royal Navy, Royal Air Force but accompanied by the British Army. Even when the monarchs returned the Army never became "Royal" although units within it did gain "Royal" such as the Royal Artillery or Royal Engineers.

Funnily enough I grew up in st Ives in Cambridgeshire, Cromwells hometown and the site of the bridge he burned during the war. There’s a statue of him in the town centre which is a bit weird considering how much of a tyrant he was, but still nice to grow up somewhere with some niche historical relevance

Would maybe recommend to watch the Historia Civilis' video about the English civil war for those who havent seen it. Gives some more insight in the viewpoints of Charles I as well as keyplayers in the trail such as Cromwell

I do know a bit about the Magna Carta, etc., but not sure how all the pieces falls in place.

Like you said, no real "good guys" in this trial, all had blood on their hands. The folks we now call "Puritans" were certainly not all in favour of executing the King, I have read a number of biographies on them & many were vehemently opposed to what Cromwell's group wanted to do. Also not comfortable with the thumbnail sketch of "Calvinists" - & I'm pretty sure John Calvin could not be a "Calvinist" any more than John Wesley was a "Wesleyan" - Reformed theology has far more to it. Things went pretty much downhill for the Stuart's after James I, & at the moment I don't see things picking up until William & Mary take the throne.

The trial had no basis in law. How can the anointed head of the state commit treason against the State? England was at the time a monarchy whose authority came from God, particularly through the Church of England. The "Jury" was comprised of men who rebelled against authority of both the Church and the King. They were willing overthrow the existing order and rid themselves of Charles. They screwed it up by capturing him alive. They would have been better served if Charles died in battle like Harold or Richard III, or died under mysterious circumstances like Richard II or Henry VI. Charles was a dead man upon capture, and this was a show trial to legitimatize regicide.
