Peter Falk assumed the character of Columbo during a roast of Frank Sinatra and he was brilliant. Many of the great names of showbiz were there, but he outshone them all - even Don Rickles, and his was a classic roast.

The thing about the ending "Negative Reaction" that comes to mind whenever I watch it. The killer could have just reminded Columbo that he still has the poorly-lit photo. Columbo showed it to him earlier.

Better yet, tell Columbo to compare any crime-scene photos (that had to have been taken by police photographers) to that enlarged pic, and they would shown it to be a reverse of the layout of the room. However, Gallesco was so eager to show Columbo up, he incriminated himself. Columbo counted on that.

Like in Double Exposure when Dr. Kepple is smart enough to ask Columbo for directions to the crime scene of the second murder. Because he says he's just been told of the killing, but not where it took place. So, if he's really not the killer, how would he know the location of the crime scene?

Neither episode shows Columbo tampering with evidence. In the first case, setting up his suspect to see a false address isn't tampering with evidence...any more than an undercover cop saying he is someone else is. When this went to trial, the evidence isn't the fake address. It's what the suspect did with the false information. And the second one, Columbo only says he destroyed the original photo to the suspect in the middle of his sting operation. That doesn't mean he actually did. And again, it's not the blown-up photo that is the evidence at all, it's what the suspect does with it that is.

I'm not a lawyer but I think your argument is convincing. Which is particularly ironic since there were occassions on which Columbo arguably DID tamper with evidence, like bringing it in for his reveal and letting the suspect examine it : )

@@vibovitold The issue is...evidence tampering is a crime. It means Columbo has to have a piece of evidence and either alter, destroy, or conceal it. Holding, handling, or showing it to a suspect isn't tampering. Tampering would mean he more or less frames a suspect. The one thing about the Columbo character is his ethics and professionalism. In my mind, Columbo framing his suspect is so far outside the spirit of the show that I doubt it ever happened. The other thing is, as the audience, we know Columbo's bumbling manner is an act. So just because he says something to a suspect doesn't mean it's true. With those being said, are you aware of any instances of Columbo framing a suspect? I don't think so, but if you have a suggestion I'm all ears.

@@forsdykemontague1017 Entrapment is when the police induce a person into committing a crime when without their push the person would not have done it. So if an undercover cop manipulates you into selling drugs, and then arrests you for selling drugs, that's entrapment. Without the cop in the equation, there is no crime. Here Columbo sets up the suspect in a situation to see if he will identify the camera. In the U.S., the police can use falsehoods during an interrogation or dealing with a suspect, with a few exceptions. The entire 'meeting' here was setting this up, along with a few handy witnesses to see if Galesko entraps himself. Because Columbo acts more or less stupid and incompetent on purpose, Galesko falls for this. He's been rude and insulting to Columbo for the entire episode, so the ending here is pretty satisfying.

@ There is a famous case in Texas where Law Enforcement faked a finger print report after which the perpetrator admitted killing somebody. He was convicted of murder. At appeal the conviction was quashed and the “confession” ruled inadmissible (Wilson v State) due to the deception of the faked report. Don’t you think there are parallels here, whether Tampering or Entrapment?

yeah, from what i understand regarding investigative permissions in the US neither of these count as evidence tampering. with columbo's superior, the false file would only have been an issue had it not been bit on to try to throw blame on the scapegoat. and with the photo negative, same thing - the killer incriminated himself by grabbing the correct camera.

No tampering at all, In “A Friend in Deed,” Columbo made up a fake file folder for Jessup, which wasn’t evidence at all until Halperin relied on it to break into the apartment. In “Negative Reaction,” Columbo used the original to create false evidence, but I assume he didn’t destroy the original (accidentally or not), and lied about that to Galesko.

The same was true of Captain Wyler in Suitable for Framing. Columbo lied to Dale Kingston that he’d been bumped off the case, which set up one of the great moments. Kingston: “But I thought ….” Captain Wyler: “We *know* what you thought, Mr. Kingston.”

The problem is that all of the criminals confess before obtaining legal counsel, often in front of Columbo and other members of law enforcement. A confession carries a significant amount of weight, even without evidence.

What Columbo did is legally equivalent to telling a suspect (after he received Miranda warnings) that his buddy in the next interview room just fingered him as the shooter (when he didn’t). If the suspect responds with a key admission (i.e., that he was one of the robbers, but not the shooter), that statement is admissible.

@@artmallory970 As long as the "fabricated" evidence is not used in a court of law, and only to illicit a confession from the suspect, it wouldn't be evidence tampering.

@@zmortis111 Agreed, as I mentioned in another comment, it showed guilty knowledge. Columbo was essentially throwing 'red herrings', couple with other evidence (motive etc) it would still likely result in a conviction,..

I've got an excellent memory, but I cannot recall how many times I've watched the epsiode with the Commisionar. That's how good it is. I just had an idea. I know many things have been ruined so I would say stay the hell away, but I think there is room for a new episode/full length film of Columbo in the modern era. Yes it is risky, and to be honest I'm not confident (ie: murder on the orient express recent movie was disgustingly bad/lazy) but wouldn't it be great if it was great. It just seems to me like (if done totally right) this could be continued. Ahh well, one can dream at least. Maybe I'll write and direct it myself. I have fire (chilli) in my belly, and an interest in film making/writing/directing, so maybe it will come to pass.

Artistic license. Most literary, stage, and film plots won't stand up to close examination, but they're not intended to do anything but entertain.

When Columbo tampers with evidence that's fine. But when I take the drugs from the evidence locker and they "go missing" that's "unlawful theft of evidence" and "possession of drugs" 🙄

I love Columbo but I think most of his cases would not result in convictions. I have never been a lawyer but being one f these guys' defense attorneys would be easy. That's why I am always puzzled by them confessing. Especially destroying the original picture in negative reaction.

Given the way he is quite meticulous in his reveals, I don't actually believe he did destroy it, but only said he did as a scare tactic. ie. He doesn't need to destroy it, he only needs the killer to believe he did.

@@Thenonymous1 I realize that, but the original would basically give the photographer an alibi, at least a reasonable doubt. Any good lawyer would have destroyed Columbo's case as speculative and or circumstantial.
