All a mistrial will entail is a new trail, re canvassing of jurors and the prosecution, defense and judge getting to cross their T’s and dot their i’s. They’ll have to go through opening statements and witness examinations again but that still doesn’t determine the out come or help the prosecution.

The judge is doing a great job at ensuring a fair trial. Neither side should be able to sneak in last minute evidence. To be clear a mistrial doesn't mean that he's innocent. It just means that they would have to do everything all over again.

To be clear, the judge *believes he has no choice* but to declare a mistrial if the whole trial train lurches off the tracks. Everybody has to adhere to the rules of the court room. Evidence was filed *very late* so you have to proceed carefully 😬

Prosecutors make this calculation all the time when there's strong evidence they aren't allowed to introduce in a case that hasn't gone as well as they would've liked. If a mistrial is granted, the State gets a do over. If their isn't a mistrial, then the Jury hears the evidence.

Sometimes you really gotta drill a person for information, because if they show any doubt in their own testimony that could cast doubt on the entire prosecution. If they know what they remember, they'll stand firm in that belief. The court isn't going to let foggy memory get used as evidence, so you have to be strict on witnesses.

Don’t forget the prosecutor works under the attorney general and any evidence is submitted through the ag office first before anything else. So the ag knew full well the exculpatory evidence prior to it coming into the court

You gotta listen better the judge is trying to ban certain pieces of evidence based on some court procedural issues that out of his own mouth were not done in bad faith so at the courts discretion any new evidence can be entered into the trial, the judge is trying to help the defense secretly because he knows the defense nothing to stand on, but if you listen to the last few mins of this video, the prosecution just said that the evidence was already submitted on both sides an that the o2 % reading is inversely related to the co2 % meaning the findings was not new evidence being entered into the court but a more thorough explanation of the evidence that was already submitted by the prosecution in may. You gotta pay attention this judge just showed his true colors he wants a mistrial end of story.

@Raymond truth hurts, pony soldier. He used a less forceful approach than he was justified to use, and apprehended George on the ground at his request. In previous arrests, George also used the "I can't breathe" (Eric Garner) and "momma" lines as a means to escape custody then, too. It's a tragedy he died, of course, but George Floyd alone could've prevented his death from the moment he woke up that day. Or the day before, if he was up all night getting high. I get high too, but I dont use counterfeit money to rob stores or do anything but fully comply with police if I'm being detained lawfully.

The judge is discussing the evidence. It would entirely inappropriate for the jury to hear what the judge thinks in regards to the witnesses and the evidence they've given. If the judge could in principle have this conversation with a jury in the room, then a judge would have the ability to directly influence the jury and that would be very wrong. Even if in this case, it may have been beneficial.

And... then the prosecution rebuttal witness immediately mentioned evidence of the test showing exactly that. But: no mistrial! This thing has been a railroad job against the defense from the beginning. How many times during the trial did the defense complain that they were being presented with evidence for the first time? This case will lose on appeal if it isn't dismissed outright. I mean, every day the prosecution introduced about 450 documents into evidence - just to overwhelm the defense. What does that say about the case.

No, the prosecution just wanted to create an inverse relationship between Oxygen levels (current evidence) and CO levels (new evidence). The judge allowed this at the end of the video and the witness did end up speaking his testimony with no mistrial.

I think you’re right. This judge is clearly bias. The doctor who did his autopsy said he died from asphyxia. He did not die from the drugs. People can say that all they want but several doctors have confirm the same thing. People should have someone kneel on their neck for 9 mins and see how long they last. The whole world protested George Floyd’s death. I believe their lives will be in jeopardy, the judges and Chauvin if he is let off.

Their where and Dr. Tobin had results in his report to the court. Dr. Tobin is Pulmonologist/lung doctor. He had to see those tests to reach his conclusions. He had submitted them in his report to the court. He also spoke on them when he testified. The judge had to verify it and then they moved. The prosecution said they did not get the results until then but Dr. Tobin already had a copy. Dr. Tobin saved the prosecution. There is so much going on that we can miss a few points of the drama.

Once George Floyd was put in ambulance it would be standard protocol to administer supplemental oxygen. I did not hear any questions about how that would affect the arterial blood gas readings later at the hospital.. or the pulse oximeter readings.

The thing is that CO binds more tightly aroung blood it takes significantly more time to leave the blood up to an hour if using an oxygen mask several hours uner normal air conditions Regarding the test DR. Fowler stated that oxymeters are not an accurate method of measuring someone's CO levels in the blood The new evidence was the CO lvls tested on GF when he died which was submitted extremely late by the defense Now during questioning Dr. Tobin Stated that the test that was done and which was admissible in court to evaluate GF O2% was not an oxymeter test but rather a blood test blowing Dr. Fowler's argument out of the water which is why Nelson stopped his cross examination which is not a good look for the defense

@@leonards.9112 Dr. Tobin had discussed the tests when he testified. He is a Pulmonologist/ a lung doctor. So he had to check Mr. Floyd's blood tests dealing with his oxygen levels. The results he had he had discussed when he 1st testified. He also had them in his written report submitted to the court. Once the Judge saw that Dr. Tobin had results already written in his report to the court. They were able to proceed. Dr. Baker who did the autopsy contacted prosecution and said Mr. Floyd had blood work drawn . It's called blood gases. Dr. Fallow had said he did not see any results that blood gases were down. Dr. Baker saw his testimony yesterday and contacted the prosecution that they were drawn and they should have been in the medical records sent to the prosecution. The prosecution was sent a copy. The judge said you can't bring in these tests last minute as New evidence. What saved them was Dr. Tobin had his copy of the tests already submitted to the court in his medical findings submitted. He saved the prosecution. The Judge verified info and trial continued.

@@pricilladummie1189 they just explained it when they were cross debating the O2 levels on what was acceptable for discussion. Oxygen levels are inversely proportionate (according to the video) to CO levels. So if he had high CO, then he wouldn’t be able to breathe. Known as, Carbon Monoxide poisoning.

The last bit. If it is bloodwork from a blood draw you can debate oxygen saturation vs. CO. If it is testimony from pulse oximetry readings then the other is true. Standard pulse oximetry will not differentiate from O2 and CO. A person suffering from CO poisoning will read 100% on a standard pulse-ox. This reading is very rare though and should raise a red flag. There are also pulse oximeters that can read CO vs. O2 out there.

@@debrarice4618 Actually it is a way to get the jury to prejudge the case or the people of the courts to prejudge. Also, Maxzine Waters already started that problem. inciting more riots. It is a boat and pony show. The Judge basically helped by letting the media in.

This is how things are done. Despite what is shown on television, people can’t just walk in part way through the trail and throw in new evidence. All that stuff has to be shared between the prosecution and defense during the discovery period prior to the actual trial. If anything important shows up, they can vouch for a re-trial, but he can’t use it here. Kudos to the judge.

True. Dr. Tobin was able to disagree with Dr. Fallow with the oxygen saturation tests already submitted to the court. Lungs are his specialty not Dr. Fallow's.

They are told not to but they could. They really have no choice but to trust that the jury will be honest and that they don't want to anyway after hearing it all day long.

As bad as this may turn out- I'M SO GLAD THIS GUY IS A JUDGE. He TRULY wants there to be a fair trial and NO WAY TAXPAYERS are going to continue to pay for trials and bull. I appreciate him following the law. Prosecution needs to pick up their game..

I have a lot of attorneys and judges in my family and most see it as a game. Some of the judges see themselves as the referee of the game which I don’t think is too egregious but yeah.

I'll reply to the person who made the thread. The other comments must be from folks who don't understand any portion of the law and have tunnel vision that's guided by their feelings. I asked if you can speak in a complete sentence to describe your comment, which you can't or are to busy to respond. Yes the judge rolls his eyes because the path that the prosecution is going down by bringing in something new when they had amble time to do so could result in a mistrial (for the lesser folks in the thread, it means that Chauvin will walk free) if the defense lawyer is allowed to then ask hard questions based on the "new" info, and the jury would then have doubt to GF cause of death. As you heard, IF you paid attention long enough or comprehend well, the judge said that to recall the expert witness, you can not ask certain questions as to what the count of carbon monoxide was inside of his body. That would lead to the cause of death poisoning of the tailpipe and not the knee on his kneck. Hope these other folks never serve on jury, all 12 jurors have to agree for it to be a conviction and these folks don't know what's happening. The defense (who is really good) already tore apart the security guard when he asked if a side choke cuts off both sides of the kneck and the security guard answered "NO," indicating that the knee could not have killed GF, and the defense established from the fire dept lady that if there's a hostile crowd, you have to move to a safer location to render aid to someone, thus establishing why GF didn't get immediate help. Are you folks listening to what is being said at all? The cop is going to walk because you can't see that now the jurors will have doubt as to what caused GF death.

The prosecution in this case is a joke. Chauvin wanted to plea. The feds said he can't. So here we are and Chauvin will be let off.
