@@UncLester The nitpick is relevant and so is the digustingly vague language of the law. Any paranoid cretin with a gun (and aren't they all) can claim they felt their life was in danger. Sadly, the stories like this are few and far between. Even when there ARE good guys with guns around, the shooter has often prepared for that eventuality Like the Buffalo shooter wearing body armor. He returned fire, shot and killed the armed guard in the store If the simple presence of more armed citizens meant fewer mass shootings, America would have the fewest mass shootings of any country… Obviously we know this isn’t the case

"Shall issue" = Must issue a license, so long as all the state's requirements are met. An issuing authority has no option to not issue. "May issue" = Issuing authorities have the option to issue or not issue a license. "Stand Your Ground" = Some states require a person to flee from a deadly situation, even in their own home. If someone breaks into your house, pulls a weapon on you, and threatens to kill you (Or, a family member), you all must flee your home and not defend yourself, under penalty of law. Stand Your Ground laws stipulate that a person's "Home is their Castle" (aka. Castle Doctrine) and they have every right to stand and defend themselves.

In a lot of these states, although they offer concealed carry permits, you do not need one to legal concealed carry. For example, I live in Arizona. Here you can legally open and concealed carry without a permit. However, you can attend training and get a permit anyways. This allows you to carry your gun across state lines into other states that recognize the permit through reciprocity.

The reason why Stand Your Ground laws are so important isn’t necessarily so you don’t have to retreat, it’s more so you don’t have to prove that you tried in court. Without Stand Your Ground, a court may require you to prove that you first attempted to retreat before firing your weapon or that there was no where to retreat to, which can be difficult to prove in court even if you did attempt to retreat first. It’s less about what you’re legally allowed to do and more about how self-defense cases are handled in court.

"Shall Issue" came about because laws gave Sheriffs (no thanks to you for that construct) broad discretion to judge applicants for concealed carry permits. Vague factors such as "moral character" resulted in arbitrary denials, long delays, and no effective due process. Needing to meet an undefined standard of "need." Jewelers who carried bags of diamonds were denied permits - no need. So the laws were changed to require clear, specific criteria and removed all discretion. Also forced quicker processing. Still subject to background checks and completion of an approved class. The class in West Virginia (#6) can be a one hour class, but has to be hands on.

"Constitutional carry: Constitutional carry means that the state’s law does not prohibit citizens who can legally possess a firearm from carrying handguns, (openly and/or in a concealed manner) thus no state permit is required. Dave mentioned someone threatening to knock you out as a stand your ground defense, which I think is how a lot of people end up getting in trouble, it has to be a threat to your life. Stand your ground just means you're not required to try to flee before resorting to self defense, but it's a very gray area using that defense because there will be a lot of what ifs brought up. You never know just how far someone will take an altercation, which is why as gun enthusiast myself, I always try to remind those I talk to about the importance of de-escalation. I have my gun in case I need it, but using it is the VERY last thing I WANT to do.

If I'm threatening to knock you out, I may as well be threatening your life. If I successfully knock you out, you might hit your head in the fall and die. You might die from a concussion. I don't have the right to go around threatening physical violence against people. They need to be giving me a reason to get violent and then I shouldn't make threats, I should just act because it's necessary. "Stand your ground" in most cases negates the requirement for escalation of force. If you're bigger than me or more physically capable, you are a lethal threat. I shouldn't be required to risk my life and well-being to take time in assessment of whether or not someone threatening violence is capable of making good on the threat or even if once they've succeeded in knocking me out , they intend to stop at that. Once I'm knocked out, they might decide to hit me over the head with a brick. The point is, if you don't want to get shot, you shouldn't go around making threats. We'd have a much more respectful society if the government agreed.

East St. Louis which is across the Mississippi River in Illinois is where I would say the city gets its bad reputation from. I live 3 from both St. Louis and Chicago. As for Chicago well it's complicated lol. The city by far as the strictest gun laws in the country I would say when combined with Illinois gun ownership requirements of a FOID card (firearms owner ID) required to purchase guns and ammo in Illinois and any other state. Card issued after background check by Illinois State police, and that not counting government background when you go buy a gun after you get a FOID card. Yet in Chicago and Its suburbs there are no gun shops to buy guns or ammo, strict city ordinances on even owning a gun let alone operation of one within city limits. It wasn't too long-ago Chicago would have a shooting nearly every day, with some weekends in the summer where a dozen or so people be fatally shot. The lockdown gave some relief. Mainly it is worst around the southside of the windy city. So, of the two Cities honestly St louis is a little bit on the up and up. However, Chicago is just such a unique city where you can see everything from a busy downtown right into a protest march on your walk to go see a football game then find the last pub which closes at 4:30 in the morning (it is where all the local pub workers go when their pubs close at 3) to walk out on streets at that early in the morning downtown it's like a ghost town. Got some great pictures and few videos from my last Bears NFL game trip I took there. And the two days I was there only heard one gunshot. Every city got its places to not go at certain times. I say why let a bad rap ruin a great time when all it takes is a few smarts and then no worries to be had.

Before discussing "stand your ground laws" (sygl) you have to understand when you can use deadly force to defend yourself. There are four requirements and they must ALL be established. They are: 1. The threat must be immediate. 2. The threat must be unavoidable. 3. The threat must be one with the possibility of death or severe bodily injury. 4. The threat must be towards an innocent. (Innocent in this context means you are not in the process of committing a felony.) If all four have been established, then and only then "sygl" are activated. In states WITH stgl after the four requirements have been established, you no longer have a duty to retreat before you defend yourself. Obviously, if you can safely retreat then the four requirements have not been established and sygl are null. In states WITHOUT sygl, you always have a duty to retreat before you defend yourself even if you cannot safely do so and sometimes you have to prove in court you attempted to retreat before defending yourself. Be very wary about media, politicians and organizations with an agenda. What they say about sygl is often skewed and dishonest. They'll actually try to make people believe it means you can shoot anyone at any time for almost anything. That's not the case at all.

Dave was kinda wrong on his Stand Your Ground (SYG) description... it has fukall to do with bears. If you or another person is being threatened by wildlife, you have an absolute right to shoot that animal. The difference between SYG and Duty To Retreat (DTR) is this: In the 15 DTR states, you are not legally allowed to use deadly force to defend yourself if the jury concludes that you could have safely avoided the risk of death or serious bodily injury (or the other relevant crimes) by retreating with complete safety. In the 35 SYG states, you are legally allowed to use deadly force to defend yourself, regardless of whether the jury concludes that you could have safely avoided the risk of death etc. by retreating. There are stipulations and provisos that need to be met to claim self defense but the main distinction between a Not Guilty plea and a Self Defense plea is the fact that claiming Self Defense is, in effect, an admission of guilt. And unless a jury finds that you're privileged to claim Self Defense then you're jeopardizing your defense because you admitted to the act of homicide and that's why so many lawyers advise clients against offering that plea. [EDIT] One of the biggest provisos that nullifies any DTR laws, if the event occurs WITHIN YOUR HOME, there is absolutely NO Duty to Retreat. In Texas, this includes your "curtilege" or the porch and garage.

Great reaction as usual. Thank you. In the U.S. our 2nd Amendment recognizes the individual's right to bear arms to defend themselves and to deter, resist, or defeat the implementation of a tyrannical government. The U.S. cannot be compared to any other country in the world when it comes to recognition of individual freedoms and individual rights. In the U.S., having the ammo and the guns stored separately is ludicrous. If someone breaks into our homes, it is assumed they intend to do us harm. We must be able to access our firearms in a matter of seconds. The old saying here is, "When seconds matter, the police are only minutes away." We have a right to defend ourselves. Whoever wrote that law in the UK should get charged with a count of premeditated homicide, every time a citizen is bludgeoned to death during a home invasion. You say it shouldn't be that way in the UK but if you suddenly had the right to carry and the right to self defense with a handgun, people would mysteriously learn to keep their mental health issues to themselves almost overnight. The places in the US with the most violent crime rates are usually the cities where law abiding citizens can't carry guns. An armed society is a polite society.

"A stand-your-ground law, sometimes called "line in the sand" or "no duty to retreat" law, provides that people may use deadly force when they reasonably believe it to be necessary to defend against certain violent crimes (right of self-defense). Under such a law, people have no duty to retreat before using deadly force in self-defense, so long as they are in a place where they are lawfully present. The exact details vary by jurisdiction."

Stand Your Ground is not as you were speculating it to be. Without SYG, there is a legal obligation for someone conceal carrying to take an avenue of escape should it present itself. SYG is not about bravado and not taking any shit off an offender. You see, in a self-defense situation, you experience physical symptoms like loss of short term memory, loss of dexterity, tunnel vision, loss of hearing, etc. This is why conceal carriers typically volunteer for tactical training to build muscle memory so that in a real life situation, they follow their training that's impossible to forget like never forgetting how to ride a bike after you learn. Because of these physical symptoms, those in a self-defense situation will often not be aware of an escape route even if it is obvious. Then in a temperature-controlled courtroom, overzealous prosecutors can take advantage of this situation and say to a jury of clueless soccer moms, ah-ha! You see here? The Defendant had an opportunity to escape, but he's a vengeful vigilante who took the law into his own hands. SYG eliminates this possibility. However, the law still imposes several other requirements for a shooting to be ruled justified self-defense. For example, the shooting must be consistent with the threat. If the assailant is beating on you or lunging at you with a knife, then the shooting is justified, but if he verbally threatens you or slaps you on the shoulder, then you're almost certainly criminally liable for shooting. Also, the threat must be imminent. Remember that scene from Austin Powers where the guy is holding out his hand screaming, "NNOOOOOOOOOOOOOOOOOOOO!" when the steamroller is hundreds of feet away barely moving? Ok well if that guy mowed down Austin Powers with a machine gun, he would not be justified, because the threat wasn't imminent lol. Other similar common sense laws also apply, so SYG doesn't mean you get to go around legally shooting people in the face because they call you an asshole or something.

I can understand why Texas isn't on this list. Sure, Texans can own any firearms that are legal at the federal level with no additional restrictions. But unlike most other states, Texas has absolutely no public land managed by the Bureau of Land Management. So you can own whatever you want, but good luck finding a place to go target shooting. Also, the Texas economy is indeed very strong, but the cost of living has become outrageous over the last few years.

I've lived in Missouri my whole life and can say that if you were take St Louis out of it, it's a pretty decent place to live. @marksmith4892
@marksmith4892 Жыл бұрын
Actually St. Louis is pretty much the way you described KC. All the crime is on the east side of the city across the bridge. Having said that, the reason St. Louis gets a bad rap overall is because it deserves it. The per capita murder rate is the highest in the entire U.S. so in terms of the *rate* of murder, St. Louis is definitely the murder capitol of the USA.

I live in a suburb of St. Louis and it is definitely not as bad as people make it out to be. The reason it gets such a bad rep is because the actual city just encompasses a little more than down downtown. With that people can say that St. Louis has the worst stats for crime and things, but in reality that is just because the actual city does not factor in suburb areas as other cities. I will admit though that you have to be aware of your surroundings if you go to certain parts of the city, but that is everywhere. In general though the suburbs of St. Louis are very nice and they are continually ranked as the best places to live in the whole state of Missouri year after year.

Open Carry is More Likely than Concealed carry ….for most states you have to have additional background checks to conceal carry (classes about how to identify your conceal permit when pulled over etc). Part of the reason we have private ownership of guns is for the government to stay in line. But also because when we fought off Britain the government couldn’t make enough weapons so people fought with there own guns and ammo for the first couple of years then production became more capable mainly because of Frances shipments of weapons so private guns is part of the reason we are free today besides if the government decides to go crazy we can gang up and deal with the government so we are not completely crazy

I hate to be political but politics has a lot to do with gun friendly States. Keep in mind I'm an independent that leans conservative on some issues and liberal on others. As the democrats pushed for violence and protest in the streets it caused those same democrats to move out of those cities/states. They end up moving to conservative/Republican States where there's less violence and a better way of living. The problem is they start voting Democrat in those places and making places like Texas push back towards a more liberal lifestyle. Which is the reason they left their city/state in the 1st place. And the democrats push for more gun control but it's mostly democrats doing these mass sh**tings.
