May be I don't know much about the Constitution, but we certainly cannot question Faizan Mustafa's knowledge on the Constitution. Not even for a single moment Mustafa seems to be speaking emotionally, he is giving answers logically and on the basis of facts. In fact there are instances, such as the question on development, where he elegantly says that he is not the right person to answer rather than just giving his personal opinion.

It doesn't matter now... The President has the ultimate power and He has signed on the removal of rest of the clauses of 370. The lawyers will just make money on the hearings and it will be a waste of time for the Court. The unfinished business of Sardar Patel has been not achieved yet- taking back POK, so by looking at the current Home Minister Amit Shah is not at all going to show any mercy to achieve that.

1.) Keshavanand judgement also mentions that Constitution is not in a state of being, but becoming. Judges are not there to sit and refer what pioneers had envisioned, and rule as per that. Basic Structure wasn't envisioned by the Constituent Assembly. Expanding the meaning of life to mean Due process was not envisioned by the Constituent assembly. 2.) 370 is called by him as an _outcome_ of agreement between two sovereign state. The signing of instrument of accession was not contingent on the promise of 370. 370 was a _political_ zidd being granted later.

In all these 3 places , a referendum was held & people's concurrence was sought before completely acceding them to the Indian union, which was never done in J&k. Bcoz of that many of the people in the valley feels as a separate entity, and thinks that India is trying to impose on them, this mentality which was further boosted by Pakistan led to emergence of separatism & militancy

Great interview. Some counters:- 1. Others states specially northeast doesn't have Pakistan as their neighbour. 2. Although there are special provisions for northeast we don't feel any special ourselves. we call ourselves proud Indians. 3. NSCN having peace talk with GoI was constantly giving example of j&k having flag and constitution to GoI. Scrapping of article 370 is hard slap on these insurgents. GoI has achieved two targets with one arrow. 4. Nagas are proud Indians. We just want our history, our cultural uniqueness to be identified by GoI. 5. I had kashmiri friend. In very first talk of ours he cleared that he wants freedom. He used to mention india as another country. 6. There is future danger of insurgents coming from Afghanistan to India via j&k. Government needed to show USA that they just can't leave Afghanistan as it is. 7. Constitutional expert will see through legalities, journalist will see through emotions or things around, forces will see security, bureaucracy will see through administration etc. But it's government who has to consider all the factors while taking and decisions. This decisions may have some drawbacks or plus points. Afterall everyone can't be kept happy. So let's support our government in this decision. And also criticise it if this decision backfires.

I'd want to counter all your points.. But specifically point no. 5. Just go live in Kashmir for a year. Go live under AFSPA, PSA. I'm from Ladakh. I have stayed in Kashmir for extended periods of time... The reason most kashmiris or some kashmiris demand freedom is because of the tyrannical way in which the Indian government has been operating in Kashmir. Even now. Its almost a month now and they're under curfew. Do you think with these kinda atrocities they'll be proud Indians?? Lol

Countering point 1. Some other states do have Pakistan as neighbor.. Also, if that's the reason then that's a failure of the government to seal the Border-LOC. Also bilateral talks could be a solution to that, don't u think? Rather than playing with the sentiments of the Kashmiris. What if China is blamed for some reason and all of a sudden Indian Govt does to Nagas what it's doing to Kashmiris? Will it be acceptable. All other points are a joke. You are just biased.

An important point that was missed (I presume on purpose) was that the real question is not whether J&K had a better constitution or not but of implementation on ground using state machinery. Some families for decades had made it their personal fiefdom and it was in their best interest to maintain tension as the status quo, with their removal, Delhi now has the power to implement on ground and hopefully bring some much needed change, stability and development to our fellow Indians in Kashmir.

This "we" and "them" used during the entire course of interview is one reason why Article 370 should have been abrogated. If all laws applying to "us" i.e. India are similar to the laws applying to "them" i.e. Kashmir, then i guess it makes more sense to abrogate 370 and be seen as one and governed under one Constitution.
