So I don't know if that is true. Think about it. The 17 y/o went to the party to participate in the act of prostitution, already an illegal act. She is old enough to know the men she would be selling her services to would be over the age of 18-24 and chose not to volunteer her age. Furthermore, other adult activities were occurring, like drinking, which to most reasonable people would mean that anyone present had to be over the age of 21. I should say Gaetz should have asked the girl's age; I'm simply pointing out the difficulties in prosecuting such a case.

So here are the facts of the case: A) the 17-year-old went to this party to take part in prostitution, an illegal act. Whether she knew the age of her clients is debatable, but she likely was aware most would be violating the law by taking part in her services. B)Gaetz failed to ask the age of a sexual partner in a situation where drugs and alcohol were being served, and thus, it would be reasonable to assume the partner was at least 21. C) Florida state law requires adults to ask the age of possible minor sexual partners, which Gaetz did not comply with or was not aware of. My guess is the prosecution doesn't feel like this is a slam dunk; I mean, it only takes one male juror thinking, "Jeez, I go to bars and hit on girls all the time. That could be me,". or one female juror thinking about her son trying to meet someone and being entrapped by a girl who is just a little too young. Then boom this entire case is meaningless.
