Thank You. One of the worst stories about civil rights abuse I've heard. Except for someone actually being killed. This has to stop. Implications are far reaching and causes increased distrust of law enforcement. Undermines public faith in the worst possible way. How would the feds feel if this happened to one of their college age sons or daughters? Common now!

I believe it should carry a more severe punishment, Imagine if a civilian who just committed a crime rounded up all nearby witnesses and forced them (flashing a gun) to delete the footage they took of him committing the crime. Now an officer doing that should carry a more severe punishment because he did it while on duty, he's getting paid for that time and he's using government issued service weapon, vehicle and resources. While being paid to uphold the law he instead violate the law!

I would normally say that is the wrong way, but... plain cloth officers pressing charges for resisting police officers against a person they victimized... What are people supposed to do? Calling the cops does not help, that leads to arrest and charges being pressed. Opening a case? Burns money and decades of lifetime and results in... nothing I can call a victory for anyone involed. Ask the law makers? That is a good one, if those two muggers are immune to the constitution and literally use it as a weapon against a defenseless person, then nothing helps.

Qualified immunity is a widely misinterpreted legal theory. Qualified immunity protects cops from frivolous litigation. Sadly, the reason that cops have literally gotten away with murder so much is because government itself is inherently criminal. Policing needs a complete overhaul. Cops protect their oligarch owners -- not the people.

Qualified immunity is derived from sovereign immunity, which dates back to the English kings. I the original idea of sovereign immunity is that the king could do no wrong that definition has been refined over the years in the United States to allow people to sue the government in some instances, but not others for example, if you are a civilian employee of the military you can sue the government, but if you are, an enlisted person or commissioned officer you may not. Qualified immunity is supposed to protect an officer from being sued in the case of a legitimate mistake of fact, or law, not obvious criminal abuse, as we saw in this case.

Forget the immunities… this was before that had anything to do with it. They ruined his life before he was even allowed to TRY to sue them. Say there were 0, Zero, protections for the officers, not even qualified immunity at the local level. In that instance, they would have Still spent their life savings on the ‘criminal’ defense…. Then he sues them and wins instantly etc etc, but FIRST you have to have a life savings to spend on the criminal defense so that you aren’t in jail..

If you're in NYS you'll want to support NY Senate Bill 182. It would repeal qualified immunity for police officers and government officials through all of NY. Call your senator ASAP and tell them to vote for SB 182.

You have to remember IFJ is composed of BAR members and with the BAR is where their loyalty lies. There are certain Constitutional questions they REFUSE to litigate because these Constitutional issues conflict with private international law (global communism) as well as the fact that the resolution of these questions in favor of the Constitution will affect affect the monetary bottom line of BAR members nationwide.

It's not better in Canada, everybody knows that the laws apply 100% to citizens even the super obscure laws that nobody could reasonably know considering regular people are expected to be able to hire a lawyer just so they can understand the basic laws that apply to themselves. Wake up Americans; Treason is the crime of attacking a state authority to watch one owes allegiance. So those with Allegiance can attack a citizen and the government authority has the security blanket of qualified immunity, The sole purpose for this allegiance is for prosperity for all. Harlow, V. Criminals of the government acting under the color of law conducted themselves as tyrannical criminals supported by the security blanket of qualified immunity. All the acting government authority on scene did their best to use their presumption of authority for the brotherhood of law enforcement not for the oath of prosperity for all. The destruction of evidence is not in good faith or objectively reasonable with the laws of this United States of America. Wake up Americans; 800,000 AKA law enforcement officers across this nation keeping America from prospering over (1). Qualified immunity encourages criminal activity. (2). Fraternal order of Police, protects criminal activity within the agency of policing (3) the Unions of law enforcement protect those that do criminal things under the color of law. Stop those that keep prosperity for themselves. True leaders need only good faith in themselves to be honorable to the believes to prosper we must have the mindset that prosperity is for all. It's impossible to be the white stripe on the American flag, but it's possible to recognize what is not pure and innocent. It's almost impossible to always hold true to hardiness and Valor. But when we see the red in others we most certainly know theirs no valor in their hardiness. We most as a nation strive to keep a watch for danger that keeps America from being prosperous, it's an agonizing responsibility to always strive for justice, it's the need for all humans to have the chance to prosper. It's time to hold your self's acceptable, be for hold others acceptable. The path to prosperity for all is to always fight against tyranny and treat it as it's never welcome in any society. The LEO involved aren't going to testify against themselves. I can't imagine how the people defending them on the federal level can stand being in the same room without spitting on them much less defending them in court. Perhaps the only way to punish these kind of criminals until laws change is to publicise their crimes, along with their names, photos, in the hopes that decent people will refuse to socialize with them and at least let their families know what they really are.

There's no reason for having any cop that can't be sued . When they committed a crime against a member of the public. They should be able to be sued like any other cop. Being a federal cop should not give free range to violate people's rights and commit crimes against citizens.

Qualified Immunity was extended to cops to make it profitable for civil rights lawyers to sue. Cops were taught to hide their assets and make themselves judgement proof. Lawyers weren't talking egregious cases because there was no boat payment at the end. The idea of QI was to open the deep pockets of the tax payer. It's a difficult situation. They talked about it from the lawyer perspective in the beginning. How if there's no big payday at the end lawyers just won't take your case. That's even with the deep pockets of the tax payer. It's a balancing act.

@@ftws41 Depends. If you define unconstitutional to mean "whatever the Supreme Court decides", then no, Qualified Immunity absolutely is as constitutional as it gets. If you define unconstitutional to mean "whatever a moral and intelligent person interprets the constitution to say", then Qualified Immunity is absolutely unconstitutional and an egregious abuse of power. Things would change if Qualified Immunity was about protecting officers who made a honest mistake, but then we're talking about spelling errors on a form, not "I accidentally beat somebody up, after I accidentally mugged him, then I accidentally charged him with multiple crimes"

I don't need to imagine a government that does something wrong and not being able to sue over it. I was arrested for a crime I didn't do. Spent over a year in jail fighting for my freedom. Just for the DA to drop all charges a year after my arrest and them saying they didn't have any evidence against me. Happened to me so I don't need to imagine. I lost everything. My home, truck...... everything. I looked for help after I got release. All the attorneys said they want money up front. Lol how in the hell am I going to have money if government just kidnapped me for over a year.

They are not allowed to force a deletion of footage. It should be serious jail time just for that. Literally tampering with evidence, corruption, impeding an investigation, all those charges at once and more. They should all be dismissed and criminally prosecuted, and that's before you account for those two 'federal' officers, who need to be charged with criminal assault and battery, false imprisonment, lying on a police report, and false witness on top of everything else.

Now even with body cams they can delete,alter,withhold my family member that works for the Chicago pd tells me they do it all the time and try to get your own video recording because its the only witness you are going to have in court and it's going to decide if ur guilty or not of whatever charges they decide there going to charge you with. Its a scary injustice we have to face against this tyrants but know we all have cameras in our pockets live stream to what ever platform so they can't delete the video

Currently many members of the supreme Court want to prop up immunities as high as possible. Several of them are known to take bribes from people with matters in front of the court so they want to make sure immunities are strong. They think that if they limit accountability and transparency they are less likely to get in trouble.

They won’t even allow the officers to be sued for monetary value. Let alone the fact that these criminal officers deserve to be behind bars for what they did. And the entire government protects these criminal officers. But yet they will convict us of the pettiest of crimes. It’s disgusting and this crazy laws need to be changed. Every officer needs to be charged with felony assault and this man James needs to be awarded a minimum 9 million dollars. A million for every year they tried to dodge accountability.

That’s really another problem in and of itself. Say they take it to court and lose. These people already lost their life savings. Now they would owe attorneys something probably close to what they already lost. Literally lost it all to the “justice” system. That would be a tragedy. It wouldn't benefit him, as the law change would only apply to cases after that date. And while there are people that would want someone like him to testify, there are many moneyed powerful interests that like things just as they are and will fight to stop such testimony from ever taking place.

He was acquitted!? That means a prosecutor, saw the video, saw the beating, listened to witnesses, and still decided to try to put this man in prison. The prosecutor is even a bigger villain than the cops.

​@CrucialFlowResearch No. What they're saying is, since he was acquitted, that means it went to trial. The prosecutor's job is to decide wether or not there is actually a case to bring to trial. So the prosecutor saw all the evidence and still decided to try and send him to prison when they should have seen that evidence and immediately thrown it out.

Wrong… acquitted of criminal charges. Acquitted means found not guilty. Charges are invalid. They are appealing to the Supreme Court for 5he violation of James’ civil rights. I suggest you look up the legal definition of “acquitted.”

@kriskoppy2753 just looked it up. First hit on Google: "Acquit means to set free, release or discharge as from an obligation, burden, or accusation. It is what a jury or a judge sitting without a jury does at the end of a criminal trial, if the jury or the judge finds the accused defendant not guilty of the crime." That's what they are saying. It went to trial. Which means the prosecutor still tried to convict despite all of the evidence suggesting innocence. Who do you think those "invalid charges" were brought by?

The corruption is literally everywhere. Starts with the officers doing this evil, then all the other officers that played along, then everyone in the prosecutors officer, the jail, the courts etc, etc, etc. Instead of standing for justice, they all actively cooperated to deliver a gross injustice and to make the US a dangerous unfree country. Calm down Mary. He didn’t even die. I saw a video a few weeks ago, where the call was “a black man with a gun” (that’s not a crime). They showed up, he ran and fell down, the gun went clattering across the sidewalk several feet away from his reach, and they shot him 13 times up his spine and rectum (he was laying on his belly facing away from them). That was the most egregious case i’ve seen. Or how about the unarmed white guy that got ripped out of his mom’s car and shot to death in an elementary school dismissal line. For smoking a cigarette. Or Tyre Nichols beaten within an inch of his life.

Scary to think that regardless of how law abiding you are. The only thing separating you from criminal charges is luck. Sheer dumb luck. The idea that you could go from doing absolutely nothing wrong, to ending up in hospital facing 3 felony charges and spending your family's savings to prove your innocence is just inexcusable. The system is beyond broken.

We should back the blue, however, there is a HUGE difference between saying back the blue, and back the blue at all times, in all cases, in all places, no matter what. I believe in backing the blue, provided they are doing their jobs and not breaking the law themselves. But if an officer is a bad apple and they break the law, as seen in this video, then no, of course I don’t back the blue in that case. Simple as that!

@@Parkerone007 I think any law abiding citizen who believes that a healthy society requires some rules. Want's to be able to have confidence in those we employ to provide and enforce those rules. Which is all "Backing the Blue" really is. An outward display of confidence for the system and it's participants, that implies trust. But personally, I am alarmed by stories like this one, and deeply concerned by the rate these sort of stories are occuring. It's at the point where there are enough bad apples to ruin the box. It's at the point where no matter how law abiding you are, you still need to be lucky. And I'm at the point of saying if you're not part of the solution, then you're part of the problem. Good cops are the only people who can fix this. And I'm holding them responsible for allowing bad cops to exist.
