I don’t think she planned on dying. Plus. Gifting the mortgage is better than selling it while you are sick. This buys time for her daughter to sell it and get an adequate price

If you didn’t sign the loan, you don’t owe it. The creditor can force the sale of the property securing the loan and you get whatever is left over after the sale. If you’re foolish enough to sign onto the mortgage, it’s your own failure.

superiorconnections - Well, you might not want to sell if someone gifted you a mortgage, if you can afford the house. Depends on the mortgage. This what she is discussing is ridiculous. This is why people need sufficient lift insurance.

jdstep97 - Or a policy rider/provision in the mortgage arrangement that pays off the balance owed in the event of the debtor’s death...of course, a term life insurance policy would probably work better for less money.

I can understand Dave's alarmist reaction but they have $252k of equity on the house, if they can avoid the tax issues and sell the house at a good price and buy a more affordable home or rent a home they'll manage even without her father going back to work.

@@jdstep97 If only we could get our cells, organs, and bones to think that way lol. Maybe socially, financially 60 is the new 40 but biologically; 60 is 60 years old. Can’t expect someone who is 60 to work like they are 20... going that route you might as well get palliative care ready for dad. Unless they do a low impact, low hazard job then sure.

Dealing with her non working dad who's grieving his wife and being a single mom all at the same time. It's a bit much. What if she wants 2 sell As Is. The stress of it all.

Why would you live in California with a $40k salary? With kids that's barely above poverty level, while in multiple other states it's middle class income.

It’s actually below the poverty level in the Bay Area. In this lady’s neighboring city of San fransisco a family of 4 is low considered low income if them make under 115k.

Dave is almost at the point of political correctness , and he has changed with the times and his co host reflect that , especially the millenials . I just hope that he does not eventually over compensate , like so many other professing CHRISTIANS have .

She wasn't gifted a house OR a mortgage. She was gifted a $260K equity on a house her mother took out a loan for. There is a HUGE, HUGE difference. The way I understand it, NOTHING but that equity actually belongs to them. What they really need is a good lawyer who can advise and help navigate them correctly.

My son's supervisor inherited a house in a very exclusive neighborhood. He has no mortgage but can't afford to repair the huge house!

Then he's going to run the house's value into the ground. He should sell it and buy a house he can afford to repair. If he does it right, he can put $30-50k in a repair/renovation account and be better off. He probably also has a hefty HOA payment.

The a ton of life stuff you've not considered. She can't just up sticks when you have shared custody - you have to have the agreement of the ex, plus sounds like the father isn't coping with the death of the mother. You need to walk in somebody's shoes for while before you "solve" other people's problems.

The problem is people thinking living in California is "affordable" or "normal", a down payment on some flats in Cali can pay for an entire house in other states or even cities. They should move now, and get Pops a job.

People need to stop being sentimental about houses, houses are shelter, the people, and your memories with them are what is important. This is how people become hoarders, when they are so sentimental about STUFF that has any attachment to a person. Even people who are still living, standing next to them, saying "mom, choose me over the garbage" "but this garbage is our memories...." No, it isn't, memories are memories. Stuff is stuff. You have to be able to let it go or it owns you. She's struggling to keep something that the obvious solution for was to sell, nobody in this situation was thinking with their brains, they were thinking with their sentimental emotions.

Agree! My sister-in-law was left a huge home and five acres debt free. But she hadn’t worked for over 30 years- fear of people! Now she’s barely existing and refuses to sell the property so she can have a better life. Fear of the unknown keeps her there. So sad her parents didn’t teach her to fly!

Gosh, give him a break. He just finished taking care of a sick wife. He was also grieving. He will indeed go back to work. It is not as if he was being lazy. It is hard to take care of the sick and dying. I have been there. It is very stressful and then there is the funeral later on. Let him breathe a little first before judging him.

Of course it was a gift. If someone offered you a current year Mercedes Benz with 10,000 miles on it, but they still owed $2,000 on it, would you accept it? Of course you would. Because the car is worth WAY more than what is owed on it. Even if you didn't have the $2,000 cash, you'd accept it and sell it and keep the difference. Same thing with a house. There's a boatload of equity in that house. If she sells it, she can buy a very nice house. She might have to move to a part of the country with a lower cost of living, but considering her current income, that shouldn't hurt too badly.

If I had $1,000,000,000 I would not want a house that is large enough to be "valued" at $500,000. I am quite content with my 1100 sq ft paid for home on an acre, in the country, valued at $100-$110K. Few folks realize that we humans own nothing. Things own us! Life simplification requires us to remember this and keep things in balance!

1redrubberball It’s Santa Cruz. It probably is a 1,100 sqft house. Do you have any idea what the cost of real estate is in that area? It’s more than the average person can afford and she’s not making very much money for the area she lives in, either.

There is nothing abnormal or unsustainable about 50% of your income going to a house payment in the Bay Area. That's just our reality, we have higher incomes, but much higher housing prices, the extra income goes to cover our housing costs. I don't know what the caller does for a living, but no matter what it is she very likely can't make the same amount of money doing it somewhere more affordable. Depending on what her property taxes are (and whether they really are going to get socked with a $30-$40K gift tax), she may well be better off making $43K in Santa Cruz than, say $33K in Fresno or Phoenix. No way will she be able to make it renting in that area.

@@brianascani746 that's the sad part I live in Upstate New York most of the upper middle-class neighborhoods that have doctors lawyers teachers police officers the houses are six bedroom three and a half bath half acre lots two car garage for $250,000 most of the houses that are in decent neighborhoods 425 of 250000 I will never understand why people insist I'm living in a s*** state where a 900 square-foot house is half a million dollars

The sad part about this situation is that she cannot afford to live in California, even after given a house(after a death) with over a hundred fifty thousand in equity. I feel bad for her and her family... I will pray for them.

That’s the bottom of the market for everything within a 80-100 mile radius of Santa Cruz. She would be lucky to get a 2 bedroom rental in the ghetto of San Jose for less than $2100 a month. So that’s either her and 2 kids in 1 bd and the dad in the other, or somebody sleeping in the living room. The dad HAS to work. He could do Uber part-time and bring home an additional $2k/month. They can’t afford to live there, but they can’t afford to move, either.

Santa Cruz home should double in price soon. eBay. Google. Facebook. KZbin. Apple. All 30 miles away. My friend bought a house near there for $240,000. It’s now worth just under $2,000,000.

Michael she should stop making all payments and just pray to Jesus. That should help prevent the bank from foreclosing on the house. Also make sure to include in the prayer for the bank to forgive the loan since they can’t afford it. Then they should be all set.

I hope she follows his advice, gets the amended return filed, then gets "her" house on the market and gets it sold. If she sells it for a good price, she and her father will have an opportunity to start over. I'd actually recommend that they move somewhere where it's way cheaper to live. If they end up with $300,000 from the house sale, they could buy another house for cash in some parts of the country and have $200,000 left over. Then with her job, her dad's survivor benefits, and (soon) his social security, they could make it work, without him having to rejoin the work force.

Keep the house, participation out for ABNB rental for extra income. Santa Cruz rental is super hot, rent the whole house out, keep the backyard for your RV to live for free for life. Don’t ever sell cause you’ll be homeless if you sell.

A 1200 sqft house is NOT tiny. My first rental house was a 900 sqft 3 bedroom one bath house. Shortly after I moved into it, one of my friends bought a house (for cash) nearby. It was a 700 sqft one-bedroom. He picked it up at a lien sale for 10,000 and put another 10k or so into it to fix it up.

Do not sell it! Dave's suggestion is wrong this time. You long-term payment for renting will be much higher. You dad should start to work to make more, and things will be better if you own the house because your income will be higher and higher. Mortgage payment with starts with close to 50% of income in California is normal, which is not understandable to non-Californians.

Refinance it for a full 30 years your payment would only be like maybe 900, you could even keep 20 % equity you won’t have PMI. You can keep it until your dad passes away. Wouldn’t this be a viable option? Her dad could even sell it to her if they are having a issue with the bank.

This episode made me think - I am all on my own - bought a house late in life and ALL I think about is money. Not in a destructive way, but I am making sure I am ok without anyone to lean on. If I was gifted a house, oh wow. I would NEVER leave my house (that I absolutely LOVE) to anyone who didn't love it too. TOO much work. I will most likely donate it to St. Jude's before I die.

How about turning it into a rental property? Why is this not even discussed? They have good equity the rent should cover the mortgage surely. Let it out and then rent somewhere cheaper. Selling a house is an expensive thing to do when here real estate agents charge 4 percent. Also selling a property when you have no money to do the most basic things to present it for sale is not such a great idea.

Good question but what I’m thinking is that say they rented it out, the income they have from it will probably be equal to the rent the end up paying elsewhere so it’s kind of pointless. What they could do it rent it out and move out of state (if she’s able to considering the children involved)

Renting may not work if the lending institution comes calling for the remaining mortgage balance payoff immediately since loan approval wasn't on her name and she may not qualify for refinance.

Rent only the house but keep the backyard for her Trailer home to live free for life. Santa Cruz rental market is super hot, many UC Students there are struggling to find home every year. Selling is a bad idea!

Fear and the trauma from losing her mother is the only issue at the moment. Once her and the father get a clear head, they should sell the home. The $200k profit will put them in a better position. They could put down on another home or rent an apartment. This will buy them some time to recover. The dad can eventually get a job and she could probably find a better job. Fear is their obstacle. Not a lack of money

In Canada primary residence is TAX FREE. Gifted or not. If she were here and sold the house any equity would be free of taxes.

I like listening to Dave Ramsey, but I believe he may have misstated potential issues with the gift tax, and income tax if they sell the house. The daughter will get a 250k exclusion and even though the house value was not “stepped up”, the gain from the parents basis value could be under the $250k. He’s correct that they did it incorrectly, but they probably did it thinking they were sheltering the house in case the mother went on Medicaid (which, if under five years, would not have helped). Also, some mortgages allow transfers to relatives. But the dad definitely needs to get a full time job.
