I mean a witness said she used a towel to hide evidence of gunpowder residue no telling if she wore a hazmat suit in order to hide the residue from her clothing. It absolutely can happen. A Judge is the one that makes all the determinations before the jury is charged with making a decision. He knows the law better than anyone. He said the State didn't prove their case. This is a prime example of the legal system working and why it's important for the prosecutors to have undeniable evidence.

His explanation makes no sense. Or if it does it would apply to a whole lot more cases. He says he is worried the jury would convict on emotions. Both sides had the opportunity to play on emotion. The judge had opportunity to instruct jury what to consider and what not, and to warn the jury not to vote based on emotion.

There are many innocent people in jail who wish they had a judge who did their duty like this one did. Better to potentially free guilty people than to risk jailing innocent people. The state did not fulfill their duty, and the jury members then proved that they were making emotional decisions, proving the judge correct. Prosecutors love to manipulate juries, knowing they are human creatures, as easily manipulated as all of us (despite what some of us like to think about ourselves). It's honestly disgusting how easy it is to put innocent people behind bars.

No, he saw that the State had NO EVIDENCE. The Corner jump the gun too. His death should have been ruled Inconclusive. There are way too many holes to pin on anyone. No gunshot residue on her person nor clothing. Where is the evidence linking her to the death? The evidence at hand does not show that she was the person who pulled the trigger. Find the person who has the gun shot residue. Did that corner test the victims hand for gun shot residue. Too many holes to lock someone up for the rest of their life. It's not a contradiction it's 2 different facts, she was known to be out and he couldn't be proved to have died at a specific time where she was home. Unless you can prove someone died like 3 hours before the suspect was out creating an alibi then you can't prove anything. I don't think the judge was saying she's innocent or guilty honestly, I believe he was saying there isn't enough evidence to prove she's guilty. In the uk police have to put forward their case to the crown prosecution service who decide if there is enough evidence to go to trial. They are similar to the DA in that way except they aren't elected or appointed, they are people who applied for the role and have a country wide framework of what to consider. No political agenda can sway it. No emotion, just does this meet the criteria for being prosecuted, is there enough evidence to support the trial ect.

It’s the price we pay for trying to have cases tried on the merits of the case itself instead of someone’s past. Although rare, I promise you there are people out there with 2 or 3 spouses that died under what can be described as suspicious circumstances but that had nothing to do with their deaths - our Justice system is designed to protect the innocent which sometimes means letting a guilty person go free.

Was she wearing the same dress in the morning before she left for the hospital?. - Judge Summers - "There was no evidence to show she was even the last person to ever see David Leith alive". Were there no home security cameras in the house or the immediate neighbourhood? - Judge Summers - "...the state couldn't prove the time of death..." Did the autopsy not include the app. time of death or the estimate of time since death?. David was alive in the morning before Reynella prepared breakfast for him and left for the hospital. - Were they watching TV in the bedroom before Reynella prepared breakfast and left for the hospital? - Were cell phone tower analysis not done to confirm the whereabouts of both Reynella and David on the morning of the fateful day? - "...he was convinced the prosecution didn't meet it's .... to prove Reynella had the time or the opportunity to commit it..." How can one be so sure? She probably shot David in the morning just before leaving for the hospital. - How come there were no fingerprints on the revolver? Was the revolver tested for DNA? Did the perpetrator wear thick protective gloves before the shooting?

Having dealt with a close family member that was dealing with the same thing as her second husband, I do see where the defenses explanation is very plausible with the gun shots. If you don't have experience with mental health/brain diseases/death with them and neurological problems you wouldn't understand it. It was my dad and I saw not only his irritation dealing with it but other people in the facility he was getting help at. I heard several times what they said as well as my dad. "I'm useless, why am I even here." I would assure dad we needed him and give him examples. I also dealt with PTSD from WWII. Extremities (head, arms, hands, legs, feet) just spasm or move on their own. I myself have neurological problems with my hand. It will spasm and double do whatever I am doing. It's slight and just an aggravation for now. Like typing this I have to proof read and correct what my fingers double type and if I use the mouse my middle finger will spasm and click the mouse button. Sometimes the mouse flies to a different area altogether. My wrist will just have a weird flick to the right once in a while. Thankfully, the doctor does know why but I won't have the surgery until it gets worse. Other than that I would have to hear the entire case to base an opinion. I am in middle Tennessee and we didn't hear much about this case back then. I saw no hard evidence, nothing that showed beyond a shadow of a doubt that she did it. Just circumstantial that might implicate her guilt, but it certainly doesn't prove her guilty.

Great story but if you want to die, you use the hand you normally use to make it a speedy death. Not shoot with a hand you don't normally use.

He didn't send the jury to deliberate at all...and he did what he did to uphold the law...the state didn't have enough evidence to prove her guilt therefore he dismissed because in his opinion they didn't even have enough evidence to charge her to begin with...which they didn't...I agree she's probably guilty however the prosecution didn't PROVE it beyond a reasonable doubt and the judge stopped the jury from convicting her on emotions and their opinions because of the lack of evidence
