The problem with that is how much is a street actually worth? I assume that the other houses on the street have an established right of access, so he can't charge them for using it and he can't build on it. So it has no income value and no development value. In effect it has has only liability, in that it needs to be maintained it. To be honest, if it was mine I'd be glad to see the city take it over.

Even if he does own the road and the property, the road is just an easement he'll have to pay property tax on AND maintain himself. He's way better off letting the city buy the road from him. They're doing him a favor.

If the city officials are ignoring him and are planning to use eminent domain to reclaim the land that he lawfully owns, how else is he to make his case and be fairly heard? By drawing media attention to this street. Sometimes it takes a silly ridiculous thing to get the world’s attention. Politicians act swiftly to avoid negative press. By media and press, I also include going viral on social media. It’s not about being a bad neighbor. As someone else said, he can give the money back. But 8’ll bet you a street full of angry neighbors will also get the government’s attention. He can even explain to his neighbors that he is desperate and taking any measure to be heard. BTW, if you own property then the government can take it from you at any time through eminent domain and they will definitely try to give you less money than it is worth. You should always be afraid of losing your own. You never truly own land.

If that was never a declared public road, he didn't buy a street. He bought a private driveway. If the city wants it they can compulsorily acquire (eminent domain) it but they have to pay him fair market value.

There are very few situations where imminent domain should be applicable these days. It was one thing when we were expanding the national, but now everything is allotted, either owned by the people or privately owned. We don’t need to expand anymore so imminent domain should only be used in the most extreme and necessary situations, after significant review and analysis of all options other than imminent domain seizure.

They're already lowering their offer to him, the only counsel that's going to help him now will be a criminal defense lawyer when they have him thrown in jail for the sole crime of resisting arrest. That's how this process goes with the gov't. They make you one offer, and that's the highest offer you get. They'll walk it down from there until eventually they force you to accept 1/100th of the actual value and then toss you in lockup for balking. Strongarm tactics are all they know.

Seems like he bought it "fair and square" and should be able to do what he wants with it. If they want it back, he should be able to ask whatever price he wants for it and if they can't or don't want to pay his asking price, they can't have it. Possession is 9/10 of the law... As a 20 hear residential mortgage underwriter. I literally had a month straight of renters using thier ID buyout (the owner also got +full value for income loss) there is now way a competent lawyer would not win value + income loss + lawyer fees minimum I've reviewed 1000s of appraisals nationwide and dealt in imminent domain cases from single lots to lots that included whole apartment buildings.

So, this guy didn't understand what he bought (a lot with a private road with existing easements), didn't maintain it, didn't get taxed on the portion which includes the road and now is upset because the government is using eminent domain to claim the street? Why is this even news? The street has no real worth. By the nature of the other homes on this street, there's already no fewer than 5 implied easements on it (hell, there are probably express easements on it too for utilities). It has no ability to be developed or generate any income from it. He's liable for both maintenance and insurance on it. What's his problem here? They're really doing him a favor. If a neighbor drives down the street, hits a patch of ice or a pothole and wrecks, he's likely to be found liable.

I hate imminent domain and think it should be done away with. It may have had its purpose at one time, but now it's being weaponized by local governments and big corporations because of greed. ❤I pray that he gets fair market value, but like he said when he doesn’t have a good lawyer you won’t get much. My sister owned over 26 acres of land she was going into foreclosure her neighbor owned 25 acres they gave him 1.5 million fir his property, than said we can wait for her to lose her property to buy it off the court steps. Another company or friend came to her and told her I will get you out of foreclosure, then did she sold her property to them and still got ripped off because they only gave her $200,000 so even some of the people around you will rip you off. I've seen this situation multiple times, and it's almost always an owner that has purchased the lot out of tax foreclosure, generally sale for pennies on the dollar. The owner is likely not someone being "taken advantage of", but a real estate speculator that is trying to take advantage of a scenario that he was well aware of when he bought it.

I think the best solution would be to assess the property owner for the street repair and tax value of the land, and let the other property owners file suite when the easement is blocked. that way his property rights won't be infringed upon and he can undertake the proper maintenance at his own expense, and it also will add to his tax bill for all of the additional land under his ownership. the simple answer is to give him what he asks for and then wait for the tax sale if he defaults on his obligations.
