I got my "In Training" vest off eBay. I'm owner training my dog to be a PSD. There are obvious signs the dog isn't a real service dog. It's not "paper work", the vest, or leash that make the dog fake, it's the training! It takes 1-2 years to have a properly trained service dog and you can obviously tell if the dog has the training or not.

I do agree that there needs to be better service dog laws, but they also need to be accessible to owner trainers. I think that there should be a "official" required public access test, once the dog passes the test (owner trained or program trained) then they should receive a id card and a few patches that can be put only any vest for a service dog. It would be wrong to have one or two mandatory vests because people need different vests for different disabilities.

Michelle Rekuc I get the idea of what you're saying but I don't like the idea of "ID cards". Fakers will do anything, and often have the money to blow on stuff like that. Unfortunately a lot of real disabled people are poor and can't afford 70$ to "certify" their dog. I am one of those people. I train my own and while it's a good idea to have the K9 good citizen test, if you don't think your SDIT or otherwise isn't ready than there's more training needed. I just don't like the idea of buying into the monopoly of needing money to have a piece of paper that HOLDS NO LEGALITY. Dogs are not robots, they're just like people and have good and bad days. Say you pass the test on a good day, then your dog has a bad day and regardless of the "certificate" you're still asked to leave the premise. It's all about the training, not having some piece of paper and an ID. I see the want for "proof" but your dogs behavior should be enough.

@RandomPoet869 жыл бұрын
Yes, those are the only two questions that store owners/employees are allowed to ask. But if a dog is misbehaving (e.g. sniffing merchandise, barking, growling, jumping, approaching other customers or employees...) they have the right to ask the handler and dog to leave. Also, the main problem we have now is that too few people are aware of what a real service dog is. And they're not aware of the laws regarding service dogs. So let's start with raising public awareness. Go to: www.ada.gov/service_animals_2010.htm to start learning the truth about service dogs.
@rstevewarmorycom9 жыл бұрын
+RandomPoet86 That's a very simplistic intro to ADA service animal law. The law also says that if a state requires a shield or placard in addition to the claim of the animal being a service animal, the owner must display such shield or placard or else the protections of the ADA are not available to them!! In other words, without also respecting state law regarding service animals that the protection of the owner by the ADA is held in abeyance!!
@RandomPoet869 жыл бұрын
It was meant to be simplistic, sort of an invitation for people to learn more. That's why I posted a link to the ADA website. I am not aware of any individual state laws requiring service dogs to carry any form of ID, but that doesn't mean they don't exist. If however there are laws in some states I of course would encourage service dog handlers to abide by such laws. The ADA website says: Some, but not all, service animals wear special collars and harnesses. Some, but not all, are licensed or certified and have identification papers. If you are not certain that an animal is a service animal, you may ask the person who has the animal if it is a service animal required because of a disability. However, an individual who is going to a restaurant or theater is not likely to be carrying documentation of his or her medical condition or disability. Therefore, such documentation generally may not be required as a condition for providing service to an individual accompanied by a service animal. Although a number of states have programs to certify service animals, you may not insist on proof of state certification before permitting the service animal to accompany the person with a disability. www.ada.gov/qasrvc.htm
@rstevewarmorycom9 жыл бұрын
RandomPoet86 You missed the part about owners having to abide by the laws of the state in order to have the protection of ADA. California requires a metal state shield on the dog at all times.

As I said before, I'm not aware of all the individual state laws, so I don't know California's requirements. Was just stating where my info came from. @la86169 жыл бұрын
+rstevewarmorycom No. No. No. You do not need a card, registration or identification. Yeah, it sucks for some people, but for owner trained SDs, like my own, it helps. I can't afford to shell out money to get some bogus registration. The ADA is defined and is set. State laws aren't allowed to go above that. The ADA has a section defining that states CANNOT require registration and all registration is voluntary.

Faking a service dog especially when you’re bringing it to non pet friendly places (even for the purpose of reporting like they’re doing) is illegal and EXTREMELY harmful for real handlers and their dogs. They should NOT have brought that completely untrained dog anywhere, it leaves an awful impression of legitimate service dogs and is extremely upsetting to see as someone who legitimately needs and has worked hard to train my SD myself. You can report on the issue without making things worse for actual SD teams and actively breaking an already highly abused law.

This is why I wish that ALL businesses would have to take a course on the ADA laws and learn in advance how a real SD is supposed to act in public and how they should look if it is a fake before they ever get their business license no matter what state the business is starting or in?

"Owner trained" service dogs are just as "real" as agency-trained service dogs -- they just don't cost tens of thousands of dollars, and there are not waiting lists up to a decade long to get them. It would be a step back, not a step forward, for disability rights to say that only one or two for-profit agencies can "certify" a service dog. The national kennel club -- open to any dog owner -- has "Canine Good Citizen" and "Community Canine" tests that can be done all over the country by any number of impartial trainers that are nearly identical to the certifying tests given by agencies.
@JandysPantry8 жыл бұрын
While I completely agree that it would be a step back and I agree with where you are going, CGC and a Public Access Test are very, very different. Most service dogs are CGC certified, but the public access test is so much more in depth and intense, any trained pet dog can complete a CGC test, but only service dogs and the very very best trained pet dogs could pass the public access test. I have a service dog and I am a certified trainer, so I know all about both tests.

@donnaparker19287 жыл бұрын
RayRay Risin You might consider taking her to those kind of places as a matter of training. Like, once or twice a week until she masters it a little more. Or alternatively, if you are able to be without her, not take her on the few occasions you do need to go there. (No offense intended if you can't -- I've met several people whose service dogs primarily wake them up if they have a medical issue while sleeping, and lots who have "good days and bad days," and on their good days, they are able to out without their dog.)

The scary thing is not everyones "fake" misbehaves. Some dogs are just fine and well trained in public and not a SD but no way to know. On the other hand Oregon Law protects service dogs in training when it comes to public access which helps noel and I with her training and readiness. So if you have a service dog in training mess up (you're supposed to leave the establishment) sometimes people will think its a fake when really its just in training. SO I understand the bistro guy saying "I just thought you were training it". Businesses are afraid to ask the two questions because they're afraid of kicking out a real service dog when even a fully trained can be kicked out for misbehaving.
@snager806 жыл бұрын
the really sad thing is how easy it really is to train your own service dog. people don't even want to put in the energy/adopt a new dog with the right temperament for it. dogs are BASICALLY FREE. all you gotta do to make a regular dog be a service animal is to teach it to behave well in public, basic obedience commands, and at least one specialized trick that is specific to yourself. say you're a skin-picker, hair puller or nail biter. just train the dog to expect a treat or to jump up or nudge you when it sees you picking at yourself. you could even train the dog to stop you from sucking your own thumb or scratching yourself in public or picking your own nose. those behaviors aren't disabilities, they are things even neurotypical, able-bodied people might do. but it is a specialized task the animal is mitigating. the other sad thing is how your dog doesn't really need to present itself as a service animal and people must take your word for it, but the authority of the vest makes people suddenly stop caring. I went to a fair last month and I saw many obviously fake service dogs in cheap vests. but I also saw animals without vests who had the mindset of an animal doing a job. Its possible those dogs were specially trained animals who weren't wearing vests because it was hot that day. People dressing up their dogs actually put their animals in more danger. Those dogs who were not acting right should have been asked to leave.

Way to go breaking the law and posting it for thousands of people to see. Who in the hell thought this was a good idea
@rstevewarmorycom9 жыл бұрын
In most states there is a law against impersonating a service dog, and punishable by $1000 fine or a year in jail. Most states also provide a metal shield with the state logo, and you can look for that or ask for legitimate documentation, and if you're in doubt you can call the police to verify it, fake service owners will usually flee if you tell them you're calling the police to verify their status. The Americans With Disabilities Act doesn't allow you to question or judge a person's handicap, but they should tell you what service the dog provides for them, and by federal law it MUST be more than mere companionship. There are also federal penalties for impersonating a service dog. Also, any supposed service dog can be required to leave for misbehavior, pawing food or product and they should be attentive to their owner at all times and not be distractable by smells or inviting situations. If you have such a situation call the police. They're a fake.

You aren't allowed to ask for proof though so even in states that have that state tag it can't be required according to federal law.
@rstevewarmorycom8 жыл бұрын
+Marleigh Joy This is a mistaken understanding. The federal statute is written so as to support any further state statute, and never contradict it. If a state requires a state shield or license, the federal law stands in abeyance to it.

federal laws says you are not required to show proof and federal law trumps state laws...the ADA says the more lenient of the laws should be applied and in this case it would be federal...which states no proof can be demanded
@rstevewarmorycom8 жыл бұрын
Kathleen Biederstadt Federal law trumps state law ONLY when it is written to. And there is no such federal law. The ADA is written so that state regulations are not trumped. in fact, they say that IF state regulations are not meant, the act is in abeyance, or void.

I don't like how that guy questioned it because it was a small dog... any breed of dog can be a service dog. My first service dog was a Jack Russell Terrier mix... and she was a wonderful service dog. I wish more people knew that any breed can be of assistance.. it's not just goldens and retrievers. My current Service dog is a Standard Poodle... and I still get questioned because she's "Too Cute to be a service dog" (Yes, I've gotten that comment before!!) or "I've never heard of a poodle service dog!"
@DigiDrifter6 жыл бұрын
Poodles rank, I believe, number 2 or 3 on the list of most intelligent dogs, so they do make wonderful choices to be used as a Service Dog, their varying sizes are also favorable depending on the living space and/or the job they are trained for. I once saw a Chow Chow come into Petsmart and they said that they were training her to be a Service Dog for diabetes, which I thought was a wonderful idea, Chows don't really have the best reputation so this could help boost it.

The issue is, dogs that aren't service dogs aren't allowed in public period. It's the law and its that way to protect the health and safety of the public as well as legitimate working teams. Running into a fake is every team's worst nightmare and I know legit dogs that have been attacked by fake ones. As far as terminology, it's important that the information provided to the general public is very clear as to what types of dogs are and are not allowed in public.
@inkeed8 жыл бұрын
Fake service animals are not only not allowed by law, but you have to also include the following for the disabled with REAL service animals. 1. A fake might attack either the handler or the service animal. 2. A fake might distract a service dog from "working". 3. The laws in place are to respect and protect patients medical information. 4. Fake service animals are not always well behaved, thus giving a really bad image for the real deal.
@belainverso74558 жыл бұрын
Other dogs can distract service dogs or pick fights with them. If the dog wasn't at attention to his owner, something could happen without the dog alerting the owner. (Seizure,blood pressure drop,ect)

No you don't need to prove anything, but maybe it will help weed out the fake ones. Its not fair to the ones who really need a service dog when fake ones are making service dogs look bad. Maybe it might help carrying a card, a tag, certificate to show stating this is a real service dog, just to make it easier for people with real service dogs.
@eliicd3035 жыл бұрын
Actually you do need to prove a service dog is a service dog when it is a psychiatric service dog to fly. You must have a letter from a doctor for the dog to fly in the cabin.

The easiest answer is because it's against the law. Health code forbids animals, specially trained service dogs are an exception. Period. That's what irritates me the most. Aside from all the reasons pets shouldn't be in stores, none of it really matters because the bottom line is in the US it's against the law. The end.
