Patent can be worked around and is intended to be worked around, you can't make a game mechanic with the exact same function and with the exact same method, but you can make a game mechanic with the same result using a different method

Let's be real, the only reason why The Pokemon Company is suing palworld, is because Palworld is the most successful pokemon-like games that are not Pokemon. They wouldn't be doing this to other games like Nexamon, or Tem-Tem because no one cares about those games

Palworld really did skirt very close to pokemon ideas to legit sell it as pokemon with guns, but this is dumb as hell. They know pokemon has been out of ideas for years, so it's like they had to get super petty with their suit just to make it remotely relevant. Boycott or pirate imo, we've said they're scum for a while but still shower em in money. At least it's a Tokyo based dev so maybe more from Japan will follow suit and shun the big N too

I just want them to make a different game. The Pokemon Colleseum game was amazing because it eschewed the traditional gym badge hunt and gave you an actual story and mission to follow. More games like that less copy and paste games

It seems theyre only patenting the idea of catching monsters in a ball. Shin Megami Tensei, Dragon Quest, Digimon, Yokai Watch all have monster catching but the methods are different. Ita stupid but really Palworld just need to rework how you capture monsters and the game should be fine in Nintendo's eyes

Getting a patent doesn't mean it won't be rejected when challenged. It is a game mechanic and usually in the US patents on game mechanics are easily defeated because they are not protected.

Applications are published 18 months after the filing date. And Nintendo's US applications aren't patented, they're still in the examination phase.

Someone had a decent explanation about why it took so long. Japan has strict laws against "slap lawsuits" (lawsuits that are hastily thrown together and likely to be thrown out of court and are only done to disrupt lives/businesses and cost the defendant money in legal fees) In order for Nintendo to not be accused of filing a slap lawsuit, they'd have to build their case first, and that can take time, especially when lawyers who bill by the hour are involved.

Companies have been patenting game mechanics for years, there's nothing wrong with it. Worlds Inc. is probably the most prominent example in this field, the most notorious patent trolls of the mmorpg industry. Competitors have to find workarounds to avoid infringement. And the application in question isn't even granted in US yet. It's only vaild in Japan.

No, the priority date is December 2021, and the patent is not granted in US yet. They can only enforce it in Japan.

This is patenting ideas, not inventions. Its like claiming that every car, house, phone or whatever manufacturer is breaking patent laws because someone had the idea before them. Nintendo and Warner Brothers should only be able to patent the exact implementation and code, not the idea.

Friendly and necessary reminder that Nintendo does not develop the Pokémon games. They own a 33% stake in the IP along with Creature Inc. and Game Freak(the actual developers). Together they make The Pokémon Company. This should be basic industry knowledge.

Patents are an outdated, archaic, legal mess. There are a couple of law firms in Texas that make all there money on false patent claims. One patent-troll took out a patent for using Wi-Fi not Wi-Fi itself but using it and would sue random. people for it.

What makes this even scummier, is the patent was registered in Japan in 2023, which means it was filed with the intention to weaponize it against PocketPair.

IP law is completely messed up. Remember that copyright used to last for up to 14-28 years and then Disney came along and lobbied the government to change it to 95 years. Patents can last to up to 20 years justified by the fact that new drugs take a long time to develop, but the fact that this applies to software as well is utter nonsense.

According to the publication date of the patent, and the fact it takes around 18 months to get the patent published. Nintendo filed for the patent shortly after the first Palword trailer. Patent rights start after a patent is filed for, so this may mean nothing if Nintendo waited this long to Patent those things. Also, patents are generally only good for 20 years, so again another way around this since the first Pokemon games were released in 1998.

Nintendo Corporate is horrendous. The old Japanese mem in suits. Since the NES days they've been a problem. I remember hearing about Nintendo of America struggling to work with Nintendo of Japan or whatever it's called (someone will correct me). The suits wouldn't budge on decisions made for the US market. It's why Nintendo of America became a thing. The suits in Japan had 0 clue how to market for the US. Literally, you hear Nintendo people say that. Like actual ex employees. Especially during the SEGA days omg. Nintendo needs to get those creative minds in charge. F the suits.

By this logic Nintendo ripped off Ghostbusters since pokeballs operate on the same principle as a ghost trap. Weaken the enemy, throw the trap, once caught the trapped being is kept in a pocket dimension until released.

So Nintendo is suing PocketPair for the patent of the car? Because that sounds like what Ford tried to do with the car. At some point, Ford wanted to charge everyone who made any kind of car royalties. Then the courts in the US came in and said "knock it off". I'm interested to see how the courts in Japan handle this, and what the global response will be.

Game mechanic patents should be illegal. Same goes for software patents in general. Also, patents in general should be heavily restricted or abandoned as they are essentially legalized monopolies.

I think having like a 10 year patent is fine. An inventor or creator should be rewarded for finding a gap in the marketplace that people want/need/ or enjoy.

I don't think it's necessarily fair to say it mirrors real world hunting too closely to be a patent, because it isn't just the capturing aspect, it's the entire formula of throwing a device, capturing a monster, then pocketing that monster and training it and later using it to fight other monsters. It's not like all they did was mirror throwing a net onto some wild animal to cook and eat later. That said, it's a ridiculous claim on Nintendo's part. They're just looking to beat out any and all competition by draining their wallets with legal fees. They don't really expect to win this.

I wanted to make an indie game like Crazy Taxi but it turns out they patented having an arrow showing direction and distance above your vehicle. Sega doesn't even make consoles any more and they're still squatting that idea preventing cool new taxi games.

As a programmer the number one rule of programming is to never ever under any circumstances look at patent documents and to run far away if someone starts even so much as hinting they're about to talk about them, which is a shame because we could learn a lot by studying the kinds of gameplay elements companies think are worth patenting, but essentially i was thinking about having leveling companion pets in the game i'm working on but because i've listened to this video i run the risk of getting mega sued if they decide to uphold that patent infringement, if i'd stumbled across a patented feature and they lawyered up i'd be able to get away with simply removing the feature, but knowing about it would basically make it like intent, sucks man lmao

Pokemon literally stole the concept of using creatures to fight for you, by releasing them from capsules, from a show called Ultraseven that came out in 1968. Even the creator of Pokemon admitted as such.

What's strange is that Palworld literally ripped models straight from Pokémon, THEN modified them. Nintendo could sue that aspect so easily, but instead decided to sue the WAY more unique gameplay mechanics.

I grew up on Pokemon in the late 90s. I never knew this about Dragon Quest! I mean I never played it but I've been aware of it for 2 decades now. I just assumed it was more like Dragon Ball because it was the same creator or artist or whatever. RIP Akira Toriyama btw. So sad. I love DB and DBZ.

Also, the Nemesis System is patented because of the tech involved with the feature. They don't care about people doing something similar as long as they don't use the exact same formula and tech involved. For instance, Assassin's Creed Odyssey did something very similar to the Nemesis System in its Mercenaries System. The key difference though is that they were randomly generated but were by no means as sophisticated as the Mordor games. They didn't have a journey of growth, and were essentially just tough enemies to fight that would hunt you down if you gained too much notoriety.

I was about to say that Pokemon is "Pocket Monsters" so maybe the unique thing is carrying monsters in your pocket but... that just sounds like acknowledging videogame hammerspace. And then I thought maybe you could say "well these aren't items, they are living beings" but there have been RPGs (even before Pokemon) where all your party members just phase into the main character while you're walking around the map. So... yeah... I can't think of a specific unique thing for Pokemon. It's just unique as a brand, not a game.

And I think it's kinda bad faith to say that Pokemon isn't unique. Again, totally agree that them trying to patent a single aspect that can easily be replicated by anyone is stupid. But at some point you have to look at things at their whole, rather than their individual parts, and Palworld is pretty much the only IP that has tried to be a Pokemon-like. I'm sure there might be other failed attempts, abandoned or shutdown projects, but I don't recall anything in the last 20 years that comes close to this. If we only look at individual parts, then yeah, it's easy to say that NOTHING is unique by the simple fact that everything has a framerate, everything has a resolution, everything has an art style, or everything has code to bring the game to life. Pokemon IS unique. Palworld being the first game to be like it and succeed in decades proves this.

The people who hate Palworld will take any bad press about it, the sick part is that they are ignoring the fact that a major game company has patented game mechanics, or specifically game code for creature collections. That can't become the norm because it'll straight up stifle inspiration and game creation since you'll never know what land mine you might step on that'll get you sued by a multi billion dollar company.

And yes, Pokemon 100% copied Dragon Quest. Lesser known fact, they also took inspiration from Shin Megami Tensei, which came out years before Pokemon did, and they both involve aspects that are basically the same: kids using monsters or demons to fight for them.

A user on Reddit pulled up a patent that Nintendo filed for Pokemon Arceus in 2021. Basically it describes the mechanics and process behind realizing the use of a capsule to capture a creature in 3D space. If that is infact the patent that Nintendo is suing over, then essentially they are suing over implementing a pokeball system in a 3D world.

listen…I am in the side of Palworld. and i am NOT a fan of Pokemon game. im just trying to see this in a PoV of a legal system. for anyone saying “you cant patent throwing” or “you cant patent monster combat” you are true but thats not the issue. its ALL of these bellow AT THE SAME TIME: - throws ball at the monster - monster become a light and goes inside the ball - the ball shakes representing monster’s struggle inside of the ball - if failed the ball broke and not reusable, and the monster came back out - if success, the monster become friend - theres a power level for the balls and you use better balls for more powerfull monster - to increase of your catching chance you damage the monster to lower health - you CANNOT deploy more than one monster friend when fighting, when you want to deploy another monster, the previously deployed monster went back to their ball its ALL of those at the same time. its not “look nintendo stupid they think they can patent fighting animals” or “patenting trap” or “patenting ball”. THIS IS NOT MY OPINION i just try to play devil’s advocate. i play palworld and i loved it and from day 1, my highest concern for them is Nintendo suing them. Dragon quest, digimon, bakugan, etc dont have ALL of above at the same time

I remembered similar cases where a gacha game called Shironeko Project got sued by Nintendo for 5 patent infringements and people speculate it has to do something with Dragalia Lost. Years later Shironeko is still alive and doing fine. What is funny they will have a new project that will be released on the Switch. So Nintendo suing doesn't always mean its end of the line for games that got sued.

Ghostbusters predates Pokemon, you throw a trap to catch the ghost, (or monster) a light blinks a few times, and it will be captured or break free based on how strong it is and how much damage it's taken. Sounds kind of familiar doesn't it. Nintendo didn't even come up with this mechanic.
