Ok so. 1. The buyer received a stolen card that can now be confiscated. 2. The owner is entitled to the 1k… you sold his card…. Guy needs to send him a demand letter for the card or $1k. Moe’s ass is going to freak out with all the evidence in plain sight.

You’d think it works that way but it sadly doesn’t. Not even worth it in lawyers fees either. The dude will likely laugh any kind of threat or demand straight to the “bank”. Not saying it’s impossible but the likely scenario would be that it doesn’t go that way or it ties them both up for 6-18 months. Easier just to call the dude out repeatedly. I will say this much. The guy is a douchebag but at least he actually didn’t straight up rob him and the OG buyer did make a profit. He should have split the profit with him in the first place or at the very least, give the OG buyer like $300. My guess? This guy was never even in real possession of the card. He was using OG buyer to float money to pay bills and when he got the money that was tied up, he paid the guy back with a tad bit of interest (in a short period of time too). It’s shitty no doubt, but MANY people do the same thing with credit cards every single day. As long as you can guarantee the money will be back in under a certain period, there’s nothing wrong with floating money very temporarily and not often. It’s smart actually since you’re saving on penalty and interest fees. Guys still a lite douchebag for sure though. He should have just been honest and asked someone to float him or whatever he was trying to play at.

I've had NUMEROUS times I have sort of screwed myself, like probably 3 times in the last 8 years or so. Sucks, it happens, but guess what? I shipped the items, (mostly auctions that didn't get nearly what expected.) I don't do that, no matter the cost. My ntegrity is far more important to me and customer satisfaction will always be #1 for me as a seller.

Uses your capital to profit $1k and then sends you $100 and refunds you and acts like he wasn’t in the wrong. After the fact, acts like he never owed you anything and pretends like you’re the bad guy for expecting Moe’s promise to come to fruition. The wildest part for me was how he flexed the gains to the person he screwed over. That's just in bad taste. What did he expect the person who put him onto the card to even say at that point but fk me lol. The whole deal sounded a bit iffy and as soon as dude came back with 3.1 when he said 2.5 to 3 max was grimey. It's not theft but it's bad for business for sure. I wouldn't tell him the name of nothing lol.

@@Rynik05 yeah I see other people saying that same thing but possession is 9/10ths of the law. A small claims court judge may go so far as to split the proceeds but maybe not. What the person did wasn't illegal so much as it was unethical and sleazy. It's no different than rsvp'n a hotel room a year in advance and then some event being announced that entices the hotel to refund you. A terrible practice as it could be made public but again not illegal.

@@nah4215 yes it is. He took possession of an item purchased for someone else under contract. He does not own the item. He then sold something that he does not own… therefore the buyer received stolen merchandise. (Contract terms were established and payment was made. It was confirmed as purchased and item was in possession). This isn’t flip and dip central. There are actual laws in place for these exact types of things that many other brokers/procurement for items have to adhere to. This is exactly why stock brokers, hedge funds, car dealers, any other business on the planet. If you take possession of an item for someone else; you do not own the item. Send a report to the IRS. Let them know the illegal sale took place. Guarantee he isn’t filing taxes on that $900. Add another felony fraud to his list. Moe Money Moe Problems.

@@nah4215 that is how a contract works. He bought the item for someone else, as agreed upon. He does not own the item. When he accepted the funds and completed the transaction, he became a transport for the item. That is how brokering items works. Had he purchased it with his own money and chose to sell it instead of fulfilling the offer; that would have been slimy but legal.

He also most likely made money off of the card to start with. When a dealer has a card that high wanting to be bought they will usually cut a deal of about 10% if it can be sold especially in Cash. Moe was already at the Convention there was no I have to go and pay to get in to get your card scenario. He most likely made his 10% but got greedy when he saw he could make another 1k even lying he would split the profit just to try and appease the buyer. Moe is essentially wanting everyone to buy his inventory for him and treats his buyers as investors by lying and saying he will buy cards for them so he can get their money.

People need to be smarter do not deal with dealers or "flippers" they will only use give you 30%-50% of real value. They look and say you need to look at the inventory "storing" cards do not take up that much space like comics. If the card is graded and sealed and you want to sell only take 75%-85% to dealers and "flippers".

I had a douche call me a scammer cuz his card had a tiny white spot on it and i had clear as day pics of my card but he claimed they were blurry and nobody agreed they were blurry. I think he tried to scam me to say its the same card but he actually swapped them. Idk but so buyers can scam too. Its all scams 😅 He would cry to me when he would buy a card and it would grade a 9 even...i was happy to not sell to him ever again. The lowest grade any card i sold him, ever, was a 9 😅 not even one 8. Its funny cux i found a local buyer now and he tells me i take better care of my cards than anyone he buys from. They would go from pack to sleeve. Always. Oh well. I only deel with trustworthy pple now and have tightened my group. It did affect my trust selling actually
