Brokers are okay with holding your truck hostage but heaven forbid we do the same to them. I told the broker I would sell all the product in the trailer if he didn't make it right. playing hardball with freight brokers!

Better know what you're doing if you're going to hold a load hostage... Put the storage fee's in the rate con. If this happens, then send them a invoice each day for $1000 storage fees and I do not release product till fee's are paid. Just like a storage facility would do.

@@johnwells920 trust me it works. A freight claim ect is going to drag out for them because it is in the contract.... If they want to waste their time with that and money on product etc... all for a couple grand. go right ahead. All my contracts with brokers have storage fee's listed. In fact the way it goes down is the customer talks to the broker, whom then call me and I point out the fee's. most of the time the broker pays them out of pocket... They don't want to lose their customer over a few grand. Would you dump a customer you make 50k a year off of for a few K? doubt it... this shit i not all cut and dry like you think. this is still the wild west... "just go make a freight claim." is not so easy my man. also product not getting to a brokers customer is them risking a lot of money most of the time.... If they don't pay ball, then my lawyer calls them. You sound like you know nothing about business... More than one way to skin a cat my man. Like none of this happens to me because I know the game so well. I lost thousands while learning this game.

I had an executive from an oil company call me to inform me that I had to sit on his load over a labor day weekend after the delivery address that was given to me was wrong. I flat out told him he make arrangements to get me unloaded or I confiscate it and he will have to contact my attorney to re negotiate terms. He got on the ball and got me a proper address to drop his load. Sometimes we have to push back or get used to being a doormat.

There's a story of a load of potatoes where that happened. Trucker was a pro. No problem he said. He stored it at a warehouse and kept on trucking. Months later when they went to court the judge sided with the trucker and they paid an absurd amount of money to get a load of rotten potatoes. You own it while it's on the truck. That's what they sign the bol to you.

@@dominick253 I highly recommend anyone thinking of going into the trucking business should spend a few bucks and hire an attorney for an hour to instruct them on these issues. Truckers are loosing thousands of dollars because of issues like this. They need to be ready and have all the right answers when the brokers and shippers and receivers screw up. They always want the trucker to take the brunt of the screw up when they caused it in the first place. In my case when that executive in Canada realized his staff forwarded the wrong information to the broker for the delivery address on my load and I was not going to sit on his freit over the labor day weekend for free he got on the ball and found an address to drop his delivery right quick. My point here is I was adamant that his freit was my property if he didn't figure it out at 3:30 in the afternoon Friday before the holiday weekend. Truckers need to be ready to set the record and tell them how things are going to work out if they dont fix the problem. The cost of reloading his freit and having it shipped BY ME ONLY would cost him a fortune. It was about to become my property and if he wanted it I was not going to play nice at all. Glad he got the message so it worked out for both of us..... Hey Truckers !!! That's how it's done.... so grow a set and wise up for the sake of your industry and stop doing business like crack head loosers.

Same thing happened to me with a broker on a Proctor and Gamble load. Broker lied about the delivery date and thought I was going to sit 4 days for free. Every night at midnight, I sent them a storage bill of $750 per day. I ended up getting about 75% of the total storage bill. You guys need to learn the laws that protect you from broker fraud and abuse.

@dominick253 FINALLY. Someone who understand the freight chain of custody. You are absolutely correct. The "driver" took ownership/responsibility for the load at pickup and is 100% responsible for it until someone else accepts delivery. PERIOD. As long as the driver fulfilled his part of the agreement, he's protected

@@SeeSaw99 he's protected right up until he tries to hold the load hostage. The thing is he basically owns that load when he put it on the truck. That means that until someone else signs to accept it, the consignee another carrier or a storage place/warehouse. Maybe these guys talking about a friend of a friend did this or that know stuff I don't. Think about this, you're in a city not your own, you decide to put this load in storage. How do you do that? Do you think possibly the warehouse guy might wonder about things like who will be paying him? Who actually owns this stuff? Who authorized it to be delivered to an unauthorized address? How many agencies are going to be racing over here to arrest me for receiving stolen goods? He handled it as well as he could. Get out from under the liar's load asap by any means necessary. Accept whatever extra money offered. Ideally make the delivery without incident. Then look at the bill of lading. You will see "prepaid" meaning the shipper is paying the freight, or "collect" meaning the consignee is paying the freight. Once you've determined that (understand that the "shipper" may not be where you loaded, same with the delivery) once you've determined who pays then you know who the broker's customer is. That's where you send your "amended" freight bill with your extra charges and an explanation of why you have billed them directly. If you're asking for reasonable compensation you'll probably get it. From the broker. Who doesn't want to lose his customer. The one who was on the phone with him 10 seconds after he read your freight bill.

What they did is called a “theft of services” I was on a dock in Fon Du Lac Wisconsin they had me 12 Hours late waiting then I bumped the dock five times then pull off due to “refrigerators” not working properly so I started videoing the activity at the dock six trucks backed in got loaded and pulled off. I did have a lawyer. He sued them for theft of services, $450,000 later I was a happy camper. What they did was falsify federal paperwork and scammed you out of fuels and insurance. You know if something happened to that load they would’ve sued you and filed on your insurance.

Ok tell me what attorney does this kind of work. I need one to help me with some past employment issues. I get fed up when I have to wait 2 weeks for detention of 6 hours and what I got was 116.00. These consignee had a 2 hr window to unload, then have me sit in the dock till 11 am and I arrived at 03:15 am. Who is the attorney or the type you use.

Well I don’t know how not to put up with them and lay out my terms . It seems to never works or at least 90 % of them time . I need 175 per hour or $3 per mile plus all charges like tolls . Gas scale IFTA cargo insurance . Return route only . Please educate me where I can do this

Most brokerages don't have the industry knowledge of say myself, owner, driver of several trucks for 30+ years. The 8% industry standard has blown out the window. The snakes have basically ruined the best part of the industry. Supply/demand vs business ethics. Most brokerages don't have business ethics or a true understanding of the industry.

Often times customers don’t wanna deal with truckers that’s why they work with brokers, “here is all the work I have figure it out”, if you are able to find direct customers find them and make sure you keep them happy, have a deal with HR not with warehouse manager because a new manager can come at any time at not validate your deal with the previous manager.

I worked for a heavy haul company, I picked up a customers crawler crane, called my dispatcher when I got loaded, he said bring it to our yard instead of the customers job site, the next morning the customer called looking for his crane, my boss told him when you pay us for the previous moves you’ll get your crane, he got paid in full that afternoon

That’s a classic move in the industry! Using owner ops for storage. Best way to beat the system is to; go above the brokers head and call the customer and confirm your delivery time before you leave the shipper.

Yeah I knew some one who found another trailer that was good enough condition that was fairly cheep so he went and bought it and just left the trailer with the other load at the lot and ran another load and sent the original delivery a storage fee of 680$ per night over 5 days and at the same time took a load 5 states over and dropped his trailer at a friends house and went grabbed his original trailer delivered that sold the trailer he bought 6 days prior with no loss

Drove for a small company and dealt with the brokers myself often. I would always call receiver when loading and double check the receiving hours and “appointment times”

I appreciate how nice you were. I operate 10 trucks and each truck gross over 2k a day. I have a great debt recovery team and lawyer play with my money I’ll drag you in court. Shippers pay money don’t take shit from a broker!! Each truck and trailer runs me quarter million. I’m not playing games. This isn’t my daddy’s money. You pay me or say bye to your freight!

I owned a trucking company with 1200 employees. If a brokers mouth is moving he is lying. It has been that way for a hundred years. If you are going to make it in the business, you MUST develop your own contacts. My nephew still runs trucks and right now he gets paid whatever he wants. Many times 6-7-8 dollars a mile. F these brokers.

Detention is at $115 PH and layover is $750 per day. You also should have had the broker sign your contract as well.

Unfortunately that isn't enough. The truth is that the vast majority of peoppe would be far different carrying a rock over a firearm. Having a firearm alone doesn't make you safe. Having a firearm and having the knowlege your grandpa thought you isn't enough. Spend the money get training and learn how to fight with that firearm. All the things you dont know will show their pretty face at the time that you need to know them. For instance malfunctions. The fight won't stop when a firearm has a malfunction. You have to have the training and practice so that clearing that malfunction becomes second nature. Along with a kost kd.other things. Anyway, spend the money and get training. And no, those shty ccw classes are not training.

This used to happen to me all the time until I developed my own contacts and got contracts direct with shippers. At one time I had 5 loads sitting in warehouses all over the country. All paid eventually and they paid storage too. I didn’t tolerate this bullshit. My business is intentionally designed to turn a profit. It’s done on purpose. I got away from brokers and dealt direct with customers and guess what? All those issues disappeared.

@@AyyYoGee we did 2 things. My wife became a freight broker and we also worked closely with customers that needed niche services. It’s all about relationships. Develope them and invest in your business relationships. Sometimes it is a waste of time. But only sometimes. We made a lot of contacts and slowly we worked with smaller shippers, manufacturers, jobbers, etc and we developed excellent relationships with some big names like Kraft, Pillsbury, Tyson. When they needed a delivery that was out of the normal and didn’t fit the contracts with big trucking companies. We got the call. Handled the delivery immediately, and made sure everything for the customer was smooth sailing. No issues ever. It became a name your price relationship with many businesses because we were so good. Like I said, grow relationships with people. Invest in them. Most of the time it will pay big dividends. It’s not something that happens overnight. We worked on it for many years. Our relationships with the small guys kept us busy as hell and our relationships with the big guys not only allowed us to haul their products but we also grew a heavy haul/ over dimensional trucking company along with a rigging company because of the trust we built with them. We moved heavy equipment for these big food manufacturers. Everything from ovens, mixers, vats, pumps, piping. It all grew from a single handshake and a promise to never ever let them down.

Yeah that broker had dealt with this sort of mess up their end before and disgruntled truckers , tried pushing the driver into a corner "this won't look good as a solo driver" crap instead of honestly admitting driver is 100% right and maybe saying sorry this is not my policy I just work for a bunch of inconsiderate parasites. Anyway he was ok and he sorted it out, but the $200 was an insult. They put you out of schedule 4 days !

This just happened to me. The broker AND my dispatcher(as far as I'm concerned) lied through their teeth just to FORCE me to take the load AND on a weekend that the company knew full well I was suppose be getting home! But these brokers do it bc NO ONE holds them accountable for their bs they pull when they NEED/WANT to get the load on AND hold our trucks hostage with a shitty rate to begin with! Good for you for charging the $1k, I hope you got it for every single day..... He's Lying ALL THE WAY THROUGH HIS TEETH btw!

This is pathetic. Yes, he shouldn't have threatened to sell the load, but I understand his frustration. Truckers are squeezed from every angle...constantly rising gas prices, reduced pay, and shit like this. The big shippers know that truckers have no real power so they take advantage of it. It was the shipper who was at fault for entering the wrong date and he's just supposed to eat it? BS. You're a great guy!

I had a somewhat same problem once and I put the load in a storage yard and rented a trailer and went on with business. The end result was I got paid storage and redelivy fees, it took 3 weeks for them to get there stuff together but I was not going to give into them

Thanks for sharing this frustrating journey. It's great to see how you handled everything and what the outcome was. I had a situation that I had to negotiate a return rate for a rejected load. I didn't tell them that I was holding the load hostage, but I parked it until they agreed to the rate. So really I was holding it hostage. Thankfully, I didn't need to twist their arm for them to agree. Use your leverage when you need to!

There are several things that MUST be changed in the industry: 1. Improved detention payment, accrued by the hour. 2. Shippers load, consignee's unload. Plain simple, drivers MUST NOT pay lumpers to unload the consignee's freight. 3. Time limit of 1 hour to load/unload any load. Detention after. 4. OO's set per mile based on length of trip. Should charge "putting up with shit" fee to go into areas like CA. And allowed to charge surcharges as needed for reefer fuel used to keep loads a "REQUIRED TEMP". 5. Company drivers paid by the hour when company directs routes. 6. Those trained by military or police and trucking is a second career by allowed to concealed carry in trucks nationwide. This shouldn't be an issue for any driver to carry , but you know, Chicago, LA, NY.

This is very common for small independents getting screwed. This is why I haul Household goods only. I set my own rates, and I have a 17 page tariff. What you need to do immediately is send the Broker and Shipper a Notice that you will be placing the goods into storage in the next 24 - 48 hours, and cite the breach in the hauling contract. You will need to cc the letter to your insurance company, state police, and FMCSA. This way they cannot have you arrested for frivolous offenses, If they refuse to act within the time stated on your notice, place the goods into storage and invoice them. Follow the protocol above to cc everyone. If they fail to pay you for storage and reasonable waiting time and all other expenses incurred, you send them a final letter demanding payment in 7 days, or you will place the goods into a public auction. If no money comes in 7 days, you have a right to sell of the goods in an auction. This will be a big time waster for you, and keep in mind if you make any mistakes, they will use that against you in a cargo claim. Check with your state on the procedures for public auctions, and how you should notify the debtor. All the best. Alternatively, I have been told by a friend that you can call the FMCSA and explain the problem to them and they can show you how to file a claim on the brokers surety bond. This may be the easiest way, however you will need to do this after you have delivered the load. The claim process may take several months to be adjudicated, and the chance of winning the claim is not certain.

@@Jfdas123 I love to write. My Wife looks at the tariff and she says, "Your nuts 😆". Here is how you do it. First you start by defining the carrier, that is your company. Name address, MC and DOT number. Then you define who is your Shipper I.e the person who hires the carrier to haul the load. Then you define the consignee etc. Secondly you define your rate per mile. Say $8 It needs to be high so you can discount it on an invoice. Then you define things such as payment terms, waiting time, storage in transit, tolls, lumpers etc. You then define things such as your procedures when a shipper fails to pay. When a consignee is unable to receive. You think about all the scenarios that happen in real life on the road that you encounter under a load. Over weight procedures and fines, Hazmat procedures and permits. Finally you have a table for fuel surcharges. If the fuel is $4 fuel surcharge will be 12% if fuel is $5 fuel surcharge will be 18% etc. Then get it down to fine print and sent it directly to your Shipper once they book a load along with an estimate. Send a copy of your tariff to the FMCSA so they have it on file. If you update it or make changes make sure you update them. It's that simple. I haul house hold goods, motorcycles cars and boats so whomever wants me to haul their stuff gets an estimate as well as my tariff. All the best.

Every time you deliver or pickup a load offer to match/undercut the broker by a few percent. The brokers take a huge cut so even if you go 10% under the brokers quote you come out ahead. After a few years you will have a bunch of customers and enough loads to fill your calendar.

It's called a contract. Read it and if there are no penalties for the broker in this situation don't take the load. If you accept the contract that has no penalties against the broker you have no legal recourse in this situation.

Same thing happened to a few months ago, I told the broker he would have to cut me a comdata check BEFORE I unloaded or I was gonna sell the load, he said I couldn't do that, I informed him the load belongs to me untill the bills are signed, I got my money 2 hrs later.

That’s what happened to me and I told them if you don’t pay me I will keep the load in my storage and he told me I will call the police and I told them call them because I have confirmation for this load and it’s been confirmed between me and you for me to pick up for the service that I’m giving you and need my money 💰. He said I’m not, so I told him if not I will just sit with your load and u will loose your customer and will tell your customer that u are not paying me my money that u owe me for sitting for 2days. Within the next hour I got my money for 1500. Police could not do a dam thing because it’s business and all they would say is take up in court because it’s a civil matter.

Interesting that the broker expects you to pay for their/company error. Then to talk about how they would damage you if you do not comply with their demands? You did well there. I think I would hire some temps load the product in a storage unit , overnite the keys and tell them to go suck themselves. I would eat the loss Of expenses but there is no way they would tell me what to do with MY equipment and business. Then call my attorney for a letter that advises them if they post anything negative I will be suing for business interference and also slander.

@@pain_weaver yes, both as they would be conversing in the office, company. 32 years ago I sued a company for both after they did not pay me for a large bonus under contract. When I sued just for the back pay I sued them for libel, slander, malicious prosecution, interference with business relationships and 3 other counts when they retaliated and did some stupid stuff in an attempt to pressure me to drop my case. I won a judgement for $366,000 against the owners of the company, husband and wife. They bankrupted, I bought the company at auction for .10 on the dollar including the vehicle they drove and the desks they sat in, restarted the company with expanded and improved product line, sold the company 12 years later and it continues today. One way or another I am going to collect.😎

I am so happy seeing this post. We are an owner operator with one truck and trailer. We just literally ran into this situation. I ended up calling OOIDA for advise. They told me the ball was in our court and we could set our rate to store the load. If they didn't agree then as a last ditch effort we could get a storage bldg and put the product in there. Also we could set our rate to return the load! The broker rep wasn't happy but he paid us what we asked for! You don't have to let them screw you! You can be professional and matter of fact! Also.... There is a possibility of filing on their bond. I hope this helps!!

I would have told the broker that they're going to be billed an additional freight charge to deliver it to your warehouse and then be billed a daily storage fee to store it in your warehouse. On top of that be billed an addition charge to re deliver it, as soon as it fits your Truck and trailers prior made commitments and Schedule... BS with BS.

Tow truck companies do something similar all the time and if people want their dang car back they got to pay . They got to pay the storage, they got to pay the towing Bill and all that crap, so why the heck can't owner operators do the same thing if they're using their trailer as storage and holding him up.

I'd just say "You've got (X amount of time) to get this figured out before I figure it out....." It's your truck and trailer.... If you've got to throw everything out on their doorstep and count your losses, well that's a risk you have to take.... Or else it's a few grand a day or a few grand back haul..... Or you can see me in court.... Don't let them tell you how to use your equipment.... If I can't tell you to save money by driving slower, they can't tell you to hold cargo at their rate 🤷🏼‍♂️ their mistakes aren't your problem!

I never jumped ship and I was always driving for somebody else, mostly smaller companies though. The smaller companies boss man was usually a networking Wheeling dealing fast talking son of a gun! I have experienced what you’re talking about and how they handled it. Generally he knew somebody or someone who had a warehouse and a forklift locally and they would send me over to dump the load. Bear in mind this only works if this is an area that you go to quite regularly. Usually he hung the delivery location out to dry in that we didn’t deliver until he got damn good and ready and it was really convenient for my company. We charged a really hefty redelivery fee and sometimes I think he hooked them for storage too. Meanwhile our trucks were still running, making money etc. The big technical difference here is we never planned on selling the freight or crossed with the ideas of stealing the freight. We had every intention all the time of delivering the freight. This as I understand it kept us out of a lot of legal problems that could be associated with the idea. The point is if you snoop around or nose around you’re very likely to find a small freight company and they have some open space that they’ll let you use for surprisingly a little bit of nothing. Some delivery companies are such asshats that these local people will help you out for free just to throw jabs at them.

I found a buyer for onions I picked up in Arizona once. Was supposed to deliver in Massachusetts and when I got there on appointment. They said they couldn't unload me when I got there and told me they didn't know when they would be able to get to me. I found another market place near the location that was going to purchase the load and I told the broker. I was the very first truck they unloaded the next morning when they arrived at 0530. No fear. That's my advice. No one in this world can do anything to harm you or your family. Fear can turn anyone into a slave to this corrupt system. Live morally correct and faithful to The Lord and you will be amazed at the true power you actually have to not allow anyone to tread on you.

As a 1 truck 1 trailer o/o I've bn in this sammeee situation.. these million dollar companies won't pay u jack ish if they mess up. I feel this whole situation 100%. Happened to me in Nov with a -10! Loaded on Mon night didn't get empty until Fri am maybe around 3 or 4. Was an 80 mile run ended up getting $3300 total which it orginally paid $600 bucks I believe. I also got to wait at home. Ik I didn't make nothing compared to a regular week but atleast I got something.

I commend you for staying as calm as you did. I'm not a trucker but your video was very interesting. I'd bill them for the storage fees like the other person said in the comments and if they don't pay take them to small claims court or turn it over to whatever government agency oversees interstate commerce. Let them handle it, that's what they get paid for. You shouldn't have to take it in the keester.

There is NOTHING on the BOL that states that it needs to be delivered on a dock! I have backed up, hit the brakes and left it on the ground. I signed the BOL delivered date and time. (told by Dispatch to do it and I did) greatest feeling ever! Funny thing, I was back the next week and unloaded real quick!

I had an absolute hate for brokers when i worked shipping and receiving. The first couple hours of the shift were the busiest and we absolutely could not handle a large truck out of order most of the time. I worked at a company that had 3 sets of 3 dock doors. Most were reserved for drop and hooks and i only had about 3 doors we could really use, and 1 was on the opposite end of the building. And we didn't have much dock side space, we had room to unload a single trailer, if that, and after that we had to start hauling material to storage, and we only had a couple forklifts. I had a guy show up at 3:30 asking for a door, his broker had told him to get there at 4, our dock time for that truck was 6PM. He was livid when i told him i couldn't get to him for 2 hours, but i had a 4 PM live load/backhaul for 1 door, a 5PM live load/backhaul for the 2nd door and the 3rd door was just not an option because of the location. It was not the last time that happened either. And it wasn't like this was a one off load for us, this particular truck was a 3x Weekly delivery. It was always nice when we got the same drivers as they knew what to expect. At one point we were expediting 1 or 2 skids of product every 4 hours to the customer (not our fuckup) so we had sprinters showing up like clockwork. I had one guy walk in after i just gave the previous guy the paperwork to leave (they literally held the door for each other) and asked how soon he could be loaded. He was not happy when i said 4 hours. I told him we are shipping every 4 hours and that guy just walked out with everything we have right now.

You can put a load in storage at a warehouse and charge them storage fees until they are paid. You legally own the load while it's on your truck. They legally don't get ownership until they sign for it and unload it.

That's how we do it in car hauling on COD loads. I put the vehicles in storage until they pay the load, storage fee, and then I FedEx them the keys and location of the vehicles.

I’m 21 and about to go owner operator. I’ve been trucking since I was 19 and I’ve been very isolated so it’s hard to develop my communication skills. Videos like this help me so much so thank you!

Just watching how this deal unfolded, really pissed me off. Im 100% independent O/O 1 truck 1 Reefer. What I do to avoid , at least to try to avoid these issues is: asa I get the rate confirmation, I call the shipper or receiver , depending on what deal is . I contact them and I confirm de rate confirmation and the dates and times . Otherwise , I cancel the deal. But , having said that . This shit shouldn’t ever happen. If happens , then they have to pay for storage . As you stated , 1,000 . In my case , I have to make at least 1500 per day , specially now that the Deasel is so expensive The problem I see in this industry is that , we don’t have any leverage to fight for what is right and fair. That is the reason that brokers can F With us without fear or consequences.. I really appreciated that you take the time to put this info out , for all of us. There is something to learn from. Hopefully most of us start taking the time to share the good , bad and ugly moments in this business. I have my channel as well , but it is in Spanish . Let me know if you want to checks it out . I'm a company driver, have been for almost 8 years. You have way more patience than I do man. I've had customers that made me wait two hours for me to pick up their load, I told them they have 10 more minutes, that's all I got then I'm leaving. Started driving off when it hit 10 minutes and saw a guy trying to chase me down, I'm like nope. Put it as a refusal.
