Depends on the County you live in. Here in Casey County KY I didn't have to get any permits except a septic and electric permit Its easier here in Casey County Kentucky

Estill County Kentucky has no restrictions on what you can do with your property. Lots of rough land in the eastern part of the county above Ravenna.Kentucky.

I ran into all the same issues here in Wisconsin. And like you the septic is the straw that broke the camels back. Ironically, I’m looking at a parcel in eastern Kentucky. Looks like I need to call the county and ask some questions. Sometime I feel like we’d be better off if we just went to the property and didn’t pull any permits and just did what we wanted.

Yes I would definitely call the county. You might be OK in eastern Kentucky. As far as I know a lot of the laws are state laws not county. But it’s worth a phone call for sure.

Not that I have tried but you don't need to permit anything but the kicker is when you go to sell you can not advertise the work you did if it's not permitted. Kentucky has fairly lose laws and it's the county that decides the building laws. If you live near a big city or surrounding county then you could rink into this but if your a few counties out then you might be OK. That was your bad for not doing your research before buying. Your Realtor should have helped you in this department too

I'm putting 4 pallets on two 10 inch wheels as a camping trailer shelter and then put a wood stove and two tents - as my composting toilet. If it's not in a structure then it's not a privy - it's a campsite. Move it every six months.

I'm in grayson county and they are pretty relaxed here...people live in junk campers and get away with it here. Main thing they change was no longer allowing holding tanks. I wonder if it's close to Cincinnati and they are preventing this, because of future development

My friend, I completely understand your frustration and I want to help! Just to let you know, FYI, I’m a retired county building inspector in southern Indiana. The building codes everywhere are confusing and frustrating, here is why; there are two different codes that can be adopted by a state, city or county! Usually the state legislature adopts a specific international building code for the state. Then each county in the larger cities can adopt that building code for their city or county as is, or with deletions of specific portions of the code and/or they can add more stringent codes! Here in Indiana out of 92 counties, I believe there are still three counties that have never adopted a building code therefore allowing the people that live in those counties to build anything they want in any style or method that they choose and everything is completely legal. Greene County in Indiana was one of those counties and I forgot the other two. Every county in every state makes a decision on whether they want to have building codes or not and how strict they’re going to be. Usually the more popular the county is for residences the more strict the building codes are, the less popular the county is, the less strict building codes are if there are building codes at all! States, counties, and cities can choose to require that the contractors are certified or licensed in their specific trade such as plumbers electricians HVAC contractors and the like. this commonly can require a residency type learning structure with a proven work history just to allow you the opportunity to take the test to become a contractor in that location. other places allow anyone to do the work no matter how unqualified they are! This is a double edge sword for people who wanna build their own home like you do. The reason is let’s say you build a home not knowing what you’re doing and you’re having all kinds of electrical troubles or plumbing problems or mold and mildew and water leaks and rot and you hide it and sell the house to someone else that assumes the house is OK. Building permits and inspections helps society overall. I’ve been to inspectors seminars and met lots of inspectors that were complete buffoons and others that I was thoroughly impressed with their knowledge. As far as the health department that you mentioned and trying to have a septic system and leach fields, those are also incredibly important because for example the farm I bought had a house up on the hill and a septic tank some distance from the back of the house and the affluent that came out just ran down the hill. There was no leach field! The neighbors downwind had to smell this raw sewage constantly. I had it completely dug up and a new system installed properly. The original work was done before the health department started issuing permits and doing inspections on septic systems in the late 70s. How would you like to be my neighbor and smell raw sewage every day? As I said earlier I’m sorry about your frustration but what you’re getting into is a double edge sword. I really hope that I’ve given you some answers and made it easier to understand some of the frustrations that you’ve had. I also hope that others read this will learn from it and understand how to handle these problems. Here are my suggestions; Visit the inspectors at their office. Ask smart questions. Ask for suggestions. Make written notes! Learn codes, ask more questions. Tell the inspector what you intend to do, ask if that will pass inspection or is there an easier way? If you are going to build a house, this is not kindergarten, it’s the real world, you must know what you are doing and do the work correctly. After all, why are there building codes??? They are designed to keep the occupants safe and secure, and to protect the structure from known and unknown forces. (high wind, flood, fire, electrical shock, water pipes bursting, sewage stoppages, tornado, hurricane, heat & cool comfort, rot, mold and reduce utility consumption) yes a portion of the building code gives minimum requirements for R value! Building codes are protection!

Look into a Harbor Freight trencher and do your own septic system. Also some of the no gravel chamber septic systems seem promising (no experience with those, but I do own a trencher and I love it). Good luck!

I moved to Eastern KY and had to install a septic. It was an unexpected costly expense. i am not off grid but they refused to remove the smart meter and replace with analog claiming I would not have any electricity.

It’s extortion. Ive spent the last four years preparing to move off grid and permitting has been the only thing holding me back from moving forward. I’ve come to the realization that my life is ticking away and I can’t waste what I still have left or exert any more energy and effort into trying to please the system that has extorted, oppressed and denied me my right to pursue such dreams and aspirations. As you said there is no making the government happy, they will always want more control, more power and will always resort to enforcing said control and power over is citizens or subjects to maintain their power. To move and life this way means we stop producing equitable, profitable capital for the ruling elites that lobby, legislate and enforce such policies and laws. If we stop paying their rent and utilities, move out of their cities and pay less of their taxes and expenses they charge us just to exist let alone to live that would be the death of the ruling elite. They need subjects to rule over and to work for them in order to maintain their wealth and power. It’s time for social reform and it starts with us the people from the bottom up. They can’t kick us all off of our own properties, they can’t force us all to submit. Just an attempt by the government to enforce this upon us would be the end of it and the start of something new. We should not be forced to conform to their every whim and continue to line their pockets. If they refuse to properly represent us and provide the people that wish to live this way the opportunity to do so then it’s the peoples responsibility to take a stand against such subjugation and to maintain and ensure our families prosperous futures, liberties and unalienable rights. In our life time these changes will come we have just arrived early. I wish you and everyone on their journey through these turbulent waters safe travels, that everyone reaches the shores they aim to reach and most importantly that they remember to enjoy the journey along the way even through all of its storms, challenges and obstacles it throws at you as most in this world never even set sail let alone envision the dream.

yeah the septic thing is real in kentucky from what I am reading online. it is illegal to have an outhouse or any other non-septic system. It's also illegal to build your own without permits. however, i'm also reading that some counties have no enforcement ability due to lack of staff. So it kinda goes unnoticed in some counties. figuring out those counties is going to be the hard part for some of us like myself who's looking to go there for retirement to get away from teh government nonsense

If it's a campsite - I'm allowed in my zoning seasonal camping. So a composting toilet needs a privy permit but a privy is a structure! So just don't build. I'm putting it on four pallets on wheels with two tents and wood stove for heat. Move it every six months - it's a camping trailer shelter that is easily movable. Not a structure so no permit needed.

Yes, Kentucky is pretty strict on building codes for new construction and development. But if you go east of Harlan, and drive through the hollers to the state line of Virginia, you’ll see why they don’t want people to compound the problem that has been going on for centuries. I highly suggest your homestead plan has an economic, educational, public land use or improvement that benefits the surrounding communities. If you tell the state and the county that you want to buy some land and build a shack to live on, they’re going to tell you they have enough people living in shacks. However, if you are building a handful of cabins and you plan to live in one and rent the others to tourists near the national forest, you are going to have an educational center, a native habitat, that you’re hoping KDNR want to use your creek as a fish hatchery, or this is going to serve a legitimate economic purpose beyond the scope of living in a shack or cabin in the hills and hollers, they are going to be more open to the idea.

Agree. Many counties in KY have so many regulations. Sounds like you live in Boone county. An tons of expense getting all the permits. And what we experienced in Boone Co if you don't use one of the local contractors they will keep failing you and local contractors are very expensive. It's so bad outside contractors don't want to do anything in the county. Can't swear to this but our neighbor told us even going solar the county doesn't allow you to go off grid that you have to stay hooked to the system. We also have been told we can not dig a well nor put in a sceptic system. We live in the city but right over the line so zoned county. It's better to go way further south to get away from all this BS. You can do more around the KY TN line. Problem is then there isn't much places to work. Wish I knew where you were we might be interested in buying.

It was so expensive that the locals who have been there for generations couldn’t afford to go. They started getting stricter regulations, and it’s always been a good old boy network, to fill the coffers. I moved from there in 2013. Best decision ever.

@@Will1998 True. I have family that live in Whitley Co which is KY, TN border. Very small town and yep same deal permits etc. Hubby and I looked at a house in Corbin a few yr's ago. Even though it felt like country it was city limits. House was cheap enough but wow the taxes were really high. Tax rate the same as NKY. I was shocked ! Even though we are old now I would still like to find about 20 acres if not more. Then put up a pole barn and finish it out. Honestly were waiting for another crash and hopefully find some land then. It's coming maybe a couple 3 yr's but it's coming. Price has just gotten stupid outrageous cost even down way south !

Alaska is one of the hardest to go off grid. The winters make solar bad and freeze the rivers, and it has the shortest growing season. You have to really know what you are doing or have a very expensive setup.

I lived in the winter off grid in Alaska on a homesteaded property - after six months in Alaska you get residence and so get your annual fuel allowance. We got six cords of logs delivered. Then we left with six feet of snow there. hahahaha. I'm not sure how the permitting process has changed there but a lady on youtube is putting in her own septic in the same town I was living outside of. I haven't asked her for permit details - b/c it's all just a big pain.

Sorry that you tried to be decent and had this happen. I have called up county planners and I have been very skeptical - and I never "pulled a permit" since I knew not to trust the government. hahaha. It sucks. As of now I don't need a permit for seasonal campsite and so I will keep it that way! You have convinced me bigly. I asked them about composting toilets - the STATE pollution regulator said is there no discharge? I said "No discharge" then "no permit needed." OK but the county planners insist any composting toilet in a structure is a privy and a privy permit needs an engineer designer or something stupid. So I told the county planner - I just camp occasionally and I put it in a shelter. He didn't know what to say to that. hahahahaha. So now I am building a year-round pallet-wheel camping trailer shelter that will have a wood stove in it for my composting toilet. Yes we get very cold weather and that's my main priority - not freezing. hahahaha. What else? Yeah so the zoning and tax assessment are different things. I am zoned for no permit for seasonal camping. But the tax assessor would probably change me to "seasonal recreational" thereby requiring me to have a permanent address somewhere else. That gets you into the whole - car license RealID tracking system now post-9/11. So the Patriot Act made it illegal to be poor. I would try to NOT get a Real ID and hope that I can have a mailing address somewhere that is digital and not a PO box - but if that gets rejected then I would be forced to get domicile in a nearby state that is RV "continuous or full-time traveler" friendly. "In most cases, yes, even a gravel driveway will likely require a driveway permit," - dang that's disgusting really. They really do micromanage your property.

Man… that sucks. I know you may be hesitant to do it but I would look into hiring a realtor who specializes in finding no BS true off grid properties. They can save you headaches by figuring out if all of those permits are required, they can keep searching until they find you a plot where those things aren’t required. Plots where you can run your own rain water and solar, and if you want to take a dump in a bucket by gosh you can do it. In Oklahoma and Texas there are several places like that.

I grew up in Kentucky and we NEVER had a permit for anything. My parents built everything themself and by hand. I’m sure things have changed there since the 90’s and 2000’s but this sounds a bit much. I think most places in Kentucky as long as you are far enough from city limits you wouldn’t have to do this.

The problem is not only did this fellar' make a major fuq'up by asking any bureaucrats for permission slips to build and homestead, and going about things like the Yankee City Slicker he obviously was, but he must be in Metropolitan Louisville or N.KY/Cincinnati or Possibly Greater Nashville for those stacks of permission slips to even exist. The parts of the state that are still culturally still KY' don't need no damn zoning or codes, and if any of that crap did exist in the real KY, it would only be for those that are arrogantly dumb enough to go such tyrants and beg them for such forms of abuse.

Good luck finding a place to build a house where you do not have to deal with the local/county/state government. It is not just Kentucky. Let me ask you this. Would you buy a house from someone that built it without following any type of building codes using whatever materials they wanted and how they went about assembling it? I sure would not.

More importantly, would you want your neighbors being able to poison the water table by just dumping their raw sewage directly into the ground? I believe in the Do No Harm principle of Libertarianism. Regulations about septic systems help ensure people are doing no harm to their neighbors' drinking water.

@@TheCharleseye what do you think septic systems do? It breaks down the solid waste and then drops it directly into the ground where the dirt filters it as it goes into the ground water.

@@firefalcon100 That's a good way of explaining septic systems...except for the whole part where the tank holds onto the toxic sludge that can't be broken down and has to be pumped out every few years. It's almost as though there's a reason we started using septic systems instead of just holes in the ground.

@@TheCharleseye yes "failed" septic systems are a real problem though and then the "treatment device" is what? an aerobic air pump into the septic tank along with aerobic bacteria to COMPOST in the water! hahaha. Meanwhile you are wasting a huge amount of clean water to flush the toilet and it's a huge expense. You know what happened? The Roman empire had shallow street sewers that polluted their drinking water. So then everyone is all like wow look at those impressive Aqueducts! hahaha. Meanwhile the Berbers in North Africa have been doing humanure composting for thousands of years to grow their food! No water pollution by doing source-separation urine-diverting dry composting toilets aka "ecological sanitation" - even the U.N. promotes this now. But that goes against all the septic installer businesses and also people don't want to embrace ecology - they want to "flush and forget." Hilarious. There is one septic treatment device called the "Sludge Hammer" - I think it's 25 watts for an air pump and then a burlap bag of aerobic bacteria - then you can actually fertilizer your lawn with the effluent because it comes out composted!! The Sludge Hammer inventor studied ecology and he points out all these septic installers have no idea what kind of bacteria there are in their anaerobic septic tanks.

if you need a permit and don't get one you can be issued a citation to appear in court, your house or dwelling can be condemned by the health department. move to another state which allows what you are looking for. the trouble with that will be lack of decent jobs. move to alaska young man.

my state had an Amish septic case go to the U.S. Supreme court and it in 2017 the Amish won!! Wow. Or maybe 2018. Anyway you gotta marry into the Amish to become Amish I suppose. hahaha. It was all about their graywater ironically - and NOT about using a privy outhouse. Pretty crazy since everyone kept pointing out the outhouse was permitted but would cause way more pollution problems then their graywater setup. They just use 3 feet of woodchip mulch for graywater and the Supreme Court granted them their "freedom of religion" right. Pretty awesome.

You picked the wrong part of Kentucky. Southeastern Kentucky and you won't have those kind of problems. You must have picked western or northern. It's not the state, just the part you're in.

You're talking about County restrictions, not State. You picked the wrong County. There are 120 Counties in Kentucky, all with their own laws. I understand your view on being left to your own devices on your own land but it's your own fault for buying land in a County without researching that County's zoning and housing laws. As for your future plans, if they require permits for the remodel, you're just back in the same situation. Do yourself a favor and actually learn something about the County you want to buy in _before_ you buy another property.

Uncle sam gets richer while poor get poorer. I think its a knee slapper how they can tell us what to do with our land we bought and worked for... smfh. But this why if we dont do alaska and we end up doing kentucky im look into something already built with land and make sure the majors like septic, electrical, plumbing and foundation is good. Im sorry you had go through this. Now i see why my pal pal a vietnam vet says the only good government is a dead government.

I'm burned out and tired of the GA climate. I'm not willing to pay 1500 a month in rent. The real estate in GA sucks.

Yes even a 30 sq. foot lean-to shed gets "assessed" as real property. It's called appurtenance. Any structure on skids might be a temporary structure with no permanent foundation but the skids means it's "attached" to the land if it is a portable building or "readily removable" building. So that's why I'm sticking to four pallets with 2 wheels of 10 inch solid polyurethane - and put tents on them - and so you have a "camping trailer" that is a shelter that is easily movable. So then it can't be tax assessed as a structure even though it's bigger than a 30 square foot lean-to shed.
