I find it baffling that some people think that Toei, a Japanese company that distributes to other countries, is not bound to another country's legal system when in fact they have been known to censor their works in other countries to follow that country's laws. Not only that but Toei has businesses outside of Japan. Like they have an animation studio here in the Philippines.

@@harimauindia5775 That does go into a realm of obscure copyright legality tbf, especially country to country. Referencing other media is quite common in the west even without expressed permission (think D&D in gravity falls, star wars in phineas and ferb [not the movie that later came out] and any multitude of things). Usually using a name is permitted once you're not in the same industry, roughly, in Jojo's case its referencing/ripping the direct name from music (music being different to tv/cinema) but obviously that has caveats. Good example is where No man's sky was nearly forced to change their name because of the british tv service sky (ie tv forcing name changes on gaming) so its not cut and dry. So basically it depends on who's asking and in what context really, though it definitely could go either way if legal action was threatened.

tbh it's more of a crisis temporarily averted. i'm glad his life wasn't utterly destroyed by an unfair content ID takedown, but nothing was *gained* and the same thing could happen in the future, but maybe even worse next time. although it is worth celebrating this show of force of the community, that we won't lay down and accept these injustices and are determined to come together and fight when it happens. i won't take that away from anyone.

The sheer braindead energy of arguing Toei shouldn’t be held to American law astounds me. It’s the other way around, Mark, an American creator operating in America, should not be held to Japanese law. Toei operates in America, and plenty of other countries, and should be, and in a lot of ways ARE, beholden to the laws of those countries. If Toei wants to block the videos in Japan and other countries without fair use law, fine, but they had no right to torch Mark’s channel. EDIT: Mark is Irish. The point, however, is no less valid.

Mark is not am American creator, with your logic, should Toei and Mark not be under EU copyright law, which is much weaker fair use case then in Us, and he would likely lose a fair use court in EU.

@@lifeofryu7584 uhh, EU law is very strict on corporations and nonsense law suits, Toei would have been thrown out for lack of base evidence to prosecute a case, also they would have to pay the legal fees for both parties as well in Irish court. Toei's case was so bad that they straight up didn't try to prosecute, they avoided the legal path as much as possible. They failed to provide a since legal case against TNM at any point in this process, even using Japanese law which doesn't apply to TNM's videos outside of Japan anyway (which is why they are blocked in Japan now but nowhere else)

There definitely were a few other smaller content creators that got attacked/copyright claimed and their channel removed before Mark’s. I’m so glad he persevered and had the support and luck to be protected as he is. Right now, there’s a smaller channel in dire need of a lot of help and support named Suede who does Pokemon reviews. ShoPro the Japanese corp that owns Pokémon is suing him internationally for court. Please spread the word.

There’s one huge reason KZbin will never come down on company’s. They buy ads. If KZbin punished Toei for abuse they risk losing a potential ad buy and that’s where a lot (if not the majority) of their money comes from. But even a small victory is good. Maybe one day things will turn around.

youtubes problem is at any moment the whole site could get nuked because of copywrite law issues. now its such a big site that maybe the government would have enough higher employees that use it to care about change but as it stands youtube can basically get fucked whenever. the solution is well we allow takedowns so we are not ourselfs doing the infringing. this is a big thing with the twitch react meta right now because twitches solution is to pretend they dont know so how could they have done anything. but soon they will have to do more and more until its similar to youtube. its not just losing ads which is important its also about the billions in copywrite lawsuits that youtube sits in the grayest of areas for. no one not youtube nor the companies want to find out whose side will win because no result is good in the end so we play this little dance of take downs

My whole issue with this comes back to the ability to block content in certain countries. I can understand, even if I don't agree with, why KZbin doesn't want to give that ability to everyone. That’s so sad content creators have to constantly worry about being targeted and having their livelihoods taken away at the snap of a finger. KZbin needs to get it’s shit together. Their number 1 priority should be the creators who are making them money. Without content creators youtube would be nothing. I have things improve. Maybe if enough content creators come together you can organize some sort of union? I’ll continue to support this channel as well as your other two channels for as long as your around my friend.

Very happy for Mark and content creators alike. This is a massive win against an archaic dinosaur that clearly doesn't see the huge profitability in creators like him, Liam, and TeamFourStar, which is basically free viral marketing for their most famous shows. On the one hand, I get trying to protect their product from pirates, but to try and completely annihilate a channel like Mark's and TFS, even with voice actors like Sean Schemmel coming to Toei's defense, doesn't really make much sense to me, when they maintained massive popularity during DB's down years thanks to creators like them and so many others spreading the word, diving deep into the story and on and on. Simply baffling. This is a massive win for all content creators. Like Toei was cut in half with its own attack. Can't think of where I've seen that, though. (I totally stole that joke from Plague of Gripes).

04:00 - I am really against letting big companies off the hook in this manner, we should always assume that they know exactly what they are doing, and that every move they make is intentional (including the inconsistency that mark mentions in regards to which videos got taken down). Toei is a huge company (at least when compared to TNM), they have legal teams and business teams and they have all the resources to consider their moves before making them. We could have made that argument at the very beginning, but at this point, they have been in contact with YT about this for a while without backing down. We can say their reasoning is flawed and that it's not a very good move (even business wise), but to say they did not know what unleashing that many copyrights claims on a youtuber might do to that youtuber is, in my opinion, letting them off the hook too easily. I get that it's their IP, and I get that in terms of Japanese copyright laws they are in the right, but FUCK TOEI. I will not watch their productions anymore. I'll just read the manga, but as long as I can help it I will not give them any money.

Would it not be possible to say, get together with a few other One Piece youtubers and set up your own MCN together, without any of the BS that usually goes along with it. Vet channels who want to join to see if they are actually fair use, don't take money from members (unless its required, then do bare minimum) and just have it as a way to get video location feature to people who "need" it.

Listening to the whole TotallyNotMark situation, makes me wonder what happened to TeamFourStar years ago, they had implied many times that the whole copyright system and Toei had a big hand in essentially ending their old content production (granted their new stuff is pretty good too) but I have to wonder how much this hurts everyone from the IP holders to the content producers like you that are free advertising for them. Since the Mark situation happened for example, your production has significantly changed in the use of still images and video. I've loved this channel by the way, in getting to explore some of the nonsense that goes into video production beyond just the video. But, why not create your own MCN to solve some of these issues?

This happened to our channel a little over 2 years ago. Our channel was outright banned and we still have not recovered from it. We went from averaging 1-3k sub growth a month and 100k views a week. To 100+ sub growth a month if we're lucky and 15k views in a month again if we're lucky.

Restrict the ability to geo block to partners. That first defense fails. But it fails in general because anyone can report. And the Content ID system exists to find this stuff.

I think you may be underestimating the power of the "noise". This is a situation that had never openly happened before. Though, some smaller channels may have had this happen to them in the past, i highly doubt they went to trouble of making a big enough fuss of it than Mark. If it's any consolation (and to me it is. even just for hopeful sake) it's brought an awareness to these issues not to the general audience of youtube, but to both KZbin and probably Toei themselves. The fact that FRED went in to rectify the situation meant a correction of an underlying problem of youtube, and through that probably learned some valuable lessons about copywrite take downs, and i definitely think Tonei is probably feeling the ill effects of their decisions. If anything, Liam, I'd say that this whole situation has probably put you and other youtubers alike in a safer position than you were before. If it didn't happen to Mark, it would have happened to one of you. As someone that had been following Marks Channel around this time (along with yourself and other content creators, particularly in the realm of one piece) Im pretty happy with the outcome

there is the legal precedent as they call it.Its used in cases that refer to a court decision that is considered as AUTHORITY for deciding subsequent cases involving identical or similar facts, or similar legal issues. Precedent is incorporated into the doctrine of stare decisis and requires courts to apply the law in the same manner to cases with the same facts.So maybe next time you can make a case since KZbin resolved kinda the matter and therefore is the authority.You must be stressed and worried i get that Liam so hang in there and if at any case something happens we are here for you mate❤🙂

Yes, but sadly this not legal in the eyes of the law. This is only regarding KZbins own rules. They can choose to forgo a previous choice because they feel like it. It would be nice if there was some actual legal repercussions, but nobody wants to be the person who sets actual, factual Legal Precedent and screw things up for the worse.

You should get in contact with your youtube manager and request that your videos are region-blocked in Japan. Then Toei has no way to come after GrandLineReview or anything like that as the content isn't being broadcast in that country.

I honestly hope that the situation has not made Toei angry. Toei was previously like a wasp, just being an ass to everyone, and one day they stung Totally not mark. Mark tried to defend himself, but ended up aggravating the wasp and now, it’s possible that the whole Wasp Nest is after him and any other creators that make similar content. Do you see the nightmare scenario yet?

Being a youtuber always seemed like a hard and thankless job to me. Even the one benifit of playing games for a living sucks when you think about it. Games are work now. You have to think about performance and play games people want you to play, no thanks. And thats not even mentioning the psychological problems im sure comes with it too.

The problem is nothing in the legal framework of KZbin’s safe harbor status allows them to restrict a company from making claims, even if they have a history of bad behavior. The laws would have to change. As is usually the case, the way the laws are written favors the copyright holder over the individual.
