Yep it’s a Level 2 violation so for a first offender that’s a 2nd degree misdemeanor. That’s up to 60 days in jail, a 500$ fine, and 6 month probation.

I’ve had 3 OCSO sheriffs approach me and tell me to leave Noriego Point at dusk while fishing. Technically, the “park” of Noriego is dawn to dusk, so I just packed up and left. They were nice enough, but I was like c‘mon, I’m making less commotion than every drunk hooligan screaming over at AJ’s. Can’t use any of the parks after dark in Destin that I know of except Mattie Kelly. Womp. :(

I grew up in West Palm Beach and I used to fish the water in front of the famous Breakers Hotel in Palm Beach. The security was always very nice they would say "You know you have to stay below the high water mark don't you?" and I'd say "Yes sir I do." Never had a problem.

ive been stopped from launching my kayak twice for offshore trips: once in the outer banks and once in southeast florida. In the outer banks, a fat cop who probably had diabetes told me that i couldnt launch where I was at, nevermind that plenty of kayakers had launched there before and no one ever had issues. In southeast florida, a cop stopped me from pushing off into the surf at 5am cause of Covid and me being by myself on the beach was gonna kill grandma and against "the Science" (this was at the very very beginning of covid, when even florida was stupid about it). What sucks is that I went fishing anyway and had to launch inshore and go through a very dangerous pass.
