Having that waiver clause in the contract is a violation of FMCSA rules & regulations. When drivers and small carriers violate, they are given fines, shutdown, put out of business, license suspended or lost altogether, etc. We need the FMCSA to enforce strict punishment(s) upon brokers who violate the rules and regulations, whether it be through contracts or otherwise. They must make an example of any and all broker bad behavoir in order to invoke the fear of losing their livelihood, just as they do on the carrier and driver side.

I used to tell carriers and drivers of 14906 when dealing with brokers. All of em never believed me. Thought I was some conspiracy theorist. Nothing you put in any contract (especially commercial contracts) can negate or overthrow federal rules and regulations. Carriers save your money and invest in lawyers and sales reps (to gain contracts). It's part of business.

I picked a loaded trailer on a dry day delivered it went to get the next load with that sale trailer it was raining I didn’t notice the leak went to pick up a paper load got rejected from leaking ceiling and they put that on me.

It has got to a point where they wont even negotiate with me anymore. Oh & the waiver is still in the tql packet. This order is specific to their packet with pink cheetah. The sentence doesn't say remove from packets (as a whole) it states "with the business pink cheetah" & yes they absolutely black list .

Do Not become an owner operator to only haul of the load board/spot market it's like modern day slavery. I see a lot of immigrant drivers driving a class A CDL without going to trucking school or knowing the rules, regulations and laws of the U.S.A they will haul for dirt cheap thinking it's a lot of money, more than what they would make in their country, what they don't know is that they are now abiding to prices of this country which makes their load be run for almost free. I had a broker who later became a friend tell me if they don't understand English we can do pretty much anything with them....😮 TQL makes billions off of truckers they have their promotions, awards, give bonuses and a yearly event which all agents attend they teach them how to punk the trucker...so sad. Hope they get what they deserve in near future. Truckers need to write to Trump and have him regulate the industry like it was before 1980. All miles paid same rate going anywhere to and from.

Oh TQL black lists you! They are black listed by me since 2020. They haven’t paid me 8300$ for a load from seaford Delaware to woodland WA and that included 8 stops along the way! All because one receiver missed a page! How am I supposed to know what paperwork I’m supposed to get from receiver when there’s a whole packet that’s like 20 pages! Arrowhead freight LLC is black listed too! Never paid 2700$ for a load! Also choptank transport Inc! Had to fight with them for half a year to get paid!

I was also blacklisted I was given a wrong address when I told him I will be late they said don’t worry about it they will take care of it when I arrived they try to get me to pay $225 out of my pocket the argument went on for two hours. I decided to pull out of the bay door and go home. The Broker calls me back, cursing an F wording like there was no tomorrow for me to return to the load. I have no choice L O L Truck is on the Maya Authority and everything.

IF I take a TQL load there's a $250 surcharge tacked on to my rate automatically just for them calling me. That surcharge is to pay me for a detention payment they refused to pay 7 years ago. Stand your ground. If you don't get the rate you set, don't pull the load. It really is THAT simple.

At 2:55 you say carriers can't ask for the rate cons. This is inaccurate. Sorry. Just to clarify - the records a carrier requests from a broker are the documents that the broker has with the shipper. A carrier is always supplied with the rate con because that is the contract between the carrier & broker for that load. Please also it's noteworthy that the TIA is the association that has directed its members to institute the waiver in the packets. Thru even provide it as a template. And the TIA has a pac that donates & lobbies heavily to congress.

Once the foreigners get tired of getting burnt by Tql that is when you will start to see some what of a change in theses brokers behavior.. As it stands Tql loads fly off the load board very quickly.. They dont need American O/O to run their freight.. And as far as the government, that will be a tough challenge for carriers to win.. unless we are willing to lobby and allow politicians to be in our pockets, carriers will never win the transparency act..
