In this case morally maybe not but if he's been doing the work and suppose to get paid and don't then yes he should sue. I don't know much about if he should sue the estate or wife but he should get paid if he didn't. Sometimes u have to separate friendship and business

Also same. My dad was a mechanic for 28 years, owned his own shop for 24 years and had one employee for 6 months out of the year. He would NEVER. Even being the sole provider for a family of 5. Morals and compassion do not exist in this man’s world. Honestly sickening

@@eisbeinGermanyDepends. His recourse is to sue the estate of the deceased since that is who owed you money. Not the man’s widow and son. And it’s $600. I know that $600 is not chump change but he’s suing for it 2 years after this man’s death so obviously he wasn’t facing that much hardship.

That plaintiff is no friend of the deceased, if there was a bill, he could’ve had let it go instead of dragging his family into court. The plaintiffs face dropped when JM said the wife or the son owe u nothing!

As the Plaintiff, I would just let the 600 and some odd dollars go. As the Defendant, I would probably just pay the money. It seems unreasonable to think the Plaintiff is simply making up the debt to get a small amount of money from his dead friend's estate. This is a sticky one, especially because it sounds like the husband/dad was incapacitated with dementia. No wonder the son was so upset, imagine being in his shoes. Two years later and the Plaintiff sues the widow and not the estate. This whole case was sad.

I think the plantif got paid by the defendant's husband. I think he got his money when he visited the defendant's husband in the nurse home. The plantif wanted to take advantage of the defendant. A friend gave me a bill for$12 for getting my husband's shirts out of the cleaner while my husband was dying. We had been family friends and had spent lots of money on their children So people get ugly. I am sure the plantif was going to try and get lots of money from the widow. I could tell lots of stories. How I was taken advice of. Some because I was grieving. And not paying attention. Some because i was naive. Especially repairmen take advantage Now I research all repors costs etc

The son really has no idea about his father and there is no proof he was senile at the time the work was to be done. I think they have to pay the man. If mom is here she could of made decisions if her husband was so incapacitated. I think the son is greedy and is controlling his mom. I can see already the Judge is doing the guilt thing so she is not going to pay this man his money. She needs to learn not to bring her feelings into the court. She admitted she was in his situation and agreed by nodding with the son as he talked. She is goin to make a decision not based on facts, but her own situation. Hope she proves me wrong. His bills do not all pass to her, some do. Cars are generally considered marital assets and are owned by both spouses, even if the car was purchased after the marriage or if the loan is in one spouse's name. So if he had an unpaid debt and she now has the car he can put a mechanics lean on the car or her home even, beccause at the time of the service it was jointly owned (Marital Asset). A lawyer would of ate the Judge for supper, then sued for misrepresentation.

After making so much money from the guy after he died why not let the debt die with him. It’s only $700 dollars it’s not going to make or break the guy especially if he can’t prove the debt. I’m a mechanic and I would’ve never sued the widow or a loyal client.

I know of a widow shortly after her husband died suddenly, expectedly had men come to her door demanding gambling money owed by her husband....she paid. I would not have. Anyone could look at obituaries and come to the deceased partner to demand money. Why she didn't call 911 is beyond me.😮😮😢

Milian never asked who was the executor of the fathers estate???? Son or Wife? Estate accounting papers that settled all bills???????? Did the son and wife file estate accounting papers and pay taxes and Bills???? a competent judge would ask these questions??? Why the histerics from Milian????? He has to sue the ESTATE(the son or Wife are the executors(people to sue)it's business not friendship. Why even mention "friendship" when you want to collect fpr a debt??? Milyan did NOT ASK OR WANT TO SEE BILLS FOR THE PARTS FROM THE FORD DEALER?????? If 2 mechanics completed the work, who paid the second mechanic???????? Wow ---- lived this until Mom passed a little over a year ago. Miss her dearly but not her paranoia, anger at not being able to do much herself anymore, and total uncooperativeness as I'm trying to be respectful of her wishes and doing so many tasks for her and never getting thanks, yet reaped much criticism. Dad has dementia but he's very easy going and luckily accepted the 24/7 care we organized for him.

Do you notice that the judge is not saying anything to the defendant's son because of the defendant's son is staring up and down the plaintiff, and remember she doesn't like that thing going on and her courtroom, I have no respect for judge milian anymore I do not watch her new show, and I don't think she's going to least that long anyways

She usually doesn't allow litigants to speak so aggressively during cases, either, and yet is allowing the defendant's son to do so. And all she did when the son admitted to throwing a tantrum and going no contact because he felt that his daddy liked the handyman more was say, "Shame on you!" instead of seeing what it really was: the son having a 'gotcha' moment because he blew his relationship with his father and now blames the plaintiff.

It’s sad that the son could not recognize his dad’s dementia and desperate need to make his own decision about the tree. Losing independence is so hard! Choosing to be estranged from his dad over that was a poor decision. I know, we went thru the same thing but we knew my father in law was gradually losing his ability to make rational decisions so we put up with it the best we could. And tried to love him for the father he had been before dementia.

I’m sure the plaintiff had to pay the guy who did the work for him as well as the dealership and he was just trying to at least break even. The son seems greedy and only came back to take over their estate. Which is why the dad told the son to stay outta his business in the first place. I don’t believe the son had any good intentions.

I moved out my apartment in December of 2023. My landlord kept $5k in funds and didn’t return it. Life was happening and it’s not that easy to come up with the cash to go to court. Finally in may of 2024 I filed the paperwork to go to court. I find out he passed away less than 30 days after we got into it and I moved out. Idc that he passed away or that I waited over a year, I want my money.

As a motorcycle rider, they can help you move quicker through a bad situation on the road. And for me, I am more focused on driving (riding) and better on 2 wheels than 4, so therefore I DO feel safer on a bike, most of the time. (please note, taking a motorcycle class is the best thing to feel safe on the road)

This isn’t misplaced anger. It’s righteous anger. How would you feel if your parent had dementia, a handyman came out of no where 2 years after their death saying they owed him money, and had the nerve to sue your elderly surviving parent? This is 100% greed. Any kind hearted empathetic human being would let this go and not drag an elderly woman to court over this. SMH!

@@sunflowermama4297 I have lived through this with Alzheimer’s. It’s hell. It also creates the stages of grief to the nth degree all while one’s parent is alive. The frustration and hurt is unparalleled therefore it’s so much easier to lash out at any injustice real or imagined. I believed the plaintiff, even though I wouldn’t do it personally. But I did watch the son’s anger explode in a way that was not equal to the experience.

10:20 I h4t3 when people says a 80 or 90 something chose “independence”, people at this age unfortunately doesn’t have this luxury anymore, their decisions affects others. Im not saying put them on a nursing home or something like that, we need to take care of them, i know a family that a 101 year old grandmother unbalanced the whole family because she’s stubborn. When we are kids we have no choice why do we have to give them that?

I feel sorry for what the Plaintiff went through with his accident, but other than that, he should've known better than to sue and should've let it go. Just a quick point... Oak is far more valuable for woodworking than it is as firewood, even 15 years ago. Today it's just Insane on price! The Defendant's son is an A$$hole and I'm sure his only motivation is greed. He's already fighting over his parent's estate while mom stands there next to him, alive and well and hopefully for another 10 to 20 years.

So all that drama just to say at the end you can't sue the spouse you have to sue the estate.
