Hi there! I have pre settled status when i applied for retained to remain after divorce. My question is now my residence card is gonna expired in 3 months but just today i applied for settlement status cuz i did 5 years in uk. I have to replace my ID? I didn't get any new ID when i applied for the retaind to remain because my lowyer said i didn't need a new one but now I'm confused

Hi Tom, many places on internet I have read that if I have presettled status under EUSS as a non EU and if we get divorced from the EU national and if I meet the 3 year rule of being married and one year of residency in the UK with the EU citizen that I don't need to do anything now as I already have a presettled status but when I am applying for settled status I need to prove my retained rights of residency under EUSS. Wanted clarification on this if u can.

Guys although Tom is very qualified person. However as per the law you must fulfil all the 3 criteria to qualify for retained right it’s not “OR”. So basically 1. You must be married for 3 years with one year together with your partner. 2. Have custody for the child. 3. Have court order to acces the child. If you don’t have child, you do not stand sufficient grounds to get retained right simply on 3 years of Marriage and 1 year together in the UK.
