I've never thought about creating my own product line since I formulate as a hobby but this video is informative and useful in case I do want to start my own brand. How to stand out is so important especially when the "natural" and organic trend is everywhere especially with indie brand but now seems to be calming down with more consumers being educated on what is real and what is hyped up claims.

Sorry if this was mentioned..I understand the EU documents regarding “free from” and what cannot be stated about our products, but is there something in writing or a legal document for the USA that states we cannot write “free from parabens, phlalates,”, etc? I see store brands with jargon of that nature which is an appeal to customers so I’m not sure why I would not be able to stare that on my packaging. Thank you!

It is misleading to suggest that products are ‘phthalate free’ when they wouldn’t contain phthalates in the first place + its misleading to suggest that parabens, when used within regulatory limits are not safe or suitable to use. In all honesty, regulators are usually tackling bigger issues of non-compliance, BUT MORE IMPORTANTLY It's not a great way to promote your brand if this is the best you have to say about your products. Ie if you are outside of EU/UK (where it is actually written in their law, so avoid these types of activities) - then you may have it as a point of parity, and in the very background of your brand - but really, you should be putting far more emphasis on what is great about your product, than what it doesn’t contain. This is one of the biggest struggles small brands have when they start out - they think these free from claims/clean beauty will appeal to a consumer base but the problem is a. its not true and b. there are so many other small brands stuck in this thinking too. In other words, it does not give your brand a point of difference that gives it a real chance at success! Yes - there are a few conditions around this - e.g. are preservatives not normally needed like a balm? Then you can't say it. If water is present, how is the formula preserved? Makes me wonder if most skincare brands I’ve come across may not actually comply with the cosmetic vs therapeutic/physiological claims! 🤔 How about a skincare product that claims to “preserve skin’s protective barrier”? Would you say that meets the definition of a cosmetic? Also wondering if your Diploma of Personal Care Formulation covers this topic in depth? ( Looking at doing it)

Preserve skins protective barrier as in provides moisture protective agents - yes this would be cosmetic and suitable. Please consider the overall message and words used when determining if a claim is suitable. How about using the word "soothing and calming irritated skin" (instead of saying soothing inflammation or inlfammed skin). The US bill on natural excludes water as a natural ingredient, does this mean using hydrosol instead of just AQUA counts as natural? Otherwise, a O/W emulsion can hardly be called natural, else will be very expensive to be honest... your thoughts Belinda?

You could say soothing and calming for dry skin; to suggest soothing of irritated skin would be to imply an anti-irritant activity, which is beyond the scope of a cosmetic. It depends on what else is in the formula as to whether it meets the requirements of the US Bill on Natural - we can consult with your specific situation to provide you with specific and proper advice, please purchase consulting time here: personalcarescience.com.au/Advice/cosmeticformulation,brandadvice-797/ You could formulate to comply with their needs but it would take individual and specific consulting to achieve this for you.

Yes they are considered aromatic. No you couldn’t say free from perfume, because you have an aromatic substance in there.

Sometimes preservatives are used in anhydrous balms; does this mean that I still can’t put “No preservatives” on the front of the product on a label?

No - because you don't need preservatives in anhydrous balms, and you can't label a product as free from something if it isn't needed in that product type. This is to comply with the new EU regulations on free from labelling. Hope this helps.
