The plaintiff’s car was towed by the defendant. She claims the defendant illegally towed her car and then sold it, so she’s suing for the cost of a car and unreturned property. These tow truck companies definitely take advantage of apartment complexes. My daughter just moved from a community where this new tow truck company started coming out twice a week and would place pink stickers on vehicle's they considered disabled and orange stickers if you parked under a carport assigned to their unit but the fee hadn't been paid which was a new requirement added however the office staff didn't send out the notifications or stickers due to being short staffed due to COVID. One day as I sat in the lot waiting for my grandkids to come out I saw them place a sticker on her neighbor's SUV assuming it was disabled because she always parked in the same spot which was in front of her window and worked nights & I had just seen her bringing groceries in the day before and told my daughter to tell her what they did. Then my daughter had a tire changed on a Tuesday afternoon and 2 days later my grandkids saw man taking pictures of the inside and outside of the car & asked him what he was doing and he ignored them & put a pink sticker on her car threatening to tow and when I called the company someone said the report said it was jacked up for 3 days which wasn't true because she drove it to work Wed, Thursday and Friday and there was no jack when they took their photos that Tuesday after it had been fixed but they claimed their photo showed it still jacked up, smh so I told her she better update that information or I would be calling our local news hotline who had just did a story on them for illegal towing from downtown & local business claiming they reported the vehicles in their lots but they hadn't. We had no more problems with them but I'm sure they're still doing it to those residents.

These jerks will sit and wait for that "Gotcha" moment and I'm pretty sure they paid extra close attention to Brittney's company. Several years ago I got booted. The police ended up getting involved. I finally paid the fine so I could get to work...but the paperwork ended up in the right hands at my job and suddenly I got a refund after the threat of a class action lawsuit, lol. I certainly hope Brittney pursues this all the way through.

If it took her 3 hours to go out there and put the pass in mom's window, then I can understand why she was towed. But if dude towed her in 3 minutes then that means he was right there waiting and mom should have stayed out at car until her daughter came out with pass.

Hindsight is always 20/20. There are plenty of situations where I realized that I could've handled things better...AFTER the fact. But yeah, she definitely didn't do all she could on her end. I was able to resolve mine fairly easily because I work for people who eat, breathe and sleep for litigation, lol. The average person would have to take a few more steps.

I'm speaking from experience as someone who has gotten towed a couple of times because of this very reason (when visiting my mom's apartment complex) and I think JM paid attention to the part when she never mentioned that as a defense on getting out of paying the towing fees. If her story truly happened, then the rental office was slipping and she should have gotten a release from them to take to the tow guy. Or they could have called him and told him that it was on them. Also, if she was truly going out there to put the tag in mom's window, it doesn't take that long to do so I wasn't really understanding her when she said that unless the tow truck was already outside waiting, and in that case, mom should have stayed with the car until she came out with a pass. As I said, I've been in this exact situation twice and one time it was justified where I simply forgot to go back outside and put the tag in the window. The other time I went to my mom's leasing office and they called the tow guy and he actually brought my car back himself. The fact that she doesn't get her leasing office involved in this leads me to believe that she was the one dragging her feet getting those passes. But I do hate tow truck drivers with a passion. So don't confuse my comment with defending them, lol. Just being technical because even with the time he towed me legitimately, he really didn't have to and he was stalking the lot.

He cuts BW off, twists their words, is contemptuous and resentful of them without provoking, and sometimes throws their evidence down refusing to actually read it. It's disgusting really, so I don't know why on earth they continue to go to to him. He's too wishy washy. Hopefully she'll get a good fair unbiased judge who sees what this is and finally gives her justice. Her neighbors and everyone harassed too should've came as witnesses, wrote statements, and screw this show - they should've gone to a REAL courtroom that's not concerned with entertaining and ratings who would've taken the time to look through all the evidence. That's how she lost the case because she never once mentioned going to the leasing office to get them to help. If her story truly happened then this is on the leasing office and they could have called the tow truck guy and got him to release her car. It sounds more likely she was dragging her feet getting these passes from the leasing office than the leasing office not doing what they were supposed to do.

These tow companies do the same to wealthy people too. I was apartment hunting in a very nice area. I parked in the designated are for visitors-the tow guy saw me get out and go into the office-3 minutes later he comes in and asks the front desk if I’m authorized to park there. The receptionist said yes she is he looks at me and snarls out of the building. They are ruthless predators-worse than ambulance chasing attorneys or fake wholistic cancer quacks. Needless to say I chose another building with covered parking and valet.

The defendant eventually lost a class action lawsuit and went out of business. Tow truck reality shows were in back then and they thought this would be good for ratings! Was it the right place to go, no! I was just tired of the law in my town not doing anything about him!

Tow companies are definitely predatory. I remember I was at my boyfriends house and I always backed in to park (he got me a permanent visitors parking pass because I was always there.. The office had my car jotted on his parking permit paperwork and all)… He went out to go warm up the car, so we could go to the store that next morning. He came back inside and was like, “Baby, why you pull in like that? Lol”.. and I was like huh? I backed in like normal. He was like, “Nah… Your car just in the part all crazy..” We went outside and we saw track marks at the front of my car.. Then he immediately got upset because they tow guy was KNOWN for being tow happy. So after watching the cameras from the office we saw he just picked my car (because he don’t get paid if he don’t tow), and just picked it up… Even though I was always there and had the proper pass. Then when he was flashing the light in my car, he seen the pass, hurried up and drop it and sped off like he was mad. They end up firing that towing company and they had to pay for the scratches on my grill.

Tow companies in bad parts of town prey on poor and low income sides of town… they know those people can’t afford fees so they will keep the car and then sell it at auction…... I literally had my car towed 2-3 times because of these same predatory practices and there was no good reason for it. I’ve moved to a better side of town and I’ll tell you, unless you’re parked in someone’s reserved paid spot.. you will NEVER get towed.

I had my car towed with a parking sticker. Tow company said that it had to be in the back window but the apartment complex stated it just had to be visible. Whether on the front window or the back. They ended up giving me my car back, without payment, because there was a visible sticker. The driver just didn't get out of the car to see. Long story short, tow truck companies are the worst.

I will never forget. I was touring this potential apartment complex that i was interested in moving to. As im on the tour with management, this lady approached us with tears in her eye's screaming about how she was just unloading her groceries and when she came back outside her vehicle was towed. He towed her car illegally. & because it took so long to take legal action he reported the car as abandoned. He’s a snake. That crooked grin at the end proved it. She should’ve paid & then sued. Once she proved it was towed illegally that waiver would be invalid & she would be compensated for any missing or damaged items. She would’ve gotten her money back too.

This is exactly how it is where I live. The tow truck shows favoritism to the thugs, and drug dealers who will put that same energy on them but literally came after tow hours and got me back to back 3 times, broke my bumper, and went in my car and ended up leaving some tow equipment, I had to forfeit a car because I couldn’t afford the 200$ and they charged that a day! Smh I had just got it out. Other than that . The mama got a cute little stutter 😅

When she refused to sign the damage waiver and left her car with them, they started charging a storage fee for each day. After 3 months, tow company contacts owner to inform you of the total amount owed in storage fees and to notify you to pay the storage fees and pick up the car or they will sell (auction) the car. The question is whether she was notified Before they auctioned her car. She claims she made a a few payments during the storage period, but that doesn't decrease the balance because the fee is still accumulting each day. . You have to pay the full amount DUE to stop the storage fee and remove car from the property. My ex-husband worked for a tow company.

This happened to my. My boyfriend got pulled over in my car and had went to jail so they towed my car and when I called the tow company to ask how much it was to get my car out the guy was so damn rude and told me I no longer had a car and hung up on me. Later found out by a former police officer that the man is known to tow cars and take them straight away to the auction and sells the car then gives the car owner a hard time to make sure they don't get it back because it's already sold. This was over a year ago. Wish I knew I could have sued him before now.

Interesting that he didn't have to produce one piece of adequate evidence to prove her plates were wrong, tire flat, she had no parking decal, or otherwise any proof that towing her car was legitimate to begin with. If he couldn't prove it was an authorized tow from the start, then the storage fees and auctioning is neither here nor there since none of that is authorized if the tow wasn't authorized, so with him unable to debunk the tag info she produced wth her registration, then he should've ruled againstv him on that since he had no pictures of other tags on it timestamped to show the day it was towed or any verification to debunk her evidence.

WOO WEE!! I know this story all too well. Tow truck tried to take my daughter's car because it was parked in handicapped parking because it didn't have handicapped plates but she has a placard(the hanger for the rearview mirror). Let's just say a 9mm was shown to the tow truck driver. He left.

@@biggchill8176 I came to that conclusion based on everything Judge Mathis asked for the defendant was able to provide. It stopped being her word verse his when he had every legal document he was supposed to have. If she was able to prove she had a tag the judge would've mentioned it and he didn't. Everything she accused him of as the Judge said was done legally. He seems like a a**hole but that doesn't mean he's lying. Also the tow truck driver provided the paperwork from the company saying they didn't have a valid tag for her in their system.

@@SamuelsReview I noticed that as well however I know that you can get a 30-day tag and sometimes once that tag expires you can go and get another 30-day tag If the dealer hasn't sorted out the paperwork in time. I just took notice that the judge never confirmed that she handed him paperwork that verified she had a tag.

As someone who has had issues in my complex, the plaintiff was wrong. We have a parking issue where I live with MULTIPLE cars parked all over the damn place for people who are not registered to be there. Seriously! One unit cannot have 5 spaces. So, as a paying resident, I can't find parking, end up blocked end due to illegal parking, etc. So, I don't feel sorry for her. I wish they would tow more where I live because you've got folks who are entitled doing mess/selfish crap.
