In reading Streets on Torts, I notice that interference is treated differently from unreasonableness. For example, the courts would consider sensitivity and locality of the claimant when determining interference. Under reasonableness, Street on Torts intimated that the courts would consider factors such as duration, extent, character of the harm as well as the social value of the use interfered with. Are these (interference and unreasonableness) supposed to be treated differently. I ask because during your presentation, you put the factors that the courts consider together.

Hi Dzifa. The 4 factors of establishing the tort of nuisance (who can sue, who can be sued, interference and unreasonableness) are considered separately. However, each (especially interference and unreasonableness) may be contingent on one-another. Therefore, there are occasions in which you would discuss both together.

Does this apply to multi-dwelling properties such as Condos? I've been emailing back & forth w/Property Mgmt for 9 months now, advising them of multiple infractions & non-compliance, have police event reports, evidence, witnesses, but the nightmare neighbors have yet to receive a citation & my quality of life has been negatively affected.

Depending on your jurisdiction, I believe you would be able to take the matter up directly in Court via your Solicitors.

The Law Simplified Thank you. I appreciate the information and response. The Property Management tells me the "issue has been addressed", to wit I respond, "Addressing an issue does not equate rectification of said issue." I also don't understand why the police have yet to issue a citation. The police have given me event reports, which prove my nightmare neighbors are in violation of Noise & Nuisance Laws.

It’s a bit difficult to establish under public nuisance as a sufficiently large class of persons would have to be considered to be affected in such an abnormal manner.

Hi Alex. There are precedent caselaw, such as Wheeler v JJ Saunders, where 'smell' was established (on material facts) as amounting to nuisance. Therefore, in your scenario, subject to the smell NOT just specifically affecting you but of general nuisance, it may qualify.

Coming to a nuisance is an ineffective defence. See cases Bliss v Hall , Miller V Jackson and coventry V lawrence.

Common people have nothing to say about those who create nuisance. They are what they are. It is best to not mess and let them be. It is also helpful to be cordial and be clear about that. It avoids unnecessary clash if they seem to not relent in their behaviour of different kind or which may not be easy to know. Accepting them as per their way of life is the best possible solution to be at peace. There are laws to deal with wrong deeds if they occur. To live in harmony people need to maintain distance and need to just be careful. Offend noone and defend noone be the policy. These are my observations about nuisance.

Okay, the video is decently organised; however, the pronunciation is very poor which makes it hard to understand a lot of the terms. Further, the handwriting is beyond horrible which makes it difficult to read some words which are critical vocabulary. I hope this can be changed.
