It's not a metaphor. The "eye of the needle" was a chokepoint built into ancient architecture to defend against raiders. Large wooden beams were settled across entry pathways into cities so that those riding on the backs of beasts (like camels) couldn't charge in. Here I hope you will be able to see this. Here I found a shorts "content creator" who goes by the name MeowsMysteries. Their "content" is just a bunch of cat tiktoks/shorts compiled together without any credit, no on-screen handles, nothing. They don't show their face and only say a few nothing burgers in between videos, most of the time talking over the original uploaders. Also, in their description, I found it funny that it said (for each of their shorts) "All content has been highly edited and transformed for your satisfaction♥️." Which is so funny considering all they do is compile and add a few words with their voice in between, no captions even. I am in law school and just finished a class on copyright law. I’m not a licensed attorney, so please do not take anything else I say as legal advice, but what we learned in class was that the standard for Fair Use has now moved somewhat away from the idea of “transformativeness.” That had largely been an aesthetic test; how similar does it look? What SCOTUS (and by extension the lower courts) now want to see is if the alleged infringer is basically doing the same thing as the original work. The best way to describe this change is from the Supreme Court case that changed the standard: Andy Warhol Foundation v. Goldsmith. Goldsmith had a photo of Prince and Warhol was licensed to make one derivative work based on it. He made a bunch more, wrongfully, in secret. Vanity Fair used one of the wrongfully made copies as the cover art when Prince died. The Foundation argued Fair Use and SCOTUS said we don’t care if Warhol’s image looks a bit different; we care that it was licensed to do the same thing as the original: be a picture of Prince meant for commercial licensing. Now, this is just factor one of a four part test, but it’s often the most important factor. I’ll let you all argue about whether reaction videos are of sufficiently different use to pass this new test, but I’ll also point to factor four of the test: market harm. The courts do not like a potential infringer harming the financial viability of an original work. Hopefully this was useful and not horribly boring.

Two of my favorite channels to watch for reactions are MorePatterz and Stanz. Patterz will react to videos from his friends, with their permission, and he watches their ads and hypes them up and shows off their merch. He's a pokemon guy so a lot revolves around pokemon so whenever they choose one or have guessing games or anything he will participate like hes in the video and then explain answers and I think he does a good job actually contributing. Same with Stanz, where he will either learn about a topic with you or have actual good commentary to give, and will cut the videos so that either you don't see the most exciting part and then say "if you want to see how this video ends check out their video" or something like that or will cut out a lot of lesser commentary. Good balance from both where they actually contribute and work as a way to get you invested to go watch the original content as well!
