Not surprisingly, Dave says nothing to hold her accountable for anything; hate the double standards he has for men/women. He would never advise bankruptcy to a man, probably tell him to get a fourth job.

Child support should only be paid when a parent is actually providing most of the support. Why is a parent paying child support when he/she has the kid 50% of the time.

Not the child support issue at all. It's the continuous taking the non-custodial parent back to court to keep try to raise the support. Two totally different issues.

Her first mistake was taking on 2nd & 3rd jobs, that's when the courts up your Child Support payments. I commend her for trying to pay-off debts, but her case is proof sometimes it is more beneficial to declare Bankruptcy over taking on additional jobs to pay down debts.

The breakup of family structure is bad enough but the courts just make it impossible for people to proceed. I had a coworker who had to pay child support to his ex who had primary custody. He had to pay 25% of his gross salary to them and then all payroll deductions and taxes were taken form his 75%. How is that fair at all?

Its not a one size fits all. Is the ex working? Did you have a good lawyer? Was the judge having a bad day? Did his income increase over the years? Does he receive quarterly raises, side income? How many kids? So many factors. Justice is never “fair”

You didn't say how much your co-worker made. Most states have a minimum that must be paid on the 1st child, then a smaller amount for each additional child. For example: if he made $1K/month and the state's minimum for 1st child is $250/month, then that would work out to 25% of his gross monthly income.

This is usually how it is working for the fathers. It's interesting seeing the genders reversed. Usually when a father who owes child support to a mother who does not work and keeps taking him to court files for bankruptcy, the world calls him a dead beat dad.

Indeed it is interesting. Don't know why Dave seem so shocked about her paying child support and owing $25k. That's common with the guys I know and more than $25k. The guy seem to be using the same weaponized child support tactic women have been using against men since the 90s.

People always get lawyers in situations like this because they know have done wrong by not paying the child support that they were ordered to pay they do stupid things like go spend thousands on a lawyer to fight child support that they’re still going to owe on top of paying for a lawyer.

In Florida it's easy to get 50 / 50 custody for men.

That's not how it works. With 50/50, child support is usually computed on contributions by both parents. Each parent is assigned a percentage. It appears the mom has more to pay because she is a higher earner. It has nothing to do with her being a bad mother.

The attorney should know that there’s a limit to how much of her paycheck can be garnished and if child support is already being garnished, what more does he think he’s gonna get? Doesn’t sound like he’s a very good attorney or very bright! I once had an attorney bill me for more hours in one day than most people are awake and he told me he woke up in the middle of the night thinking about my case. I’m not paying for your insomnia!

80% of the time courts side with a women or wife and she knows she will likely get away with initiating a divorce for no good reason. If this guy cheated or was beating her I would feel for her.

I know this video has probably posted after the fact but I would suggest that you file the bankruptcy before you go to court tomorrow, because I guarantee he already has the paperwork drawn up to act on it and he will serve you notice that same day and possibly take anything you have in the bank.

One lawyer in town can make a good living. Two lawyers, and dang if they both don't get rich. I believe it was Mark Twain that said that. In my twisted mind: Lawyer A calls up Lawyer B and tells him "Hey man, let's keep this going. I think we can still get some more fees out of them."

These type of child support cases are so sad to me. If the custody is split 50/50 then no one should be paying child support. Why should she pay child support for a child she is already supporting 50% of the time. Why should he not have to support his own child? He only has her 50% of the time and then he's getting money for that time. It's such a messed up system.

Just so I understand, you think if a man was making $100,000 before the divorce and the wife was not working and then they get divorced that the wife should not receive any money from my husband because they have 50/50 custody? Another words regardless of who makes more, each parent just pays for the care while they have that child? Because this is not how it happens in court.

"bankruptcy is a horrible process to go through" I love you Dave, but when I was facing over 80k in medical bills and consumer debt, the stress of all these debts, garnishments and law suits was far worse to bare than the bankruptcy process. I literally met with an attorney to review my case, paid the $1200 fee to file, Had my court date, and was clear of everything within 3 months. Best thing I ever did. 3 Years later my credit is already back to a 718. I bought a house 6 months ago, $0 debt other than the mortgage, 12k in an emergency fun, fully investing in my retirement. I've never felt so free. I cant image going back 3 years ago and still having the stress and anxiety of trying to work through the debts and law suits. Best thing I ever did and Ive never looked back or have any regrets.

Feel bad for this woman. There are exceptions but women always want equal rights and responsibilities until it comes to child support and custody. I have joint custody with both my sons and i still have to pay child support. Mother works some dead end job and gets gov assistance. Fully capable of working but chooses not to because why would she when everything gets handed to her. The system is completely broken.

It was better to be honest from the beginning!!!! She should have told the lawyer from the start my situation is X. People I lived with were not able to pay for s**t and they were going to try to get access but refused to leave when they did not have to money. Imagine if the law had to pay every time everyone ran up bills they could not pay knowing they did not have it to begin with.

just because you file bankruptcy, doesn't mean you can't still pay your debts. and a lot of banks you bankrupt will still send you another credit card. also, take a page from your ex husband's playbook and go find a guy to take care of you while you become a full time student. her husband sounds pretty pathetic.
