What mojang could easily do instead is just require servers to have a “adult_content:true/false” setting for servers and warn players when they join. And boom, if some parent gets annoyed their child is playing with guns, mojang/Microsoft can easily say “hey, we gave a warning, and the server is set to true for adult content, so you can’t get mad at us.”

For example, I could tell a smoker and someone who stands against smoking to "not do anything bad" and the smoker is gonna smoke because from their perspective it isn't bad whereas the other person clearly aren't going to smoke a cigarette because, from their perspective, it's bad. Mojang was never considered the good guys more people are just becoming aware of how draconian they can selectively be about their Eula, things like this have popped up since the days Notch ran the company, infact he sold minecraft because of the backlash of one such Eula enforcement, history has shown time and time again that Mojang is like this, they are normally super lax about their Eula but suddenly out of nowhere they crack down hard alienating large portions of their community and then go back to being lax while they rebuild good will.

There's a Minecraft splash text that reads, "Also try Terraria!" Terraria has 37 different guns (20 of which are hardmode exclusive) in the vanilla game. the potential discrepancy you pointed out at the end between the people writing and enforcing the eula is one of the main problems i had with the chat reporting from the very start, because what would wind up happening is either people getting false banned by a faulty algorithm (because making a perfect system is impossible for a moderation task), or the sheer amount of people that would need to be hired to look over the reports would almost certainly have some personal bias one way or another and make decisions that may not entirely comply with the already-sketchy-and-overreaching guidelines much like what is shown here

If you miss it, help support the development of an alternative Yggdrasil authentication API. We have the means to not be censored by Mojang or Microsoft by forking away from their control ecosystem. This is at least true for legacy java clients with the potential of freeing more current versions of the game through modding. Mojang has royally screwed over alpha customers by imposing all these rules that are not contractually permitted under the terms of sale. Banning players for breaking "community guidelines" for example is not a thing that exists in my contract. Giving a third party the ability to report my account resulting in the potential of an automated ban is also not permitted. Banning blockchain technology? Mojang is not entitled to enforce that. Banning pay to win? Same. Bad language? Again, same. We don't have to like these things or play on servers that have them, but Mojang does not have the authority to impose censorship and conformity and has continued to operate in breach of their contracts with early adopters by ignoring their rights as customers.

@@peppermintpig974 Spot-on accurate. This is the equivalent of Netflix trying to dictate the required amount of lighting and speaker setup you have in order to watch their content. People simply saying "it's in the EULA" like this it is gospel. One can write whatever they want into an EULA, it doesn't automatically mean that is legally enforceable. Plenty of much more robust contracts and legal documents have been thrown out by courts and deemed nullified due to things just as this, there is an entire field of law practice devoted to it.
@peppermintpig974
@peppermintpig974 Жыл бұрын
@@ForeverZer0 It is as you say. It's like Netflix dictating speakers and ambient conditions prior to watching a show through their service. They keep adding new restrictions without any regard for the agreement we entered into. The EULA isn't gospel per se as it can be conditioned by state or national law. However typically the terms you agree to at the time of purchase have a more solid foundation, one way or the other. When I purchased the game I was promised access to all versions of the game as well as add-ons. Mojang later on declared that it would not include versions of the game developed for other platforms. While I can be persuaded to purchase additional copies of the game to support such development, the four corners of the contract do not allow them to deny access and to weasel out of the terms because they are the ones that drafted the agreement and the other party (myself) is lawfully entitled to interpretation in the ambiguity of the agreement. And ultimately it was never my intention to take advantage of Mojang. Sadly they have taken advantage of me and we're in a situation where self-help seems like the only way we can attract their attention to the issue. This has led to another infringement: Microsoft and Mojang are holding back content I am entitled to for free behind a paywall. They claim you are required to purchase minecoins, then you can purchase add-ons with said coins. No avenue has been provided for alpha customers to get that content. Another policy that Mojang proffered at the time of purchase was that as long as they existed as a company that Mojang would provide authentication/server support for the game. This has been infringed through the forced migration.

My worry is that this is going to affect the modding scene, and not just the gun mods. Yes, they could go after Crayfish's, and Timeless and Classics, but when do we stop? Will they go after something like Ice and Fire? Mods that are based off of real IPs made by fans? Things like, (in my experience) New Tardis Mod, and Dalek Mod? And what about tech mods, I mean, some of the stuff that is kinda referenced in mods like Mekanism, or Create is not "safe" for children. When does Mojang finally realize that they, #1, cannot moderate everything, and #2, if they want the game to thrive need to allow freedom of expression and/or creativity within the game. I am most disturbed by the "kid-only content" part. My server has a deep lore that is not just the typical and boring "good guys X bad guys" with a good ending, sunshine and rainbows. It's more like a Game of Thrones story. With history spanning over 1300 years, conflicts, murders, intrigues and more... There is moral dilemma, arguments, shady decisions and even if you have a "good guy", he still might be a murderer. And now I should be scared that based on this, I might be forced to close my server. Just because it's not kid-friendly, because it was never ment to be. There is literally a story in the lore about a mage that forced a baby into a girl's womb by magic. A story with a brutal massacre where a few assassins ambushed a group of soldiers, they literally cut each other into pieces and only one, that betrayed all, was left. All this is not literally present on the server, but it is mentioned and you can find it in the history or talk about it with characters and NPCs. It might seem sick to some people, but it's art and history. Nothing was always nice in our own past... So fuq you, Mojang...

4:03 I'd argue that selling unbans is a good idea on paper, but a bad idea in practice. On paper, like you said - if you cheat, you get banned, then you can pay to get another chance. In practice, though, this gives a monetary incentive to server owners to ban players, then just direct them to the store. Kids that don't really understand the value of money are more likely to take mom's credit card and punch in the funny numbers to get back on their favorite Minecraft server with all their friends. Plus, it means that cheaters with deep pockets can just pay again and again to get unbanned. Server owners can claim they're doing something about cheaters, showing bans, but that doesn't mean anything when the cheaters can just give the server owner some money and be back on the server to cheat some more. As for the practice of Mojang banning Minecraft servers, honestly I think it was a bad idea that should never have been implemented, and should be disabled. It's the same problem with chat reporting and global bans, really, just from the perspective of players. Just like server owners should have the ultimate say in (and ultimate responsibility for) who is and isn't allowed to play on their server, players should have the ultimate say in (and ultimate responsibility for) what servers they connect to. It'd be one thing if this was being done on Realms servers, since those are owned and operated by Mojang and just rented out to players - it makes sense that Mojang should be able to decide who and what is and isn't acceptable. Community servers, though, aren't affiliated with Mojang outside of running their game - usually heavily modified at that. Even Valve (through VAC) only bans cheaters, and they allow server owners to opt-out of that banlist with the understanding that they'll be allowing cheaters onto their server. Yes, there are servers who will try and exploit kids for money since they don't know any better - but at the end of the day, it's not Mojang's responsibility to stop kids from being stupid. That's on the parents. The biggest problem with it though, as you showed in the video, is the complete lack of consistent, defined rules on what is and isn't acceptable, which all but requires Mojang moderators to make on-the-fly decisions on what is and isn't allowed on a case-by-case basis, with no care for precedent. Assuming they're not going to completely stop blocking servers (which they should), at minimum they need to lay out *exactly* what is and isn't acceptable commercial usage of a Minecraft server. Letting their outsourced moderation decide on a case-by-case basis isn't fair to anyone, and giving preferential treatment to the biggest servers (like Hypixel) is morally bankrupt, if not outright criminal in some jurisdictions. Thankfully, the issue of blocked servers is far less severe than the issue of global bans, since bypassing blocked servers just requires a Fabric mod (at least for now). Global bans are another issue entirely - Mojang has weaponized their authentication servers (which is how you're banned even on pre-1.19 versions). When you're banned, Mojang is essentially revoking your receipt to show you paid for Minecraft.

Moderation is a very imperfect art. Mistakes will always be made, and as long as a platform is willing to own up to mistakes I can forgive a lot. But MS has been so incompetent and inconsistent, and with the whole chat ban thing even on single player and private servers, that it’s clear they have a long way to go if they want regain community trust. I’m even fine with them changing to not allowing “real” guns, but they need to offer a clear alternative that FPS servers can go down before they invest in making changes.

@@sekinnnnn1121 No it's neither. It clearly breaks the conditions for charging for access to a server, i.e. everyone must be charged the same for access. A ban list is maintained by a server, and people can be banned for arbitrary reasons. Therefore paying for an unban is actually a form of paying for access, which is not allowed if the same barrier is not there for everyone. And don't come with an argument like "yeah but everyone has to pay to get unbanned". That's the problem. Getting banned can be arbitrary, and it would allow the admins to blackmail players into getting unbanned - and Mojang would likely be held liable for allowing it. If you wanna run a real-world business in Minecraft, you have to respect the real-world rules. The opportunity to make money off a private server is a *very* unique privilege, not some right.

The only reliable time/way Mojang can check for "bad" servers is during the authentication process when you're joining a server, but this only works when you're playing with an account logged into the Mojang server, so just by playing offline/warez you should bypass this entire process because the server doesn't care if you own the account or not. Lack of authentication in offline mode is why plugin like AuthMe exist.

Hate to break it to you, but practically every EULA for everything is exactly like Mojang's. In theory, the vagueness gives them wiggle room to quickly deal with things not explicitly stated but very much in breach of the spirit of the rules. Especially important if people find a way around the EULA that breaks laws. These days, it's used to arbitrarily ban whoever does something that annoys insufferable & inconsistent self-appointed moral arbiters.

I think the main intention of Microsoft is to kill off the Java version by pointing out one or the other reasons while not explicitly terminating java version , until we all be subject to their Minecoin sick Bedrock, because why would we buy marketplace maps or skin , when we can get them for free in Java. I don’t like where this is going.
@peppermintpig974
@peppermintpig974 Жыл бұрын
After much study on this subject, I believe this is their plan. They want to get more mod developers working on bedrock plugins, but they still have problems encouraging users to use bedrock because of the bugs. Once they iron that out java will be killed off I believe. That way they fence off and gatekeep who can create mods. Banning firearm mods was a foreshadowing of their goals via policy. I will be contacting the FTC over their blatant fraud, so watch for my future comments on the subject since I need help promoting the issue and getting other customers, particularly early adopters, to file legit reports on their violations.

Honestly, I think that someone powerful at Microsoft is hiring a team of server "finders" that need to find and block a number of Minecraft servers per week/month that supposedly "violate" Minecraft's EULA (probably the same person that forced chat reporting to be added lol). That would explain why some servers get blocked and some don't.

4:00 I agree that conceptually paying for unbans makes sense, but... The only server I've EVER been banned from intentionally bans over the smallest possible things and sold stupidly expensive unbans. I was banned by a moderator for "rude behaviour" when I was talking to them normally, and they didn't even have a moderator tag! I thought they were just a regular player. Permanently banned because I "had the wrong tone". $50 to be unbanned. I never played that server again, but I'm sure they got rewarded for each ban they issued.

7:40 Lootboxes that comply still being gambling isn't quite true and mostly depends on local definitions of the law. In many places the definition of gambling requires a potential reward with value in the real world (so either money or can be sold for money), the presence of gambling mechanics without the chance to win more monetary value then the initial play costs is not gambling.

The trouble is that server owners, even as a group, couldn't afford to out-lawyer Microsoft into getting a clear determination on these things. So even if Microsoft/Mojang doesn't have a leg to stand on, well, they'll just ban you and there's no way you can afford to take them to court.
@peppermintpig974

IMO, the solution is two prong: Constant social media protest, and filing legitimate FTC reports against both Microsoft and Mojang. I'm almost done drafting a letter but I am waiting on feedback before I send it. And if all else fails, the non litigation route is based on developing alternate authentication solutions so that wrongfully disabled access or deleted accounts from customers in good standing can resume enjoyment of the game and break free from Microsoft's obsession over controlling it all (valid for all early adopters without a revision clause to create these tools), and get to pushing back when frivolous lawsuits arise.

To be fair, the list of complaints you received is a perfectly valid one when you have a commercial business. The fact that so many companies do not follow these guidelines, and that the minecraft team seems to be so selectively enforcing them, are the real issues. Honestly, this seems like random people on the Minecraft team woke up one day and decided to go on a ban spree without contacting anyone else.
