The plaintiff was going to purchase a townhouse, and she spent money on an inspection. However, the defendant backed out of the deal, so the plaintiff is suing for the money she already spent. The defendant admits she backed out of the deal, but there was no contract in place, and nothing was signed yet.

It is so expensive to live, I live in so Flori-duh and my kid's came back 3 times until they were on their feet, I cannot imagine throwing them out as teenagers.It makes absolutely no sense to me!!!!

Right, helping her daughter in a hard time. Meanwhile the defendant is kicking out teenagers because they are “technically” of age to find their own place, though we all know damn well very few teens are mentally or monitoring prepared so soon out of school.

The defendant is full of crap. She knew what a binder was. She had everybody waste their time. Spend their money. Just to turnaround and change her mind. I don't believe the defendant, She only came up with a bunch of ridiculous excuses (after) she got sued.

It seems to me the binder binds the parties to the sale; the later sale contract binds them to the details of the sale.

It is fun to watch the gallery 'size up' the litigants as they come into court. Watch as their eyes checking them out from head to toe. Some actually snicker while doing so. Humans are funny!

How is buying a place to live spoiling her child? My friends mom did that so any rental payments or housing issues wouldn’t need to be handled through a stranger, but between the two of them since they trust each other. Doing a large kind gesture for a loved one is spoiling them.

Plaintiff did her job. Defendant was quite honest. I've never heard of this concept of a binder. But I do think it's implied that the deal will go through

Aka a good faith deposit. It signifies that the buyer is serious about their intention to complete the purchase. In return, the owner takes the item off the market. If the buyer backs out of the sale, the owner retains the deposit; if the seller backs out, the deposit is returned. I would award the plaintiff the tests and inspection costs incurred to ensure the house is safely habitable.

Right. For her to say, “I never technically signed a contract” is so disingenuous. You signed something to move forward on a deal. It wasn’t the official sales contract, but that doesn’t mean it’s not valid.

I wonder how much was the condo that the plaintiff was able to pay all cash for it. It's always nice to pay everything in full and has zero debt.

It’s crazy how many of these cases get broken down to, “Just because life happens, that doesn’t mean other people now have to pay for your problems.” So many defendants (and sometimes plaintiffs) don’t seem to understand that they are allowed to make whatever decisions are best for them, but that those decisions might cost them down the line. Other people shouldn’t have to eat their money because you changed your mind about something. Why is it so difficult for people to take responsibility for themselves? Sheesh! 🙄

maybe I'm a really bad father, but I'd never buy my grown kids a house even if I could afford it, even if they were getting a divorce etc....gotta let baby grow up!

⁠@@rockobill7637To each their own but if you can help your kids,why not? That pull yourself up by the bootstraps mentality is toxic and ruins people. Me and my husband own 360 acres and have written in our wills that give of our children 5 acres at 18 and we will put a starter home on it. Upon our demise the rest of the land is divided equally amongst them. They did not ask to be here, I don’t believe we as parents are indebted to our children but they didn’t get a choice to be here and if you can set them up for a good life then do it🤷🏽‍♀️.

When Judge Milian asks for the receipts, she's already leaning in the plaintiff's favor. Not guaranteed, though. There can always be a Perry Mason moment.

before I even watch this to see if if I'm right, my first instinct based only on the intro is that the broker was wrong. The lady had her home listed for sale and a prospective buyer put money into finding out if the home was sound or not with the intention of purchasing the home. The defendant then took away the option of her purchasing the home which means that she put the money in something that did not happen solely due to the actions of the defendant. There may not have been an actual contract in place, but clearly she had expressed interest in a home that was put up and then promptly taken down and she should not have to foot the bill just because the defendant got sellers remorse

From the comments here I am wondering how much attention viewers paid. The defendant was horrid. She, at the very least, had a moral obligation to pay the woman back. The plaintiff would never have taken the action if there was not an agreement and how would someone inspect the home without the defendant knowing? The defendant said that her realtor told her she did not have to pay, which I do not believe, and then she has the brass ones to tell such a convoluted story to get out of her responsibility. The judge was too nice. The defendant was, in essence, not only stealing from the plaintiff but showing no regard for all of the effort she put into the purchase.

I was shocked when he was nice to the defendant at the end of the interview and ended their conversation in a polite manner. He was nice with the plaintiff during the interview but then abruptly turned to the camera at the end like he always does. Ugh.

Despite its name a real estate binder is not legally binding. The binder keeps interest in a transaction and encourages open communication between buyer and seller but it's an informal agreement and is eventually replaced by the formal (and legally binding) agreement of sale.

Milian once again is completely different in cases like this involving caucasian litigants in comparison to others where there are blacks. Here she is all jovial and professional and has a totally different disposition, tone and attitude with us. It makes me angry and disappointed in the system.
