I'm so happy for you, Mark! I'm glad that KZbin was able to support in a way that offers hope to creators outside of Japan. It's unfortunate that the makers of Dragon Ball do not see the opportunities on offer for them, to have a strong creator realtionship; but at least we can still share our passion for the works we grew up with. One thing this has been made clear to us all: KZbin is sick and tired of the years of pestering. Believe me, for who I work with, it's a LONG time.

Also, Mark got lucky. Toei misplayed their hand and cited Japanese law without reason. Had Toei not made that misstep Mark’s situation would be far worse. It’s not KZbin that did anything; it’s Toei. Though at least KZbin was working with Mark so it is clear it was more legal issues than their usual schtick.

@Kent Son the only problem with your statement(s) is that Toei is only within their rights to work under Japanese jurisdiction. As long as the content is unavailable in Japan, Mark is safe. His videos are well within fair use in like what, 98% of the world? And as long as they're within those rules and guidelines, Toei cannot legally take them down. They can stop him from monetizing his content if it contains their IP, that's fine, but they cannot take it down, and they cannot block it in places where it falls under fair use.

Happy that the videos got reinstated and this is resolved for the time being. Japanese copyright law is extremely archaic so giving creators the tools to block their content in territories like it would be great, but seems like that won't happen any time soon. At least someone at KZbin was able to get in touch with you and was able to block that content in Japan for you. I think you'll be fine from here on since you're perfectly within your rights in western law. Wishing you, your family, and your team nothing but the best!

I think KZbin should add a creator tool that allows content creators to block their videos in certain countries, so things like this will happen less often. As of now, I think creators need some kind of KZbin agent to do that for them, if their channel is big enough and they can afford one, if I'm understanding how this works correctly. If someone is more knowledgeable about how blocking vids in other countries works, please let me know.

That’s a great idea. KZbin already does it automatically, when a certain video is blocked only in a number of countries during the stage of upload and check (it literally shows you the percentage of viewers who won’t be able to see your video and the list of those countries). But I wonder if it’s final and whether it serves as a guarantee of the approval of the upload for the rest of the world. It seems like the content owners still might take further action even after that. KZbin needs to take responsibility for allowing the upload after all the final checks, and not simply come back at you with a strike or account removal.

I have less of an issue with Japan's backwards laws and more with the shameful and pathetic aggression their companies take in trying to needlessly apply it to their own fans. The logic is usually in attempting to scare people off infringement, but this has only made them look incompetent. It also only serves to *create* new imperatives for pirates - especially when the targets they choose to take on have had nothing but good will towards them and serve as free advertisement. Toei is already renowned as a litigious and ethically bankrupt entity by most content creators that must exist within their sphere of influence; this only serves to make it even more apparent to an even wider audience that they deserve no respect in any dealings with them. I'm sure KZbin is also sick of having to listen to their inept, stumbling whining as well. Imagine the amount of money Toei has wasted in these endeavors to harass and attack random people online, simply because they continue to allow their corporate dinosaurs to disrupt the good will and viral marketing that otherwise stems from a profitable, no-cost sector of the internet for them. Absolutely pathetic. Even more laughable than that: horrible business acumen. I'm happy you've seen success through this horrible time, Mark. Please retain a dialogue with your contact and strengthen yourself for the future. More than simply winning, you've overcome a villain... as it cut itself in two with its own attack.

WOW. This sets a big, HUGE precedent, and might even help other western content creators. And makes a lot of sense. If countries can block and censor content that they deem as illegal in their country, while they can not do anything else to that same content on other countries with different laws... Why shouldn't this also apply here? Specially considering that, as you said, your content was never meant to be consumed by japanese audience (mostly do the language barrier I'ld assume). It's like forbidding the whole world to eat pork because a muslim country made pork illegal. I really hope this gets solved in such a way, since it seems that japanese corporates will not budge (TOEI and Nintendo are the biggest ones I think) on collaborating with content creators that repopularize or straight up popularize their products in the west, completely out of love for it (and most importantly at least these corporates, without them having to spend a single cent)

@@zeening actually they do sell them, just likely a japanese only soundtrack release, which happens alot for japanese games,don't matter if its not sold to you it doesn't give you the right to upload and monotize off it , so that is stealing, not fair use like mark's situation which is about fair use. you want the music, import the soundtracks from japan like I do and everyone else does when it doesn't have a western release.

Great to hear... I'm in Japan, so will just VPN to hit up your content. Japanese companies are so weird with their IPs and copyright. I've worked with some companies dealing with IPs in the past, and man I got some stories, but unfortunately I can't share publicly. I can almost guarantee the reason you had 80 some random videos chosen was because this whole task of finding and taking down videos fell on some lowly employee and he ended up in shit he didn't know how to handle and just randomly chose those videos hoping something would stick.

I've fought Toei several times on my channel. They took down my Sailor Moon Old vs New videos... both of them! And when I decided to fight back, they slapped a Channel Strike on my channel. I still fought back and won all of my cases against them. They're relentless and won't stop, but even KZbin knows that what they're doing goes against our rights.

Similar things also happened with Roblox when they tried to sue a KZbinr for... I honestly don't get the reason but they tried to sue him for 1.6 Million! Thankfully, no money went to Roblox however the KZbinr still lost 150k from all of the paperworks and stuff.

As someone who was recently dealing with 10s of takedowns and strikes on my channel from Kadokawa, it's definitely relieving to know that a potential new option for copyright exists. Yes this is honestly very good for anime content reviewers on this website. We've been saying that if Japan's messed up copyright law's don't allow it there then it should be blocked explicitly in only their country. But it's nice to see that KZbin finally sees it this way as well. Maybe the boomers in japan will realize after they've successfully blocked all of their own content in their own country. That maybe their copyright laws aren't so great or reasonable after all.

The fact that a KZbin higher up had to reach out to Mark outside of YT as a whole, and through Discord of all things, shows how completely screwed YT's system really is. We're very lucky that Toei tried to strong-arm this whole debacle, and didn't just provide some verbal reasoning they pulled out of their butts. What a confusing mess, but man I'm happy it ended the way that it did. Great job sticking with it all this far, man. Toei (and Japan as a whole, considering I saw so many JP fans defending them) feels stuck in the stone age at times.

I know KZbin needs a LOT of improvement in many areas, but hearing this news (even having not been privy to the situation beforehand) has me throwing my fist into the air. Your KZbin contact sounds amazing, and what they moved to accomplish for you should be *the* model for similar KZbin/creator relations. I'm glad they were able to [hopefully] prevent any further issues with Toei, and here's to hoping that this step will lead to more options and control for creators.

@Anime School Shooter WAIT. Are you the god of this new world? Are you Light Yagami? I love Death Note! That’s one of the first anime I’ve seen. I really like the scene where he takes a potato chip and eats it. That scene was hilarious and profound. The fact that he could do so many things at the same exact time without getting caught for a long time was insane. He really was a very talented and intelligent individual. The Death Note is also a really cool ability as well and it shows how absolute power over life and Death can corrupt people. L was also a brilliant character who almost always caught on to what Light was doing despite him being at a disadvantage since he didn’t have the Death Note. His death very sad as a result because you grew an attachment to the character. I could go on, but overall I believe I made my point. Death Note is a fantastic show and I’m very glad you referenced it.

I'm going to have to disagree mostly because there are "reaction" channels that pretty much play the anime in its entirety without really adding a anything of value to their "original" content. They should remove all these channels stealing content without scrutiny. If there weren't alot of people doing it then channels making the content and losing views need to find a way to carpet bomb all channels even showing scenes of their content. I had a video of my dog stolen and put on a compilation so I am biased and bitter about this. It's not hard to just screen capture a bunch of videos and make it into one big video then add "try not to laugh challenge" in the title. So I feel there are some type of justification to a company pretty much copyright claiming their video if they didn't have consent to use that material in the first place. Yes it makes it harder for certain creators to make their content by ripping scenes and adding them to their videos for explanation purposes but at the same time it also makes it so that the creators or companies publishing this work have control over their work. It is an investment after all. It would be like you drawing a piece of art then someone using it as part of a title intro without giving you credit for something you did. Also say you were going to sell it. Well now it's that much harder because people can just Screencast your art and use it in a "transformative" way.

Mark has already stated multiple times that he doesn't market his videos to Japanese audiences, and now he doesn't have to worry about their copyright laws.

I ask this question, what is the difference between Mark reviewing anime and movies he likes and say IGN or some other bigger entity doing the exact same thing? He's not outright ripping entire episodes and uploading them on KZbin. He's transforming the content into something educational and creating his own written/vocal content to expound on his thoughts and opinions on the subject matter.

I also have a KZbin-Contact. I once thought, long ago, something like: Man, C-Culture is bad. But the reportbutton isnt inherently bad, so why is no one trying to use it for good? Using t it to be the 180 Degree Opposite of Cancel-Culture?? Years later, i had become a real Expert in using the flag-system of youtube: Some Lad who had over time removed thousands of s-ual content, racism, sexism, phobics-of-all-sorts-and-sizes, as well as even more intense Stuff than the listed. Then, Susan became CEO and it's fact-and-not-theory that it became less and less often than this worked. The flag-system became more and more 'erratic' and random. But i keep going, even if rarely any Openly Hateful Speech is removed anymore.

Honestly, props to your KZbin contact. We hear horror stories more often, about how KZbin doesn't care about it's creators, about how creator's contacts often have no idea what's going on because even they don't get any information... and yet, in your case, someone decided to go above and beyond instead of just letting the situation sit where it was. However that person is deserves this to be the best year of their life, at the very least. They looked at your situation and decided it wasn't going to stay that festering wound. That's an absolute example about how all of the KZbin background system should be.

They didn’t remove them randomly, they tried to curate what was left of your channel to their interests. They acted as though because you used their content they could do whatever they wanted with your channel. It looked shady surveying the damage, and I’m grateful they’re not getting away with it. Especially because, as you mentioned, the ecosystem that can exist between OG creators and the creators who use their content to create new and expanded universes is amazing and clearly working (excellent DBZA analogy, pretty sure LittleKuriboh has talked about feeling similarly with Yugioh)

man, seeing Mark and his team dealing with all this wild Toei litigation really helps put into perspective TeamFourStar's choices as far as ending Abridged. it's fuckin' shameful that lifelong fans and supporters of these series can't show love without having their necks stepped on.

@@jason86768 They talked about this very clear. I dont think its about Toei or some shit like that. Buu saga just doesnt have enough material to work on. Its also where the Dragon Ball Z starts to fall apart too. They said that they looked through the Buu saga and couldnt find anything funny and they wouldnt just want to make something that they wont enjoy.

KZbin is far from perfect, but they have my respect today for standing up to Toei and protecting one of their creators. Hopefully they will continue to learn from this and that Mark and his team can sleep more soundly that their livelihood is less in danger

I feel this warm and refreshing passion from the way that you tell your side of the story. I honestly had no idea how bad toei was till I started seeing memes. But seeing the way they have hit you and knowing smaller channels might not get the help to restore years of videos is heartbreaking. Most of the anime life has been accepting till we hit roadblocks like this. Your fans are the reason im here to subscribe today wouldn't be here without the people i saw fighting for you in the comments of toei memes

This needs to be the real conversation. KZbinrs should easily be able to decide what countries they want their videos available in, for whatever reason they decide, but especially to be able to make it unavailable in a country they suspect it would break the law in. It would seem a positive for KZbin for creators to be able to avoid copyright issues.

As someone preparing to start law school this year, this experience has been fascinating to me. IP has been of interest to me so following your unfortunate situation has proved to be a worthwhile case study. Good luck moving forward, I hope this end here with the new youtube president of region specific blocking. The way I see it, by removing originating jurisdiction there should be stronger legal protections for yourself. Corporations in other countries have blatantly infringed on patents for years, but keep themselves safe by producing I. Countries that refuse to recognize nation patent agencies. I see this move by youtube as a similar strategy, but in this case it is done to protect honest content and IP from misunderstandi g and corporate over reach at the originating local level.

This is actually .... logical? Unexpected from KZbin. But seeing how ruthless Japanese copyright law is, it seems like a very obvious solution. I hope they just give creators the option to leave out specific countries, so that one could easily make videos about Japanese content without running into their laws being applied internationally when they clearly shouldn't be.

@Kent Son ... Huh? This content is perfectly legal outside of Japan. By making it that these videos are no longer viewable in Japan, that removes the legal issues. I fail to see the issue with this, as this seems the perfect solution to deal with vastly different laws.

This person is either a troll or a complete moron. Let's not give them anymore attention and ignore them, please. Back on topic, I agree 1000% with the OP. Allowing creators to manually block certain countries with rigid laws will keep everyone out of hot water, KZbin included. While that'll kill engagement with any small fans you have in said country, Mark's situation is a direct example of how that's a sacrifice you may need to make to stay afloat. He's following the law in his own country, so he shouldn't be punished by the ruthless laws of somewhere he doesn't even live.

@Anime School Shooter toei is a multi-billion dollar anime company, outside of America, that has it's own laws, traditions, and is using a form of entertainment that is constantly having to deal with piracy. Not saying it COULD happen, but it's not probable enough that Mark wouldn't have done this, even with the staff at his disposal. KZbin would've immediately been able to see through it if that was the case.

Dude thats awesome! KZbin really stepped up on this one, this could legit help so many other people as well. I know KZbin gets it in the neck a lot so I'm really glad to hear you had a ,relatively speaking, good experience, at least with the KZbin staff. Im shocked and disappointed in Toei and the way they have treated this but I am at least happy that you got a resolution. Well done for sticking with it and not breaking under the stress.
