It appears the defense is just now raising an issue as prosecutorial misconduct that was prejudiced to the defendant. IDK if this was in the context of the judge denying the defendant request for certain jury instructions or if it is in response to a Motion for a New trial due to misconduct etc. it’s just not clear from this snippet.
